Well in reality, I was in the wrong, and I knew it. I wasn't make a red cent on my radio show. It was ALL done by me, paid for by me, and I had no advertisers (although I guess I could have opened that up for myself). There was no reason to drop him as someone I've loved since 1979. Twenty-three years, and I was MUCH more satisfied than not during those years to that point.

I'm not bitter from it, and it certainly didn't change my view of Prince. In fact, I took some pleasure in the fact that I was one of those he came after, even in a small way. If he had made me remove ALL my radio shows (which were legal otherwise), and my site (which had nothing about him on them aside from his name and track in a playlist....I published my playlists each month as a guide for folks), THEN I would have went postal on him. I didn't mind. They couldn't take the boots away from me. I still own them, and I still listen to him.

My angst w/ Prince lies in the things we've talked about ad nauseum on here, and elsewhere. But it's kind of the status quo at this point, huh?

No and yes.

No, I haven't "personally" been threatened or sued but when Prince threatened, sued and forced the disappearance of this site, several others that I was an active member of, he may as well had because he was bullying a lot of good people that I liked, some I even called friends and I didn't appreciate it. These were the people that looked out for his fans and developed us into a community in ways he couldn't dream of.

These were the people that kept his fanbase in touch, informed and engaged with being his fan. They were the ones that used their personal time and resources to organize meet and greets before concerts, welcome committees for out of towners who went to a new city for a concert but didn't have to be alone. These were the people that fact checked stories in the media about Prince and would bombard a publisher with phone calls, letters and emails if they got a story wrong.

Let me just stop here because I feel my cheeks warming up. mad But I think you get my point.

Wow ernest never knew that happened. Sorry to hear things went sour inall that midst. I saw you had a interview with a couple of Prince's camp( and they knew). I was wondering as well did you get a interview with Wendy and Lisa as well? Or did things fall through with that?

I know we havent gotten along in the past (sorry to be off topic a bit), I am willing to call a truce between us. I can now understand why you state such things in ur posts. Whatever the feeling.I am willing to understand where you are coming from more( since this explaination of things its more clear).

I am shocked about what you said,and knew of only one (2 maybe) that has a sour relationship with P on here.

Luck to you in the future, I hope you have another radio show(I heard of your radio show just never got a chance to listen boxed)

I had used an email I had for Wendy, and emailed her about an interview. I never heard from her. I kind of knew that they'd be hard to get a hold of, much less staple an interview with, so I never really tried. I jokingly had a contest going with Rogue (he's on the org, and had a radio show on college radio at the time call The Dawn),..or might have been Joe Kelley, that I would get more Revolution interviews than them. I think W&L were the golden ticket in that bet. The others were easier to contact. Fink and Monte both had albums coming out at the time, so I wanted the interview for their promotion as well. I got autographed CDs from both of them. In fact, Fink misspelled my name on the first one, and he sent me a 2nd CD jacket w/ a new autographed, correctly spelling "Ernest". hahaha

I don't have a sour relationship w/ Prince. I stated that. I have no ill-will because of what happened. He only wanted the bootleg playing to stop. He didn't care about my radio show itself, which I kept going until I couldn't anymore. I only stopped playing the bootlegs. There was SO much new music out in 2001-2003 (MJ's new album, Jamiroquai, Prince, Sheila E., MeShell and more) that I had more than enough to play. I also did "theme" shows, like...all movie songs, the soundtrack of my life, etc.

I have. In the last 6 months or so I got a cease & desist order from P's lawyers because of my site. I've posted lots of leaked "vault" Prince stuff, and eventually I guess his lawyers caught wind of it. They gave me deadlines to remove stuff by, and I never did remove all of it, but as of yet nothing has happened. If they press again I will remove it all, but I don't make money on my site and don't wish to make money from Prince's material -- just trying to let more people know more about his unreleased catalog.

I can't give too many specifics but that should be a good enough outline.

Nothing too exciting. I did what I would call a parody of "La Bamba" but was lyrically "sister." It had all of 9 views then Youtube took it off and I had a note from Web Sheriff that was a "cease & desist" order. And then some emails from youtube saying that they were turning over my contact info to a third party in reference to a copyright violation.

i quite innocently had taken possession of a compilation disc of 21 nights/o2 material, u know, with a few thousand photo's taken by audience members, ditto phone clips, ditto audio recordings from o2/indigo, which although i assured them, i had not been made aware of the content detail or copyright ownership of, and was for personal enjoyment and not financial gain, they requested i let them have it !! (although they phrased it a little differently !!)

Why would a law suit and me come into the same sentence?

I have not been sued by Prince...I had recently felt that Prince owed me a phone call at any point in the last ten years...and He hasn't called...and I was mad...but it didn't take me any longer than a week to realize, that I Love Prince for myself...Just because I love him doesn't mean he owes me anything. I love Prince because I do. Because it just happens to be I suppose.

