Yeah that's what it seems like, the cans werent automatically available in every state at the same time. Some Wal-marts stocked the cans much later than others. Still dont know if these cans have hit any other countries other than China? Btw loving the MJ adjusting his glasses gif. Real coo! cool

Judge rules website violated Jackson copyrights

LOS ANGELES (AP) — A federal judge ruled Friday that a businessman working with Michael Jackson's mother has violatedcopyrights owned by the singer's estate and should be blocked from future uses of the work.

U.S. District Judge Dean Pregerson sided with the singer's estate in a ruling against Howard Mann and the website www.michaeljacksonsecretvault.com , which appeared to be inactive Friday morning.

The estate sued Mann in January 2011, claiming he was violating copyrights and posed unfair competition to Jackson's estate. Pregerson ruled that the website improperly used art from the film " This Is It," a logo featuring Jackson and the song "Destiny," as well as other material.

"In light of defendants' past and present infringement, it is also undisputed that future violations are likely, causing ongoing harm to plaintiffs and misled consumers," Pregerson wrote.

An upcoming trial will address damages, although the judge noted that Mann and the site probably will not be able to pay any amount because of debts.

A phone message for one of Mann's lawyers, Lee Durst, was not immediately returned Friday. Mann has collaborated with Katherine Jackson, who is a beneficiary of the singer's estate, on several projects, including a book of recollections about her son. Several of the Jackson Secret Vault releases occurred at the same time as estate projects were being released, including the anniversary of Jackson's death and the release of the album "Michael" in December 2010.

Mann's attorneys recently wrote in court filings that they hoped to introduce evidence during the upcoming trial that the singer's will was a fraud. The businessman had claimed he obtained rights to the works in a bankruptcy sale years ago, but Pregerson ruled there was no evidence that the items could be used commercially.

"The court's ruling makes clear that Howard Mann had no right to use Michael Jackson's intellectual property for his own benefit," attorney Zia Modabber, who represented the estate in the case, wrote in a statement. Estate attorney Howard Weitzman said executors John Branca and John McClain are "extremely pleased" by the ruling.

havent been able to find those cans anywhere..

anyhow, i had a really great idea the other day about a future MJ release. I feel that anything that the estate releases is going to be VERY publisised. We saw it with This is It, Michael,Bad 25.. this is not a bad thing at all, infact i would even say its a great thing.. Michael deserves it.

with that being said, i think it would so amazing if the estate would release something like this:

A new Album (titled L.O.V.E. , or Planet Earth.. something with that vibe to it)

the tracklist to be something like this: (i have never heard these songs, they are unreleased..just basing on the titles)

Planet Earth (poem)

Soldiers Entrance

Light The Way

In The Valley

Childrens Hour

Iowa

The Nelson Mandela Song

A Baby Smiles

Color of my Soul

Water

From the bottom of my Heart

Children of the World

I Have this Dream

Stop The War

include all of Michaels Humanitarian and Charitable works in the album booklet, or a mini booklet with the album.

i really feel that something like this would shine a light on how beautiful of a person Michael was..it would remind the world of what all michael has done to make this world a better place..as well as given a true and deep insight into Michaels heart..

i get what your saying about variety, but i feel that the subjects would touch on love, peace, joy, war, innocence, nature etc.. and for example i picture Soldiers Entrance and Stop the War stronger more powerful songs,Iowa is a classical music piece, Color of my Soul would (from the way the title sounds) would dig deep into michaels inner being and talk about who he really is,songs like In the Valley, and Water are probably about Nature.. it would deffenatly be a more mellow, soft album.. but id love it.

and i dont know what the Nelson Mandela song is about/what it sounds like as ive never heard it, along with the rest of those except for planet earth and a snippet of Children of the world

Your reactions were the EXACT way that I felt. It was the most amazing experience and people all around me seemed to be in awe as if they couldn't believe that this show was that great. People were crying, clapping, cheering, etc. I've never seen ANYTHING like it. The way that the show incorporated Michael's vocals with a LIVE BAND was incredible. This tribute to Michael seemed as if Michael was there himself. I love how it was a CONCERT, a tribute, a Cirque Soleil all mixed into one. It was emotional, classy, exciting, and uplifting. Every emotion that could be felt happened during this show. It was worth every dollar that spent and I would gladly go again.

Didn't know that they couldn't do this. I was totally expecting katherine to use the kids to hawk Mann's book and other products while they were in Gary.

yep. totally shut down. mann cannot reproduce any items that he bought out of that warehouse that belonged to mj, his websites which were selling mj-related items have been ordered shut down, and he cannot continue to sell the stuff he's already reproduced. he doesn't own the copyrights, therefore he cannot profit from anything mj-related.

the trial on sept. 4 will determine how much in damages mann now owes the estate for his purposeful infringement. he had been told long ago that he didn't own any mj copyrights, and he kept up with his b.s., aided an abetted by some of the jacksons . there is a basic amount set by law for infringement, and i think it can be higher if the person or entity is going out of its way to illegally use the copyright. i want to say it's per infraction as well. (i took a copyright class about 18 mos. ago, but i don't have my notes in front of me and i'm too lazy to google at the moment!)

so that's really why i want to see this 'trainwreck'. mann is about to have a monetary judgment assessed against him. will he turn around and go after kat to recoup "his investment"?

remember, his contract is very broad vis a vis katherine and the kids. i know at one point the estate demanded to see the contract as it pertained to the kids. will mann's contract even be upheld? (i don't think it will, since kat did not have legal counsel when she signed it, supposedly she voluntarily decided she didn't need legal counsel, and certainly the kids didn't have separate legal counsel, so i think the estate will challenge the legality of it.)

will the fact that kat signed mann's contract play a role in her future abililty to enter into contracts on behalf of the kids? (i think it will.)

mann claimed that he had some "incriminating" evidence against mj and that he was willing to return it to kat in exchange for her going into business with him. what is that evidence, if it exists, and will he now use it against kat? that's why i say, i think there is a trainwreck coming down the tracks.

I wish they would have included all of the Bad era songs on Bad 25.. this one, "Cheater" and all of the extended dance mixes.. if you're going to do a multiple disc deluxe version of an album, why not include everything from that era?
