Is there any legal people on here with expertise in "Wills". For example a few people were stating on some previous thread that and doesn't do any good to have a "Will" using the example that James Brown had a Will and his relatives have or had been fighting over it and contestant it for years! But isn't that more that he did not leave it with attorney or some trustee with his legit signature or something to effect. Because I have heard of Wills that were handle without relatives ringing it through the court for years. ianal, so feel free to ignore this> I have a tiny bit of experience with being a... gosh, too lazy to go and look up the correct term for it, beneficiary?... but a recipient, or mention in a will. I'm not sure it matters who the legal document is left with. The potential for argument is there. As soon as you have more than one person mentioned as a recipient, it opens the door to argument. That's somewhat at the discretion of the people mentioned, how aggressive are they? How entitled? Language, language, language. How well was the d----- thing written? Sometimes lawyers are intentionally sloppy, in order to leave wiggle room for interpretation. If recipients choose to make a legal brouhaha over the language, they hire lawyers and voila!!! It's a knockdown, dragout fight potentially, depending on people's funds, lawyer's willingness to donate time, and the size of a potential payoff. A lawyer once told me a joke. "What do lawyers say when you ask them, "What's two plus two?"" The response is always, "What do you want it to be?" I am a legal person, and the only wills that are contested are those worth millions, right?
Wills that leave a small checking account, and a house are usually not contested by heirs.
But to answer your question, anyone can contest anything in a court of law.
Whether they win or not is another issue.

Documents are filed by electronic filing through the Clerk of Courts website.
The Clerk of Court employees are not permitted to determine whether filings have merit.

No, that is not a formal ruling from the Judge.
It is a "proposed" Entry by the attorneys.

Funerals are a scam! My husband and I have already agreed that we will not have funerals. We would much prefer an informal memorial with close friends and close family within 3-4 weeks of passing. Paying for a traditional funeral is a joke and I hope people stop doing this shit. You can have a lovely memorial for around $2,000. |
