To be sure, I have a tremendous level of respect, and appreciation, for Prince's talent as an artist. Whatever his legal rights are, and how he choses to enforce them, within the realm of the law, he's entitled to exert.

When I stated my loyalty is with Prince.org, it's for a perfectly good reason.
He doesn't maintain a website that fits my needs.. Nor consistantly keeps ANY website.

Prince.org has provided a reliable source of info on Prince's old music, new music, movie videos, concerts, a fun community , (and not so fun at times), loyal and humorous perspectives, the freedom to think otherwise, and as much of a civil environment plausable in view of the range of income groups, educational background, experiences, cultures, etc.

The only ones who are going to gain, are the attorneys and services he's paying. This from an artist who thinks he's being taken advantage of HERE?

First, I would like to say, no the site is are not responsible. Someone who would use such language obviously has no disregard for others and would use it no matter what, whether the site existed or not. Second, yes we do moderate the comments. We have had to delete many so far. Unfortunately, I am the only one online at the moment and I don't have access to that site. This has already been discussed tonight amongst those of us who do not have access and that will change as soon as the administrator can facilitate that change. The ones that have access currently have been notified and the first one that comes online will be making those changes. We do our best to moderate, whether it be the org, the quake, princefams, or PFU. It is a difficult job, one that we all do voluntarily and spend many hours a day doing. We try our best to remove such comments from all of the sites as soon as possible.

I will say that you mention a number of times here that you (meaning the site...I don't really know your role in all this except that I think you have a legal background and advised HQ people?) can't be held responsible for how people react etc. But that kind of indifference to the interests of the fanbase doesn't fill me with confidence that you guys are a bunch of Patrick Henrys looking out for our well being.

In my view, that PFU site added to the problems more than helping. You guys probably would have had a good chance of staving off litigation or winning the point if it came to it, if you were really serious about pursuing this through legal channels. But you instead decided to go the PR route and now there are these other issues resulting from the creation of that site that are going to make things difficult.

Thanks for answering and I hope there is more to this that would allow things to be settled without this bitterness.

WS sent a DMCA to prince.org's ISP. In that DMCA notice they alleged that certain materials were violating copyright of Prince/NPG/AEG. A DMCA notice requires you to identify the materials you allege to be infringing. In the DMCA notice WS included pictures of people with their tatoos, license plates, etc.

Ben responded appropriately to the DMCA notice specifically stating that (and I quote) "there are certainly MANY images in the list provided that were taken by members of the site and don't include Prince etc (i.e. picture #10 is a picture of a fan's car, taken by the fan, but there are MANY more examples)."

As someone pointed out, we cannot post the entire letter. Even if we could, it would take up about 10 pages to post the letter because WS has a entire laundry list of the images he claims were infringing which include, as pointed out by Ben, invidual pictures of fans, their tatoos, their cars, etc.

Hope this sheds some light.

I am not criticizing you for asking questions, and certainly hope you did not take it that way. I tried to answer your questions the best I could.

I hope you can understand that there will be differentiating opinions on each side of the coin. This is a very controversial topic, one that will no doubt bring out the bad side of some people. Unfortunately, when multiple requests for talks were ignored and the demand letters kept coming, even including demand for compensation, the site owners felt they had no other option but to reach out to Prince, to the fans, to the public. Attorneys are expensive, I am sure you know that, and to fund a defense against multiple jurisdictions worldwide is even more costly.

Trust me, the site owners have TRIED many times to resolve this before going public, but our requests were repeatedly ignored. What other option was there when the door is not opened when you knock? Do you sit back and wait for the various summons to arrive at your doorstep? Take a step back into their shoes for a moment....I don't think you want to be standing in them right now.

OK, 9s you have a point in that the proper avenue is legal but thank GOD this has become a PR battle because the owners of the sites weren't even being responded to and you of all people know it is a completely unreasonable request to ask that an orger showing off their symbol tattoo be removed from the site (the picture that is) or that Ben owes them any money because someone posted it!.

How much would the cost be for the site owners? They need us on their side and if they had to do it with a PR battle, then sobeit. Otherwise they would have been enduring this all alone without the resources to fight Prince and his evil clowns and they would have had 2 choices 1-go bankrupt or 2-close down our community. They weren't even fighting FAIR for godssakes. They thought they could threaten, demand money and ignore requests because they could, considering all the resources he/they have at their disposal. This amounts to a goddamn SHAKEDOWN and racketeering.
