My guess is they are paying some kind of licensing fees when they tour and Morris is trying to not go that route, not sure. But the NPG also tour but then again, Morris Hayes was a bigger part of Prince's world the last two decades. I mean the NPG was said to be doing new music too under that name so I dont know, At one point The Revolution said that too or hinted at it. |

The estate do own the trademark for 'The Revolution' but they only filed for it when the band started touring after Prince's death.
When the band performed in 2012 under the name, Prince didn't own the trademark or attempt to stop them.
Like Morris, its the Estate looking for retrospective control over matters Prince didn't seem to have a problem with.
Interestingly, although the Estate have control of 'The Revolution', the trademarks for 'The Time' and 'The Family' expired. There was never a trademark application for 'Sheila E'. . |

Earlier in this thread,I suggested that Morris simply bill the shows as "Morris Day" and it looks like he's doing exactly that but this is actually a smart move.The estate can't come after him.That's his birth name.The audiences will still show up.They know that "Morris Day" means "The Time" and that they will still hear those songs.

No, I am not a trademark lawyer. Whether it does or doesn't make sense to you, that is what the issue is. The name "The Time" is Prince's intellectual property and he can't use it unless he pays for a license. Welcome to "the org", Mumio…they can have you, but I'll have your love in the end |

Hell look at the flyer you just posted. Lead singer Mark Adam Wood owns the Lakeside name but he hired other members he can pay cheaper while the other members of the group and had to tour as the Original Lakeside with Otis Stokes and the late William Shelby(Dynasty) singing lead vocals.
I believe War and Lonnie Jordon had their own going battle too.

The funny thing is that THE REVOLUTION did most of their touring after his death which was after the estate had the trademark so there has to be some sort of $$$ deal here with go out use the name but you pay us X amount of $$ for the use of the name or from your ticket sales. I mean there was tons of merch at shows too for the Revolution and a few signed photos the iconic WDC shot of the band signed by the Revolution with Prince on it you know thats got to be estate money. BUT I know we all hate or find ways to HATE the estate, but the reality is without some sort of organiztion, or incoming money to produce any future releases to keep the lights on at Paisley etc... My question to all who have said PRINCE NEVER would have allowed shirts to be sold, posters, masks, water bottles, and even some or these releases, I always hear some fans say, PRINCE Put it in the vault for a reason. My question would be, so on April 21 2016 should all have ceased? Should there have been no memorabila, PP tours, Re issues, videos on youtube, picture books etc... none of these were even on the table when he was alive. |

There was also a mutual need for tribute shows, so I think there was a period before the Estate were really thinking about enforcing trademarks.
Wendy and Lisa are pretty business savvy, so there might be more to the story how that one went down, but they annonced reuniting pretty quickl and unless Bobby had a back up or could crank up Fairlight disks, the samples at tribute shows seemed to have cooperation and access to originals that weren't used live in a long time even by Prince.

That's my point. If the othe rmembers who don't own the trademark can be "Original Lakeside" then Morris can be "Morris Day and The Time".

You can't 'own' a word. you can only trademark it for specific uses and purposes. It's up to a judge if another use infringes or not. There can be other bands with the words "the time" in them but whether or not they can afford to fight off lawsuits is another story. |

Revolution are also talking about new music, and Wendy has mentoned the question of continuing on under the same name as one of the big issues they're wrestling with. She made it sound more like it was an ethical question though.
I can see why some money bags advisor for the Estate would eventually think there was a grace period but they should own these bands and when they perform it should be Prince money making stuff. Prince let them do that reunion while he was alive though. They also knew to ask. It's a weird situation.

I guess The Temptations & Fleetwood Mac didn't get that memo. Because each group have had over 20 different members since they started in the 1960s. Before some of the former members passed, at one time there were at least 5 different Temptations groups touring. The one with Otis Williams was the official Temptations, which are still performing now. There's a lot of classic rock & oldies groups still performing that have 1 or 2 original members or none at all, like The Platters. I think Mötley Crüe has a contract that states only the original 4 members can tour under that name today. So I guess fans of John Corabi & Samantha Maloney won't get to see that lineup.
