I was driving along a freeway around town here a few months ago, and a young girl rear-ended me. I got out of the car, and she told me she had coverage with State Farm Insurance. I got her name, address and phone number, but didn't give her mine, since I felt it was not necessary, since she was at fault.

I filed a claim with State Farm, and it took them a long time to investigate whether this person has insurance or not. I got a letter in the mail today from State Farm, and get this: apparently, since the girl who hit me was young (16 or 17 years of age), she supposedly had coverage under her father's name. It turns out that the father did not have insurance to cover the accident, so basically, I'm screwed as far as getting this claim covered. I could get it fixed under my insurance policy, but I fear that by doing so, my insurance rates will go up, which I don't want to happen, since I'm paying them a good bundle of money right now anyway.

Needless to say, I'm pissed about this, I'm all fired up and can't sleep. It's going on 3 am here, and I'm wide awake. I can't understand why a father would NOT have insurance for his daughter to cover any accidents that may occur. Any idiot knows that people between the ages of 16-25 have the highest accident rate of all drivers. What the hell was he thinking, that his daughter was exempt from causing an accident and that it would never occur??? WTF??? If I were a teenager and had coverage under my parent's insurance, you can be damn sure that they would have coverage in case if I were to get into an accident with someone, it would at least be covered.

I've left angry messages with both the other person's insurance agent as well as my own. I need to know if this person has insurance at all, or if what the girl told me was a lie. I also would like to know how the hell can a person drive without sufficient insurance?? Isn't that illegal?? If not, it should be, since I was not the one who caused the accident, this girl hit me, not vice versa.

I'm considering filing a police report, as well as a report with the Ohio Motorist Association to let them know what happened. I'm going to do it anonymously, since I don't want this asshole to find out my name and address, and wind up suing ME as a way of getting even. I don't feel that this should be just dropped and let go, because what if this happens again, and this girl rear-ends another person, and God forbid, kills them? She and her so-called father will have a hefty lawsuit on their hands from the victim's family, and I don't wish that to happen on ANYONE. I fear that she will she just get away with it scot free once again with no repurcussions, and I DON'T want that to happen! Believe me, I have even considered getting the car fixed and suing this asswhole father in small claims court, but I don't want to do that, since I am right now inbetween jobs, and I can't afford to get the car fixed using my own money.

Besides filing a police report, and a report with the Ohio Motorist Association, is their anyone else who I should make aware of this incident? Are there any lawyers on this board who can give me some sound advice? I feel that I will not sleep well until this matter has been reported and the guilty parties are made to pay for their own stupidity. Thanks for letting me vent.

You can try and try psych...but it's hard. A few years back we were in an accident with a girl. She was strung out, gave us a false name and took off before the cops showed up. Turned out that she was underage driving her parent's truck and because she took off like a bat out of hell, there was nothing we could do about it. Hope your luck is better girl.

Check the laws in your state. 1. the father should be responsible. 2. You may be able to sue them. If in fact they did not have insurance, the little cunt shouldn't have been on the road anyway. May take some investigative work but I'm sure you'll find out how to get them to pay up.

If they are unresponsive, hire a few guys and put a hit out on that fucker!

Thanks for your advice, I appreciate it. I should have known something fishy was up when the insurance agent told me that they called and called and left messages for this asshole and he never responded.

It's 5:30 am, and I STILL can't sleep. I lay down, but sleep just will not come. Wait until that insurance agent calls me, I'm gonna really lay into her.

My main advice is to make sure you have as much as you can in writing.

Make sure you try to get all the information you can on them, and to verify if in fact they were lying-because that gives you an option there.

Be careful about suing, sometimes it can be more expensive to go to court than it would be to just pay the cost, but I'd be feeling the same way.

The main thing is try to keep your cool and not let it get to you too much, cause if you do end up going to court-it's all in how you act.

Ever seen one of those judge shows on TV? Doesn't go over too well when somebody's all pissed off.

Hang in there and hope it works itself out. Don't let 'em give ya the run around!

Where is Judge Judy when you need her? She would get up into this guy's face about not having proper insurance coverage.

Sounds a bit sus to me. She probably just doesn't want to tell Daddy. I would push a bit first, if she was on her dads insurance then she was on her dads insurance. You can't drive on insurance but not claim if you have an accident thats bulshit.

DEfinately report it to the police to have an official record of the accident. the one thing I learn't in the US was to make it official and get paperwork, document everything.

The reason insurance premiums are so high is exactly for this reason, little shits who can't be arsed and basically get away with it, the law is all the wrong way round. The people that pay end up paying twice, the people that don't pay get away with it.

Check out your insurance policy too, it may be that you are covered for legal expenses, it might be worth loosing your no-claims bonus to drag her fathers ass through those wonderfull corts of yours.

I worked in the US for a couple of years and a week before I left some little fucker T-boned me and sped off, two other drivers who saw it, chased him down for his number, while I pulled over and called the cops. The two other drivers came back to me and offered to be witnesses, and provided the plate info, but I still ended up having to claim myself. Cops were useless, but it restored my faith in human nature a bit.

Good luck, but don't loose sleep over a few bucks, get the car sorted and push for w while but then give up, it isn't worth it.

True, the idiots who cause accidents and can't take responsibility and pay for them get away with murder, and the innocent people who have insurance wind up paying for it. That is sooo not right.

That's great that two people helped you out when you had that accident. It really does restore a person's faith in human nature, since most people don't seem to want to get involved these days in things that don't directly involve them.

Thanks. I'll feel a hell of a lot better when I report this to the police. I'm hoping something can be done (like a penalty or maybe a night spent in jail, teach these fools a lesson).

bummer. i don't know about insurance laws in ohio so i can't offer any useful advice. but if it were me i'd definitely report the incident to the police, making SURE the lack of coverage is known to them and any other agency responsible for monitoring that. absolutely that litle brat and her irresponsible father need to wake up and smell the asphalt as regards poor driving habits and insurance coverage.
