Why would it? The estate is getting its cut when people buy the song or album And when the deluxe edition hopefully comes out it will get more I seriously doubt Prince cared, he was alive when she did this are you with the estate? | |

I don't think they need nor require a cut. I just wondered if she offered. The first time hearing that this shirt merchandising started when he was alive.

On principle maybe to recognize that he co-wrote the song. The money is not the point. I know this isn't that big of a deal but the principle of claiming full credit for a song co-written by a deceased man that you once dated--something about it rubs me the wrong way. Due to her thinking that everyone already knows that Prince helped formulate the lyrics and wrote the music, it might not be her intention to mislead folks (probably isn't. in interviews I havd read of hers while he was alive she was classy about Prince)....but none of us are perfect.
I know he is the rich powerful one (or was) but a song is like a baby to someone like Prince. Its his child too. Prince was brought to task by fans everytime he didn't give proper credit and it has been implied that the Revolution is so humble that they selflessly often don't take credit even when they deserve it. But she gets full credit *by implication* and who cares because he is the big powerful one (--or was. Dead people have no power). What is good for the goose is good for the gander. I am more bothered by the double standard on fans' part than this whole shirt thing.

but that is already a given that Prince co-wrote the song.
I would always rather her make money than the people who did tshirts selling them and not having anything to do with it. And I strongly doubt anyone would make a big deal about it.

Yeah but she has written at length about the genesis of the song (while he was alive, at that). What else does she need to do? Send his estate a cut of the likely extremely small amount of money she's making on those shirts and mugs? I'm not a lawyer (I'm just a person who has worked in the music business, including song publishing) but it's my understanding that, to print shirts with some else's lyrics on them, you need to agree to a license with the copyright holder. In this case, two people hold the copyright to this song's lyrics. Susannah is one of them. And each author of a work can freely use and license out work on a cowrite. The license fee just needs to be shared (not the net profit unless the license specifies that). So if she granted herself a free license, there might not be any licensing fee to share. But I have no idea. None of us do. And none of us will unless his estate decides they want a cut. And, compared to other revenue sources, this is drops in a bucket. But yikes, I was just glancing at ASCAP, and it looks like Susannah only got a 12.5-25% split (hard to say but doesn't look like an equal split) on the song. At least, that's the share that ASCAP oversees. But yeah, Susannah did NOT make much money from mechanicals for this song. So there's no way she's been living off that, as someone implied. | |

This is all old news now. She is co-writer, and has those credits on the albums since 1987. This is all old news. We really don't have to do this just to keep it going. You are not a newbie. Now I might expect it from a newbie (I think Purplerabbithole said she was a newbie) I would expect it from them, not you. We know all this, we know the whole story behind it, etc etc etc | |

Susannah should sell Starfish and Peepee shirts, I suppose. Then she wouldn't need to pay royalties, as that was part of her story, before Prince ever did anything with it. . Which, for the record, we don't know if if she's doing or offered to do. And there's really no hard and fast rule about how many words could be used before you're found in violation of someone else's copyright. It's up to experts and possibly a judge or jury if it comes to that. It's the kind of thing where you know it when it see/hear it. So "starfish & coffee..." literally including the unique title lyrics is pretty clearly in that realm. Whereas, if you wanted to sell shirts that said, for example, "if you set your mind free maybe you'd understand" might not. It's kind of a more common phrase. You could argue Prince was far from the only person to use those words. | |
