I agree 100 percent. If they wanted too they could work around it but just don't stray too far from the original.It's strange though, because a couple years back the original guys were on tv and said they had Prince's blessing. Everything will always be one sided because Prince is not going to comment so it's easy for anyone to say" Prince said we cannot do this or that". I hope they put it out though...curious to hear how they sound.

I can't see where Prince owns the rights to names of The Time, Vanity 6 or The Family. It appears that Prince clearly does own the rights to the name Mazerati, but that is a fairly recent development and he has approximately 3 years to use it or he will lose his exclusive right to do so. If I was a member of The Time or The Family I would welcome a name change. The bands would run into the same LEGAL HEADACHES Prince did in trying to secure the rights to the name. It looks like you can't own THE TIME or THE FAMILY because the names are simply too damn vague. Maybe Prince threatened a lawsuit or wouln't sign a clearance with them. I don't know. But a name change looks like the path that would be the most advantageous to the guys.

Doesn't Warner Bros own the rights to the names of the Time, Vanity 6 and the Family? If so, that can explain what's really going on, and maybe due to Prince's estranged relations with Warner Bros, he might've allowed WB to keep those names in their books, meaning if the groups were to come back and release new material, they would have to change their names, otherwise they wouldn't be allowed to release it. I could see that being more of a possibility than Prince having control problems. It's odd at times people think Prince is a control freak, it's usually with issues that he's not in any position to be in control of. Maybe this has to do with the label than it does with Prince. Also The Time members have their own careers on top of that so that could add to it.

No. WB only has rights to the master tapes and maybe some publishing on the old albums. Nobody owns the rights to the names. Prince applied to get the rights to those names but HE WAS DENIED. The bands themselves would also be denied because the names are simply too common.

But here is the part I wonder about. It has been said that the bandmembers have no contract with WB or Prince. That would seem to be true given how the various bandmembers were FIRED or quit or whatever over the years without any legal action by any party against another. Yet their NAMES, IMAGE and LIKENESS appears on millions of album covers. Are they being paid for that? Do they get royalties? Morris Day in particular, because he appears on all the records. He likely gets something from the publishing since he is listed as a co-writer, but that is an entirely SEPERATE issue. Are the bandmembers being paid royalties from RECORD SALES? If not, WB and Prince may someday have to address that.

Like I said, this is all about legal maneuvering. The passive aggressive nature of the conversation by the players involved will turn to full blown attacks by lawyers unless an agreement can be hammered out.

Prince doesn't seem to like the airing of dirty laundry, but there are too many disgruntled ex-players "Prince World" and when money is involved, dirty laundry is always on parade. (or coyly dangled on string as we have seen)

Regardless, the full story will come out sooner or later.

They charge in a lawsuit that they have not been paid for their share of years of home video releases and licensed merchandise that used their images and voices.

The cast of the classic sitcom Happy Days isn’t too happy with CBS Studios and Paramount Pictures, charging in a lawsuit that they have not been paid for their share of years of home video releases and licensed merchandise that used their images and voices. The plaintiffs say the damages are at least $10 million plus interest and possibly punitive damages.

The suit was brought Tuesday in Los Angeles Superior Court by Anson Williams, Marion Ross, Don Most, Erin Moran and Patricia Bosley, who is executor of the will of her husband the late Tom Bosley.

Ron Howard and Henry Winkler, also stars of the iconic show, are not part of the suit.

Happy Days epitomizes what is best in America,” says the opening salvo of the lawsuit, adding that the actions by CBS and Paramount “epitomize what is worst in corporate America, exemplifying the worst business practices.”

The show originally ran on ABC from 1974 until 1984 and has been a staple in TV syndication and on various cable outlets since. It was originally produced by Paramount, but after a corporate split in 2005 became part of CBS Studios.

The suit apparently was triggered after a former cast member saw their images on slot machines at a casino. They had also watched as the show was repackaged for at least four DVD release in box sets beginning in 2004, again with their pictures on the boxes and in show photographs used inside, according to the complaint.

The suit says CBS continues to market the brand to merchandisers, quoting the CBS Consumer Products website as saying that Happy Days has “strong purchase-intent among women 18-54 and men 18-34.” CBS also sells related merchandise online with pictures of the cast on everything from mugs to T-shirts.

All those included in the suit say they had different salaries but the same contracts when it came to merchandising. Each was to receive a portion of net proceeds after the studio took 50% off the top as its handling fee, a practice the suit now questions.

This handling fee, charges the lawsuit, “regardless of actual handling costs violates defendants business conduct statement and constitutes a material breach of the implied covenant of good fair and fair deal in the agreement.”

The suit says that beginning in 2002, Moran (who played Joani Cunningham on the series) contacted the studio to see if she was owed money for merchandising but was told none was owed. They say they had no way to know the truth and only acted after seeing Happy Days slot machines in casinos.

The suit says the failure to pay breached their contracts and that CBS/Paramount is “guilty of oppression, fraud and malice." The cast believes it is entitled to punitive damages as well as at least $10 million in money they believe they are owed plus interest. They are also seeking to be repaid for their legal costs in bringing the suit.

On the show Williams played Warren ‘Potsie’ Weber, Ross was the mom Marion Cunningham, Most was Ralph Malph, Moran was Joanie and Bosley was the father, Howard Cunningham.

In a statement, a spokesperson for CBS Consumer Products responded: We agree that funds are owed to the actors and have been working with them for quite some time to resolve the issue."

I saw a report on tv a couple of weeks ago that said they didn't have contracts, so maybe they did or maybe they did not. It wouldn't matter in terms of merchandising rights. I can't market a product with your name and image, sell it and and then not pay you for the right to use your name and image without being at risk legally. The same principal could be in play for the some, if not all the members of the various bands.

In fact just Prince threatening to sue these acts from working using names, he does not control the exclusive rights to, could be the basis of legal action. If these guys lose deals over Prince threatening lawsuits, they be able to go after him for the loss of income.

JJ & TL especially they have worked with a whose who in every category in music. Plus have there own studio here in LA. They are not naive & stupid. I am sure they have done major mega deals with other artist. They did have there own label at one time. Perpective records. Plus at one time were the top producers in the industry & rivaled Prince with hit singles.So they do know the deal.

If it's true about what's going on, then how come I've yet to see this big headline of Prince suing them yet? Surely either it's true or just another tabloid rumor.

People are gonna be real mad when they release an album with little to no Prince involvement (or even, Jehovah's Witness Prince involvement) and its fucking terrible.

Sure hope they kept some of P's old tracks....
