Hi everyone. I've been a member here for years, but only as a lurker. I've been a devout fan of Prince's since 1982 and I've also been defending him for years, but no more. Everyone has their limits and this is mine. 25 years and I'm out! I can't think of a single logical reason why he would do this.

We are the ones who have enabled him to live the life that he leads. Without his fans where would he be? In a way, it's our fault that we're being sued, because without our money he couldn't afford to do this. I propose a ban on all Prince related material; audio and otherwise. Let's not continue to fund our own demise.

The main criteria is for web sheriff to prove who owns the intellectual property rights on each and every picture or image they are stating breaches their clients rights

There is a burden of proof to be satisfied legally

Pictures taken or images made by fans belong intellectually to the taker of the picture or the maker of the image

I would also demand proof that web sheriff do, in fact, act for who they say they do

Without signed letters of authority to act on a clients behalf they effectively have no power

In the past I have acted for people and usually obtain a power of attorney limited to the specific task in hand

If this matter ends up in court, you can always subpoena the artist concerned to give, under oath, the reasons they feel they have been libelled, defamed, or their reputation has suffered in any way

I would be more than interested to hear how a license plate or a tattoo on a fan damages the reputation of an artist

All these points at the moment are moot though

The claim of copyright on the email is dubious to say the least, and the attempts to claim intellectual ownership of other peoples property built on foundations of sand

Certainly under UK law, from the opinions I have had, the demands to remove images etc that belong to others would not get anywhere

Going for website uplinks is an old tactic

What does surprise me is why Prince doesnt seem to have any trademarks registered for music, live performances, clothing, cd's, dvd's etc

Not within the european union anyway

I checked the patents office website and cant find anything

The trademark for t shirts actually belongs to a US sports company

That technically means that any t shirts with the word "prince" on it would infringe the trademark of that company thereby breaching the Trademarks Act 1994 if produced without that companies permission

Anyway, it appears that all claims on his behalf or those of the other parties mentioned are based on copyright

Not officially, no. I read somewhere earlier that WS was sending emails to PFU stating that they wanted some post supposedly from Prince put on the PFU site. I tried looking through the 1200+ posts for it but my eyes got tired somewhere in the 600's but I'm sure if happened someone over here would have posted it.
