i'm just saying what i' been saying all along, fucking doctors are just human. I still remember about 12 years ago arguing with a doctor about lance armstrong, telling him how obvious it was he was doping, the doctor was insisten that no, lance was clean. just as human as you and me.

I think Lance paid his doctors off. Remember Prince was under a doctor's care and his records were seized. Dr. S is still working and is not under any sort of investigation however, this news below makes me wonder if he or other doctors may be sued for malpractice.

CHASKA, Minn. (CN) — Prince’s siblings told a Minnesota court they cannot decide whether to file a wrongful-death suit for the superstar’s death because the county sheriff’s, medical examiner’s and attorney’s offices have denied them access to investigative data.

Prince Rogers Nelson died on April 21, 2016, apparently of an accidental overdose of fentanyl. He was 57.

In a Wednesday memorandum to Carver County Court, the trustees for Prince’s siblings say they have “requested all investigative data Carver County has regarding Mr. Nelson’s death but the county denied their request.”

The medical examiner’s office said the requested data is private or nonpublic; and the county called information confidential and said release of it “may impede the ongoing investigation and therefore disclosure is not in the public interest.”

But the family says they won’t disclose the data to anyone but their attorneys, unless under court order, and that the statute of limitations on a wrongful death suit is running. And if the family does sue, they could do so under seal or under a protective order.

“With this type of protective order in place, no information will escape, and the investigation will not be harmed,” according to the 5-page memorandum of law in support of the trustees’ motion to compel production of data.

Prince’s estate is represented by Matthew Barber with Schwebel, Goetz & Sieben in Minneapolis.

So the family does not know what happened? They don't have access to the full autopsy report? Am I reading this correctly? That would explain why none of them have come forward with info. It's because they don't know the whole story themselves.

Yes, I believe many of us thought they were withholding information and now it appears that even they cannot find out what is going on.

I cannot imgaine how frustrating that must be for them and unfortunatly it looks like this malpractice suit or at least the investigation into filing suit might be the only means for them to find out what is going on.

Prince was taking opiods and I am pretty sure the hospital and well as Dr. S knew it. I am sure with everything going on medical test are able to pick up these pain killers.

PeteSilas said:

lance had all kinds of people on his ass for years and he arrogantly lied to everyone, i just watched a docu on it. there was some explanation about how he could get away with using epo because it's out of the system pretty quickly, in fact, i was always sure one of our eras great boxers Manny pacquiao was on epo. It all depends on how strict testing is and how serious they are about stopping drugging. My personal opinion on the subject is, they should either allow it or not allow it so that there is a level playing field, the guy who knows how to fool the tests shouldn't get an edge because of it.

at any rate, with lance it was obvious, guy had cancer, almost died and comes back to win the most grueling contest in the world, something is wrong with that picture. It's almost like michael jackson lying about his plastic surgery, it's like a little kid saying he didn't eat chococalite cake with crumbs and shit all around his mouth.

I still think he did not know there was fentanyl in those pills.

That's what I was going to point out PennyPurple.

People can't doctor shop like they used to because you have to show Id and sign when you get any narcotics. A doctor will be flagged for writing too many narcotic Rxs regardless of whose name is on the Rx.

I have to do the same even when I buy OTC allergy meds because those products are used to make meth. If I went from store to store to buy allergy meds, I would get flagged. My daughter and I both have allergies and a few years back, I bought my daughter allergy meds, then I started having allergy symptoms and tried to buy some for me. The pharmacy clerk (since you have to ask pharmacy clerk for OTC allergy meds) told me that I could not buy the OTC allergy meds because I had just bought some a few days before. I had to send my husband to buy them for me. So the feds have gotten wise to those types of tricks.

The next thing that's going to happen, is we are going to have to show ID to buy Tide Pods. biggrin

You are not allowed access to a police investigation file while it is still active.

Who are they gonna sue anyway?

I had a friend murdered in front of a bar 30 years ago (witnesses were present.)

A few years ago his family asked me to obtain a copy of the investigative file.

The request was denied because it was still deemed an active investigation even though it was unsolved for 30 years.

Well we do not know what was going on with him and doctors or his health. Maybe the family wants to try and see if they can hold someone accountable. Don't you think it is weird that they do not have access to the autospy report?

