What do you think is going on from a legal perspective? If Prince had a handshake or oral agreement is it enforceable. How would Jay-Z have obtained the files if he did not get the files from Prince? Why would the estate say he did not have permission to put the files up as I think the estate would have contacted the FBI by this time or sent a court order to have everything taken down?
Copyright Infringement issues are very serious.
What breech would Jay-Z have made if he did not pay the upfront money for Hit and Run if the agreement was oral? How does anyone prove anything without an actual contract.?
Something just does not sound right about this whole thing. Even bringing in Universal when NPG music was the admin. Can the family break any agreements made by Breamer once they take over. I can't understand why they would not want to administer their own rights.

Reading the legal papers Tidal filled today I would say you are correct.

I found the listing after a good deal of work but it doesn't look like I can buy Exodus or even listen to the samples. 20ten and a few others are still available - but it seems like some of the instrumental stuff and NPG stuff might be gone. With that said, I did have an issue searching in general and frankly the site totally sucks, so we'll see. Worst interface I've EVER had to fight with.

I can't imagine there is any way to enforce a handshake deal (if that's what's happened). So either Jay-Z already has the files or has a contract.

I just found this. It is dated today 11/14/2016

I asked Prince what he was planning to do. He told me , I'm going to look for the ladder. I asked him what that meant. All he said was, sometimes it snows in April. - book D.M.S.R.

. Still doesn't mean they had the RIGHTS to provide them to the public. In the mid-1990s Edel also released some NPG albums and singles it wasn't supposed to, e.g. the Jacob Armen one. Yup, Edel got DATs and artwork, yet never got permission to release that (and some others IIRC). NPG Store in Minneapolis and PP were stunned to get requests for those, since they weren't supposed to be out there. © Bart Van Hemelen

It is funny how Prince passes away after starting this informal business relationship with Jay.I admit I've enjoyed some of his music but I've never trusted him like most of us dont.We all know a star is worth more dead. Been a Prince fan for 36 years but I have Spotify premium because something about the whole Jay Z/tidal thing has never felt right regardless of the sound quality or not. This is on Spotify and Apple Music as well, together with a single release of Just Another Sucker.. . By the way, some people in this tread said that all albums were available at Tidal before he died, that's not true: the latest addition of 15 albums became available on Tidal at his birthday June 7th.. This was including Black Album, 20Ten, Crystal Ball, Rave In2/Un2 etc.

Tidal is saying they have a Equity Term Agreement and they have threaten to file a injunction so they must have something in writting. Now what they have will have to be shown to be a valid contract so we shall see. What we do know as that as of today all of that music is still on Tidal. If the estate thinks Jay Z is streaming music without permission how come the estate has not gone to court got a order to have everything taken down?
We are 7 months after P death and Tidal is still streaming so something weird is going on and the Estate should not have gone out and cut deals until they had this resolved.

Exactly, Prince liked Jay-Z and wanted to do business with him. If anyone is doing something shady it is Breamer.

I don't trust Bremer and I don't trust the Estate. Just look at the karaoke nonsense happening at Paisley theme Park now. What we do know, categorically, is that Prince was working with Tidal and delivering exclusive material to them right up until his passing. The people running the Estate now were NOT approved by Prince and that includes his sister whom he never officially employed at any level during his lifetime.

Tidal stole Prince's catalog.
Digital Music News is reporting Tidal uploaded droves of Prince's music for streaming and didn't have the rights to do so.
A total of 15 albums are in question and it doesn't appear that a deal was in place.
JayZ failed to pay $750,000 for an earlier Prince exclusive.

Go to the court website and read Tidal's claim. Jay-Z is claiming he has a equity term agreement. As far as money goes if Tidal owes the money they will have to pay up but for Breamer not to know an agreement was in place is very bad look.
Of course the agreement will have to go to a court to make the final decision but it appears Tidal does have something in writing. It does not matter in the end because the family will in control one day and they appear to want to continue to work with Jay-Z and I hope they continue to do the administration in house as well.

? They are not appearing to want to work with JayZ. Did you not read the article? They've streamed and stole 15 albums from Prince. Does that sound like the Estate wants to do business with JayZ? If they did, they wouldn't have sold some things to Universal.
- E-mail - orgNote - Report post to moderator |
We don't know that anything was stolen. Tidal clearly believes they had permission. We'll see how this plays out in court.