I just thought it would be courteous to call me for my own personal reasons.

When we get mad, or jealous, or envious, or feel left out we can look for reasons to blame someone else for an emotional relationship that we enter into willingly.

Prince does not send us contracts that say...Love me...so anyone that searches for compensation from emotional or spiritual neglect is barking up the wrong tree. cool

Later on, into year two, I took one of the Live365 stations I had, and renamed it Uptown Radio. People had broadband, and I kept the HI version of my shows on the one channel. Uptown Radio played all Prince stuff. Sometime it's play a whole album (like The Rainbow Children at the time), but I also played bootlegs. That was also about the time when the Nagoya and Sendai boots from the Lovesexy shows were coming out (as well as the "Days of Wild" CD single given out at the Celebration, recorded in Montreal.) I also played the NPGMC Ahdio shows, and the monthly tracks too. I wasn't a member of NPGMC, but a friend offered her login and I grabbed every single track.

Eventually, Prince's folks caught wind of Uptown Radio, and eventually emailed me. I was doing a LOT of rotation with the Japan boots, and some SOTT show rehearsals (the NPGMC stuff didn't seem to be an issue since it was officially released and out there for public consumption legally). The email told me I couldn't play them. I told them I could because I had them in my possession, and I "owned" them. (I know.....I know.) They emailed me back and, although stern, they were kind in saying it was Prince's rights to those performances or rehearsals (both of which I was playing), and that I should remove them. They later said they'd contact Live365 if needed. Well, as much as I love Prince, he wasn't worth me losing my radio show. At the time, Live365.com was the only real source I knew of to stream audio, either live, or pre-recorded. So it wasn't worth it to me to sacrifice my show for airing some bootlegs. Not needing the second station anymore, I think I eventually closed that account (although I forget what I did, exactly). I kept my usual radio show going until the end of the 2nd season. I moved, and Live365 started charging, and money was tight for me at the time, so it was just easier (although I hated to do it) to let the show go.

I don't regret any of it, but I also understood the cease and desist talk. It went for a while before I ever got an email. I'm sure whoever was trolling alt.music.prince picked up on it there (although at the time you could easily find my website and my radio show by simply googling the name of the radio show itself.) I don't regret it also because I got to interview Dr. Fink, and Monte Moir (The Time). I almost had Brownmark in the bag, but we never clicked on a date and time. I had CeCe Michaela lined up too, but that fizzled for some reason. It was probably more my fault than hers.

So that's it. Nothing too exciting, and it wasn't nasty, or put some bad taste in my mouth about Prince, despite folks thinking that. I never hated Prince, and I don't hate him now. I just hate how he's done business, treated his fans, ripped us off, and how his music quality has suffered in the past 10 years compared to the whole rest of his career at WB. So drop the haterade....cuz I never did drink it.

I still have all my shows archived on disk, including the Fink and Moir interviews. I also have a few tapes of recorded phone calls w/ Fink (yes he knew and agreed to them) that I've never put out. We recorded them just to see if anything came from our numerous phone conversations that I could use in a 2nd special on the show. I never did use anything, but I have 2 or 3, maybe 4, tapes of phone calls between us.

I realize this but what happened was between me and u. THAT was my point sorry to say a word and if it was out of line I apologize again but the poster had/has no idea of the events leading to that particular situation. They didn't refer to anything in the past. They observed this thread, and made a statement on it. The past doesn't matter anyway, whatever you thought they might be referring to (cuz I don't know). They didn't exactly name check you either, or anyone for that matter.

So, if I had no idea of this situation between you and Ernest (and, it seems, Ernest doesn't either!), how could I possibly be commenting on it or even alluding to it? Its a bit odd (not to mention rude) to tell me to butt out of something I was never involved in, had no intention of being involved in and, in fact, had no knowledge that there was anything to be involved in, save for what you and others said in this thread!

Slow down, Ms Tetchy and you might just start hitting the marks, instead of always missing the point!

I have not been sued by Prince...I had recently felt that Prince owed me a phone call at any point in the last ten years...and He hasn't called...and I was mad...but it didn't take me any longer than a week to realize, that I Love Prince for myself...Just because I love him doesn't mean he owes me anything. I love Prince because I do. Because it just happens to be I suppose.

I just thought it would be courteous to call me for my own personal reasons.

Maybe you can specialise in Prince-legal issues.
Here, as long as you fill in the coprright organisation Buma Stemra for television you can use whatever you want. The broadcasters have some agreement.
Buma Stemra, I heard , now wants to take their claiming activities to the internet. So at the moment that's the big issue.
For theatrical releases it's another story - and you pay a shitload of copyright money


Of course I recognised the tracks! Good choice, would keep me watching.
Would make for an interesting case study yes, and they can dissect it to pieces
and give me fair honest views from both sides of the coin. IP on educational material is also still a very grey area, so landmark cases will set the precedent. wink
