Woman Gets Pregnant Despite 'Contraceptive' Surgery

Lawsuit Seeks More Than $50,000

CHICAGO -- Laurie McDevitt sued her doctor Monday for negligence after she had a procedure he said would prevent pregnancy and she got pregnant anyway.

McDevitt claims her gynecologist, Edwin G. Szela Jr., told her undergoing the surgery called endometrial ablation (no comma) would prevent her from having any more children, according to a suit filed in Cook County Circuit Court.

Szela Jr. allegedly told the plaintiff the procedure was "contraceptive in nature" and advised her she could never become pregnant again.


McDevitt became pregnant despite the Dec. 28, 2005, surgery.

The suit accuses Szela Jr. and Women's Health First, the facility where McDevitt underwent the surgery, of negligence. The plaintiff had to incur large sums of money for her pregnancy and suffered medical complications, the suit said.

The plaintiff seeks in excess of $50,000 in damages.
