Spike Lee: MJ biopic impossible

The film will be released on DVD as part of the Bad 25 deluxe album package on September 17.

Since when?

I don't think that's correct, i thought it was a seperate entity from BAD25?

Yep, which one did you get? I have the smooth criminal one ;D....

I think it's the same. I've moved house twice since then so it's in a storage box somewhere.

Just the little interview he did with Chris Rock. Michael never even commented that incident. Come on now, MJ wasn't petrified - he the most known superstar in the world. He sold out the 02 arena in seconds and he hadn't performed since 2001.

It's unnecessary to be defending Prince - because in all honesty we may never know the whole story between these two. As far as we know they were friendly rivals in the music industry, I woudldn't call them friends as their is nothing that suggests they were friends. In fact before Lisa Marie Presley got married to MJ, she attended a party were Prince was also going to and she wrote a note to MJ saying, that she was sorry for the inconvience of Prince being at the same place. Prince went to see MJ in 94 while he was recording the HIStory album and it was only Mike & Prince talking so nobody knows what was said. So there's not really much information about Prince & MJ being friends (or even meeting), I think some people want to see them as enemies, others as friends but why waste time on their relationship because it doesn't reflect their artistry. It would have been interesting to see Prince on the BAD25 thing, but we ALL already knew that would NEVER happen and not even Spike Lee could make it happen lol.

Everyone who has power or success are afraid of losing it - particularly the most powerful.

Michael was at the top, the only way he could go - realistically - was down. Of course he would feal slightly threatened by an equally tallented artist emerging as both a critical, award winning, and sales success.

Has a link to the article in USA today Michael was reading about Prince ever been posted here? I went to their site but couldn't find it. Any help would be great. So glad the doc is coming out in Sept and not on Thanksgiving, can't wait to see it!

Question regarding fans who bought tickets to see This Is It: Did anyone who paid for tickets ever get their money back? I remember reading something about Randy Phillips encouraging fans to hang on to their tickets as a souvenier instead of returning them for a refund. Did AEG refund everybody who bought a ticket?

FWIW, I'm not sure how truthful this report is, but Roger is claiming that the Jackson family is behind the leaking of the emails from Randy Phillips & Co. to the press hmmm

Jackson estate, businessman settle copyright case

By ANTHONY McCARTNEY, AP Entertainment Writer – 4 hours ago

LOS ANGELES (AP) — Michael Jackson's estate and a businessman working with the singer's mother settled a copyright infringement lawsuit for $2.5 million on Tuesday, shortly before a trial in the case was scheduled to begin.

The settlement also restricts Howard Mann and his companies from using Jackson's likeness without permission in the future. It ends a year and a half of legal fighting over Mann's use of Jackson's name and likeness on a website used to promote unreleased songs, photographs and a book written by Katherine Jackson filled with recollections of her superstar son.

Mann is the CEO of Vintage Pop Media, which operated the website www.michaeljacksonsecretvault.com until it was ordered shut down last month by a federal judge who ruled the site violated copyrights controlled by the singer's estate.

Under the terms of the settlement, announced in court by estate attorney Zia Modabber, Vintage Pop Media Group is responsible for $2 million of the judgment, while the entity Vintage Associates LLC is responsible for the remainder. Vintage Associates is the custodian of the items that were at issue in the case.

Mann's attorney, Lee Durst, declined comment after the hearing. "The estate is delighted this matter is behind us," estate attorney Howard Weitzman said.

Among the items that had been improperly used were images from Jackson's posthumous film "This Is It" and a silhouette of the singer dancing in "Smooth Criminal." The settlement also blocks the usage of materials from "Thriller" that had appeared on Mann's website.

A jury trial on how much Mann owes the estate had been scheduled to begin Tuesday, with an expert estimating a license for the works is worth between $5 million and $12 million.

Mann's attorneys rejected a settlement offer last week of $2 million. They sought to introduce evidence that they were given bad legal advice about having to license the works and have considered calling Katherine Jackson as a witness. The Jackson family matriarch is one of the beneficiaries of the singer's estate, along with his three children.

U.S. District Judge Dean D. Pregerson has noted that Mann doesn't appear to have the resources to pay a large judgment. The defendants' ability to pay was not discussed in court on Tuesday.

Michael Jackson: AEG’s Lawyers File for Monetary, Evidentiary Sanctions Against Jackson Family

Exclusive: As I told you it would happen AEG Live has filed two motions in Los Angeles Superior Court against the family of Michael Jackson. The motions are a response to the leaking of emails in the Jackson family’s wrongful death suit against AEG to the Los Angeles Times. AEG wants monetary sanctions and they want to make sure everything concerning Michael Jackson’s health and other personal information is sealed.

There had been a protective order prior to this, blocking any release of information that AEG had turned over to the Jackson side during the case. Now that that’s been violated, AEG wants the court to fine the Jacksons at least $50,000 and to investigate how it happened. They also want everything sealed including testimony from Kenny Ortega, producer of the “This Is It” concerts. The court date for hearing both motions is October 24th.

In addition to monetary sanctions, AEG wants evidentiary sanctions, too. They’re asking the court to prevent the Jacksons from using the leaked emails as evidence in the future–that they’re essentially tainted. If the judge rules in AEG’s favor, the Jacksons would essentially have done themselves in.

On Sunday, September 2, 2012, the Los Angeles Times published a misleading and inaccurate article about AEG’s supposed role in Michael Jackson’s life and death. This article was based on an incomplete set of highly confidential documents leaked to the press despite the fact that a court had ordered that they not be disclosed. As such, the documents were taken horrendously out of context and were calculated to be as damaging to AEG and as misleading as possible.

