Christina Aguilera was arrested early this morning along with her boyfriend in West Hollywood, TMZ has learned.

Christina was popped for public intoxication and her boyfriend was arrested for driving under the influence.

Aguilera was arrested at 2:45 AM and booked at the West Hollywood Sheriff's substation on a misdemeanor charge.

On the booking report, Aguilera was listed at 5'2" and 100 pounds.

Aguilera's 25-year-old boyfriend Matthew Rutler was also arrested at the same time for a misdemeanor offense.

According to the L.A. County Sheriff's Department, Rutler's bail was set at $30,000. Law enforcement sources tell us Aguilera appeared to be "extremely intoxicated" and was "unable to take care of herself."

However, the source adds, "If the driver had NOT been arrested for DUI, [Christina] would have never been in trouble."

Sources close to Xtina tell us they have been trying to get the singer into a rehab program for weeks.

You're not allowed to be drunk in a car? I don't get why she was arrested.

I swear to God she just copies EVERYTHING Britney does. Floptina just isn't as epic.

Success or Failure-wise.

I know we all make mistakes, but what's wrong with these people? Millions in the bank, fandom and critical success, and they can't keep it on the straight and narrow?

...is it any wonder us nine-to-five, everyday people get fed up with these celebs and their BS..?!!

That's just it, the country has always pimped adulation, money, and success as the end all to be all. None of those three have anything really to do with getting through this thing called, 'LIFE'.

Under California law, you can be arrested if it's determined you're too drunk to care for your own safety. It doesn't help when the designated driver is plastered too.

You have got to be pretty wasted for that to happen, don't you?

I don't think I'm better at all, but I know that if I'm driving around at 2:45 am with a drunk person driving, I'd better sober up quick and not act a fool in front of cops.

Drunk driving laws differ by state. I think Sweden has some of the most stringent DUI/ public intoxications laws in the world.

Like I said in my post "I know we all makes mistakes"...but I manage to go out on the weekend very regularly, have a good drink enjoy myself and never end up in trouble with the cops. So why can't Lohan, Britney and the rest of them do the same?

Maybe some of them just get unlucky and its a coincidence that the one time they have their pants down they get stung by the police...but I cant believe thats the case all the time with them.

Cant they stay at home and get drunk, shave their heads, drive into trees, etc? They all live in big enough houses with enough cash to waste...why take it out on the street where some poor sod might be run down by a drunken twat behind the wheel (Aguilera's beloved other half in this case it seems)

nod

Normally, drunk passengers will be charged with being drunk in public if they cannot care for their own safety. No, Ms. Aguilera wasn't driving but she was drunk in public, it's against the law and for good reasons.

Laws ARE different in states. I think you can be drunk in NC without getting arrested for it, you can just call someone to pick you up if you're plastered. But I guess you can't in California. lol

I'm pretty sure that it's at the discretion of the officers....

Like I said, you've got to be either mouthy or stumbling and slurring badly, or both (lol) to be arrested.
