Were you threatened/sued by Prince

Little question as I am quite new here & was wondering.

Who of you here actually received any threatening letter from Prince/ Prince organisation/lawyers regarding any youtube violation/ or other violation. Yes or no is fine, but if you'd like to elaborate please do. Perhaps you know of someone who was. I have seen the online united Prince fans site where he released F.u.n.k as a gesture, but don't know much about it all from the fans perspective.

Looking forward to your replies so I can gain further understanding of the whole story.

When I had a radio show on the internet back in 2001-2003, I played whatever I wanted. Not a problem. I eventually had two stations on Live365.com, one for a LO and one for a HI stream of the show. I'd tape the show (usually about 2-4 hours depending), and it'd stream for the month.

Later on, into year two, I took one of the Live365 stations I had, and renamed it Uptown Radio. People had broadband, and I kept the HI version of my shows on the one channel. Uptown Radio played all Prince stuff. Sometime it's play a whole album (like The Rainbow Children at the time), but I also played bootlegs. That was also about the time when the Nagoya and Sendai boots from the Lovesexy shows were coming out (as well as the "Days of Wild" CD single given out at the Celebration, recorded in Montreal.) I also played the NPGMC Ahdio shows, and the monthly tracks too. I wasn't a member of NPGMC, but a friend offered her login and I grabbed every single track.

Eventually, Prince's folks caught wind of Uptown Radio, and eventually emailed me. I was doing a LOT of rotation with the Japan boots, and some SOTT show rehearsals (the NPGMC stuff didn't seem to be an issue since it was officially released and out there for public consumption legally). The email told me I couldn't play them. I told them I could because I had them in my possession, and I "owned" them. (I know.....I know.) They emailed me back and, although stern, they were kind in saying it was Prince's rights to those performances or rehearsals (both of which I was playing), and that I should remove them. They later said they'd contact Live365 if needed. Well, as much as I love Prince, he wasn't worth me losing my radio show. At the time, Live365.com was the only real source I knew of to stream audio, either live, or pre-recorded. So it wasn't worth it to me to sacrifice my show for airing some bootlegs. Not needing the second station anymore, I think I eventually closed that account (although I forget what I did, exactly). I kept my usual radio show going until the end of the 2nd season. I moved, and Live365 started charging, and money was tight for me at the time, so it was just easier (although I hated to do it) to let the show go.

I don't regret any of it, but I also understood the cease and desist talk. It went for a while before I ever got an email. I'm sure whoever was trolling alt.music.prince picked up on it there (although at the time you could easily find my website and my radio show by simply googling the name of the radio show itself.) I don't regret it also because I got to interview Dr. Fink, and Monte Moir (The Time). I almost had Brownmark in the bag, but we never clicked on a date and time. I had CeCe Michaela lined up too, but that fizzled for some reason. It was probably more my fault than hers.

So that's it. Nothing too exciting, and it wasn't nasty, or put some bad taste in my mouth about Prince, despite folks thinking that. I never hated Prince, and I don't hate him now. I just hate how he's done business, treated his fans, ripped us off, and how his music quality has suffered in the past 10 years compared to the whole rest of his career at WB. So drop the haterade....cuz I never did drink it.

I still have all my shows archived on disk, including the Fink and Moir interviews. I also have a few tapes of recorded phone calls w/ Fink (yes he knew and agreed to them) that I've never put out. We recorded them just to see if anything came from our numerous phone conversations that I could use in a 2nd special on the show. I never did use anything, but I have 2 or 3, maybe 4, tapes of phone calls between us.

Your shows sounded nice and I am sorry that one had to end in such a way smile thank you for sharing it I know you really didn't have to. I have never thought you hated Prince, but I have always gotten the feeling that you had unfinished business with him.

Thanks, I think they were good shows. They definitely grew and got better over time. I created all my own station IDs (which I didn't HAVE to, but I promoted Live365 on the show; Live365 had generic station IDs you could use, so I incorporated them into my show as well as the ones I create for myself). I had a great intro which had a line of Prince in it saying "Did I say we'd do the show once today? Psyche! Here we go..." from some Nude Tour rehearsal I believe. It got a lot of positive attention, and I had listeners from Europe, and the US and beyond. I had a fun time doing it. It was a great creative outlet for me.

I don't have unfinished business with Prince. I'm not mad at them for making me take down the boots that I was playing. I understood it, but I did try to convince them to let me play them. Fans loved it. But alas....that part wasn't meant to be.

I've thought of putting up all my shows as podcasts just to archive them on the web somewhere.

Thank you for sharing that. I think I heard of that radio station back in the day. I listened to something on live365 but I don't remember if it was that or not but that name rings a bell. Sorry you had to go through that.

Thanks, it really wasn't anything to "go through". It wasn't upsetting or anything. I was ticky because I couldn't play them, but I was somehow amused that they actually dug around to contact me directly (I had email links on the site at the time). I stopped playing them as easily as I started. My show was the focus, and Uptown Radio was just a side thing I threw up w/ no real thought. MY actual radio show, which I did separately, was the real focus, and fun part of it all for me. That show, nor its contents, ever changed. I did huge Prince segments at times on the regular show. I played the One Nite Alone EP that was released, alone with ...something else, I forget. I think my site is on the webarchive sites out there. It's fun to go back and see them.

Go look for www.theernestexperience.net on the web archive site(s). It's all up there.

Hey girl how are you! Prince hasn't sued me yet, but he will ... if I'll stick to my plans. Ha! But at the moment Prince will soon get payed some royalties because today I've used four of his tracks and I will register this correctly in the lists.

Thanks Ernest. I understand more now. It's hard not to be a bit bitter when you love and promote someone's music and then have to stop. At least it didn't go further though and boots as you say, are not really our own intellectual property. I admire that you're still a fan though. I would have dropped him like hot cake razz

I heard Prince on the radio today "toevallig" while changing cd/ipod. 1999. smile
I don't think Prince ever went seriously far enough to sue anyone it was just a statement of, "what's mine is mine" don't eat my porridge razz

Maybe you can specialise in Prince-legal issues.
Here, as long as you fill in the coprright organisation Buma Stemra for television you can use whatever you want. The broadcasters have some agreement.
Buma Stemra, I heard , now wants to take their claiming activities to the internet. So at the moment that's the big issue.
For theatrical releases it's another story - and you pay a shitload of copyright money