This is from AEG:

“AEG believes the unequivocal evidence shows that Katherine Jackson and her attorneys leaked these documents to the press. The documents released to the press were given to Mrs. Jackson and her attorneys—and to no one else—confidentially in discovery and subject to a court order. Accordingly, AEG has today filed a motion for sanctions against Mrs. Jackson and her counsel for this unlawful leak.

AEG was asked to comment on the article and to provide documents in its defense that would tell a different and more complete story. AEG, however, was unwilling to violate the court’s order in its defense. Many of the documents and other sources that support AEG’s position had also been designated as confidential by third-party witnesses in Katherine Jackson’s lawsuit against AEG. These witnesses trusted that their materials had been provided in confidence, that their confidentiality would be respected, and that only the court could order the materials’ release. AEG could not and would not violate those witnesses’ rights by turning their documents over to the press without their permission.

Even without those documents, however, the story as written shows that Katherine Jackson’s claims against AEG are simply not true. The story acknowledges, for instance, that Dr. Conrad Murray was Michael Jackson’s long-term physician, and that it was Michael Jackson who demanded to bring him on tour. The story also acknowledges that no agreement with Dr. Murray was ever signed, and that Dr. Murray was never paid by AEG.

The story also acknowledges, albeit obliquely, that even after Michael Jackson appeared ill on June 19, 2012, both Dr. Murray and Michael Jackson himself repeatedly insisted that Michael Jackson was fine, healthy, and eager to perform the concerts. And again, as the story acknowledges and the film This Is It demonstrated, Michael Jackson backed up that claim by performing brilliantly at the next two rehearsals. AEG could not, and did not, cancel its agreement with Mr. Jackson, a respected performing artist who insisted he was ready and willing to perform, simply because he’d been ill one night.

Given all this, one might wonder why Mrs. Jackson or her counsel would choose to leak these documents. After all, their publication hurts her son’s memory and her grandchildren more than anyone else. Unfortunately, the reason plaintiffs chose this course is transparent—plaintiffs know they cannot win on the law and are losing control over the case. After months of discovery, plaintiffs now know what we have known all along – there is nothing to support their claims. Defendants did not hire Dr. Murray nor were they responsible for the death of Michael Jackson. In the meantime, we’ve all watched the press as the Jackson family has made ever-more-wild accusations against everyone involved in Michael Jackson’s life— except themselves.

We look forward to telling the full, complete and accurate account of what actually happened, when the materials that were unlawfully leaked to the press can be put in context and the full story can legally be told. Until that time, defendants will continue to abide by their ethical obligations and the orders of the court.”

I much prefer his appearance with minor adjustments (1980-1983). In Bad era he was a very attractive, but beautiful in the doll sense. Although Bad era looks perfectly suited to his androgynous image, beautiful and unisex.

That's why I say the biggest MJ fans are usually my age as far as appreciating all eras of MJ's music. I was too young for Thriller but was aware of him in the run up to Bad, but Bad was where it truly began for fans of my generation. Michael was like a superhero to us. All the racial ambiguity and angrogeny was completely irrelevent to us as kids because none of that was even recognised letalone an issue. He was just this beautiful thing with an amazing voice, talent and music. I didn't get into Prince until a couple of years later as his music was more adult-themed so there wasn't even a rivalry as far as I was concerned then because Prince and Madonna weren't even in my consciousness until around 1989 as they just weren't kid friendly. It was all about Michael and Kylie Minogue - strictly speaking for UK'ers on the latter front. But at the same time, Off The Wall and the latest Jacksons material was still less than 10 years old so was still accessable and kind of current, so it wasn't much of a stretch to go back and discover the past, which is what I did in the break between Bad and Dangerous.

Yeah, it's incorrect. Spike's film won't be included in the package, the DVD that's in it is the Wembley concert (and another DVD that includes the music videos). It's premiered in some theatres, and will later get an edited release on TV or probably video-on-demand.

I can't wait to see it, regardless...

I love all of MJ eras of music but I would say my favorite is BAD because I just love everything about the album, concerts and music videos. I loved Moonwalker

Michael looks sexy as hell on the RollingStones cover.

His sex appeal wasnt contrived and was natural which made him more mysterious, sexy and interesting during that period.

I agree with a lot of this! I knew of him before bad in flashes cause of family playing or having thriller songs and also being told I was going nuts for him at 1 and had sparkly gloves (but no camcorder wah!), and madonna was my favourite, also liked Prince. But the beginning of the Bad era and seeing EO was the first era I remember taking place though not the entire thing, I was still too young, but I did own thriller viewmaster slides along with other superhero ones, so I suppose I saw him as one of those as well. I remember the Dangerous era too, though only during Black or White, Oprah interview and for wybt while it was taking place. I didn't get his changes though I simply thought I was too young to understand and will get it someday, then read about vitiligo when I got the net in the 90's and became a proper fan during HIStory when rediscovering him and more songs and videos I missed out on, and the albums which made me appreciate him in a new way and realizing some songs I liked before were actually his! and would be upset at adults mocking his looks and not believing it even when I told them *smh* lol

I think Bad was the beginning of the end. I remember looking at the album cover and thinking where has Michael Jackson gone. Having lived through the Jackson era, OTW and the Thriller era, which was truely his peak the Bad era just came across as tacky and full of hype.

Michael exactly became more of a global singer with BAD because of the tour so dont know how it was tacky and full of hype. He grew alot as an artist and wrote every song on the album except three and had innovative music videos... Im not sure if your talking about his appearance or him as an artist?

Michael was always a very hot and attractive man, with or without surgery. I personally will never understand why the jacksons are obsessed with their noses, but MJ was FINE before surgery and after. Not so into his look after 96 nor Invincible era....