Anyway they are saying it would stay sealed with only their attorneys needing it to file a suit.

I do not know too many black folk who hang themselves. I think Prince's issues were deeper then drug addiction. I have also thought just by some of his lyrics that he was depressed and I think health issues especially somethink debilitating could have push him right over the edge.

He lived to play music and seemed to be a social person. Just think if it was all going away. Like I said before he had access to real pills and he was no street junky. He could get relief from withdrawals anytime and anywhere.

Totally agree. We all have issues but I think Prince had a lot going on (possible physical issues, emotional issues, financial issues, relationship issues, aging alone, overworked, if we believe the dementia story then imagine believing that you are losing your talent or the thing that makes you special... people say he hated being alone, etc) and depression doesnt help at all. Pain pill usage doesnt mix well with any of that. I'm starting to think that what happened can be summed up as a perfect storm with everything coming to a head and turned out to be too much for him. Say the pills get you through the day but then you are given the shots and every drop of opiate is wiped from your system. Lots of folks die within days of that scenario. I just think everything became too much [Edited 2/7/18 13:24pm]

I wonder if he had been in a happy steady relationship at the time if things would have gone differently.

I mean having someone close to him who knew what was going down and helped him.

How come all those recent girlfriends , I mean the last few are not saying anything about all this ?

Andy Hallo and the chick who was on the\plane just seem to talk about how much he helped them in their careers bla blabla ,why dont they give their oppinions about what happened to him ?

suely they would ...should know more than we do?

Had he given up on relationships in the last few years or what / why was there no close love interest at the time ?

[Edited 2/8/18 1:47am]

If we believe the reports, Judith states she was 'dating' him since 2014 but I dont know that Prince actually officially dated, lol, if you catch my drift. Basically, the women might have been dating him but he might not have been classifying the relationship as 'dating'. So who knows. But there are quite a few women who came and went between the end of his 2nd marriage and his death. I dont expect them to say anything too personal or too revealing anytime soon because they know how private he was. They might write books years from now (like all the books that came out about Princess Diana after her death).

I dont know that an intimate relationship would have led to a different result in this case. I once dated someone who was a bit of a loner, but our relationship was great until they thought they were dying... then they suddenly pulled away from the relationship. Everything ended abruptly with little explanation. Years later, a subsequent conversation found that 'pulling away' was their way of protecting me from pain (or whatever). They survived the impending death and tried to come back but I was over it at the point. I get the feeling that Prince was like that. He probably could have been head over heels in love but pull out to prevent putting his woman through grief. Pulling away forces her to move on. Heartbreak forces one to move on. Judging from the way he dealt with difficult life events (based on reports), he probably wasnt good at working through depression/death/emotional pain. In the end, he may have still chosen to go through whatever he was going through alone.

The one question that keeps eating me up is what would have made a girlfriend who witnessed him ODing, leave his side less than 36 hours later... Unless they had broken up or he sent her away or something. I just dont get that piece of the puzzle.

The Carver County Sheriff's office is now in the final stages of its investigation into the death of music superstar Prince, according to a law enforcement source.

The investigative file will be turned over to the Carver County Attorney for review in the coming weeks, the source said.

So is the investigation still opened or not?

Why do you think she was doing drugs along with him? I know many of us have wondered if a women did not play a roll. Was it a combonation of joint pain/medical issues and dating 20 somethings who may have been into drugs.

I remember Dez said in his book that Vanity was like Yoko Ono when he first brought her around. That Prince started listening to her and everyone could not figure out why he was defering to her.

He seems like the kind of dude that would let some women lead him down a bad road.

i just don't, i don't believe what most people say in a situation where a figure like that dies. just look at the bios of famous people, they are always by some sideman who makes their role bigger than it actually was, like they were THE ONE who had the only true insider view and relationship with the star. Just the way it is. saw it with elvis and mj. and people just make shit up, kathy westmoreland, elvis' former girl (and singer of star trek them) still says that elvis died of bone cancer and that he told her that he was dying of bone cancer, still!

Maybe Elvis told her that and she believed it. Cancer even in the beginning stages can cause heart and organ problems. The info would not be mentioned to the public because he did not die from cancer.

