unless he is his son. any child of his should have their share... it is not gold digging. I say anyone that wants to make should be allowed to pay a fee and get compared. The one-year deadline seems arbitrary to me and any notion that they were adopted makes them ineligible is ridiculous.

as well they should. but there are several cases of people being denied even a DNA test due thinks like being adopted or not having a good enough story... and the potential of missing a timeline.
The person I talked to is being denied. But then I was skeptical of his story... "Keep on shilling for Big Pharm!" |

Actually, potential heirs were given a two year deadline.
Patrick previously filed a claim and failed to give any information that would support his claim.

Not necessararily. A Trust for a child could have been set up prior to Ps death which would prohibit a claim against the Estate.

It is enforceable pursuant to Minnesota law.

The person I talked to is being denied. But then I was skeptical of his story... I remember 2 not several who were adopted, therefore were denied a court appointed test. A few simple skipped the DNA testing. Seems I read somewhere a while back there was a way to take the test out of pocket just to know. Seems no one has done that. Time keeps on slipping into the future...

denial on the bases of having been adopted denies them of due process. And no there is NO WAY to have test results compared without court approval. "Keep on shilling for Big Pharm!" |

They were denied pursuant to Minnesota case law.
The adoptees did not appeal the ruling.

I see where Estabon's lawyers filed an objection to the order but wading thru trying to see the answer to this particular objection is too time consuming for me right now. I see there was some kind of petition drawn up. Wonder if folks donated to co era his attorney fees? Time keeps on slipping into the future...

1) and what is the federal law?
2) as far as we know. the one I talked to seemed to think they were going to appeal.
the case is one of due process... a minor can not be held to a contract... so the adoption can not be used against them as a legal revocation of any rights or claims. (unless they did so after reaching 18)
But I am not sure if anyone has ever used that argument. "Keep on shilling for Big Pharm!" |

Tyka did give 2 names to the court that has never been released to the public. Like ISLISJAG said, they could have a trust that prevents them from filing an heir claim.
If there is a child out there, I've never figured out why they haven't came forward because they could own the ENTIRE thing.

Federal law does not control how a case is decided in a State Court case.
The adoptees never appealed the decision to the Appellate Court. So, apparently they were not concerned about the decision as much as you appear to be.

Yep & that thread is from 2016, so let's lock this one up.
The Estate thread deals with his death.
If we can't have a death thread or a drug thread, or a book that even mentions his death, thread. Then why do we still have this one?
There would be no Estate if he wasn't DEAD.
You complained about every single one of those threads. Your hypocrisy is hilarious.

Exactly. I did the same thing you've done on many threads. I call it like I see it, you are a hypocrite. You complain on every thread that you don't agree with, and call for it to be locked, or to be shut down, or it's the same thing over and over again. Well open your eyes, this thread is the samething over and over again and guess what...it deals with his death. Hypocrite. |