A summary of ME's public data (as in "manner of death") vs. an "active investigation"... It's not a homicide, or undetermined. The county attorney( prosecutor) will determine if the data to be released does not impede the investigation. I don't think the public data form included whether or not the death was "conclusive". I would hedge on that. Minnesota statute section13.825 Subd1-4

The reason they are rushing to do this is because they are two months left before the statute of limitations expire. Effectively (3) years to the date of the Prince's death.

Even if they had thought about doing this earlier, soliciting the count attorney, as opposed to the court, was the thing to do. However, there may be a work around regardless of whether an investigation is still on going. I wasn't able to find in the Minnesota State law library archives anything that states that an officer of the court is precluded from compelling witnesses to answer a subpoena because of an active investigation .

They need a P.R. person if they truly believe there was/is a cover up.

Again, what is interesting to note is that Tyka has not requested any of this for almost (3) years.

If you have any sort of organ failure you have to stop taking pain meds and would have to move to cancer fighting drugs. I have never said Prince was not dealing with a problem with pain meds. What I think and this is just what I think from the info I have is that he had acclerated his pain meds due to pain he was either already having and/or increased pain from another illness. If he had anything wrong with his organs he would have had to stop using pain meds and move to cancer fighting or organ failure drugs if he was going to be figithing those illness at all.

What I know is that we now have news reports that the estate is trying to get the police file to move forward with a malpractice suit. Which I mentioned before was rumored about back in the fall of 2016.

I doubt that family members want to file a suit against any doctor to say " You made our brother a dope addict". I think other things were going with his health that may have been mismanaged or not attended to correctly. We shall soon see.

Why is the courts even wasting their time with a malpractice suit? If authorities did not find any wrongdoing by the doctors, there is no way a judge is going to pursue any case. I'm not a legal professional, but this does not sound possible.

We do not know everything that is going on and the have right to file sue if they want to. I would not say it is a waste of time. If the Duane Spawn and Pat Cousins can tie up courts with nonsense why would the Nelson sibs be barred?

Yes, I believe many of us thought they were withholding information and now it appears that even they cannot find out what is going on.

I cannot imgaine how frustrating that must be for them and unfortunatly it looks like this malpractice suit or at least the investigation into filing suit might be the only means for them to find out what is going on.

Maybe one of our legal eagles can explain how the family would not be allowed to know about the investigation data and the info from the ME.

You are not allowed access to a police investigation file while it is still active.

Who are they gonna sue anyway?

I had a friend murdered in front of a bar 30 years ago (witnesses were present.)

A few years ago his family asked me to obtain a copy of the investigative file.

The request was denied because it was still deemed an active investigation even though it was unsolved for 30 years.

.

I understand that, but the coroner's report? The family should have full access to that information. Oh boy, this is looking really suspicious now! eek

I know rumors have been going around about a malpratice suit since Oct 2016. We also do not know if Tyka is the one behind it. You keep forgetting about the other sibs. When it has been SNJ who have caused most of the problems.

I dont get that either, when I hear Judith or Andy speaking about him to me it seems different to when I hear somone like Sheila E speaking about him , with Shelia you can see that bond they had but Judith was last with him not so long before he passed , you would think she would be more emotional or something if she was his latest luv interest, how she left his side 36 hrs after the plane thing and seemingly no reports of contact in his last few days or week, I wonder if they had a recent falling out or something .

Yes, but their attorney is saying they do not have access.

Judith's story is a bit sketchy, imo. I don't think their relationship was romantic, as she leads people to believe. She said Prince told her "I will always be there for you." To me, that sounds like more of a "friend"ship, than a romance. Also, the media tends to exaggerate things.

My bad. I posted that comment before reading about the Statute of Limitations. That makes sense now.

It will only be 2 years in April 2018, and not 3 years although some days it seems like 3 years.

There is a 3 year statute of limitations for wrongful death cases in Minnesota..

Yeah. I can see them being together romantically (and there are reports that he was deferring to her on music related things from 2014 onward). I'm thinking that either they had a falling out / break up OR she might have been more involved in the drug thing than we realize and wanted to get some distance from it (just my opinion). Those are the only reasons that I could think of for why a person would leave their lover who just got out of hospital for OD.
