First off, I apologize as I know I've got the quote feature all screwed up but I'm tired.
I guess my point (which wasn't clearly made, sorry. again, I'm tired and really should be trying to sleep and not on here!) in bringing up how Prince doesn't accept mail or other gifts from fans was in regard to the lawsuits/legal aspect of things. He appears to understand the possible ramifications, legal and otherwise, in taking gifts from fans or opening mail (which might contain music or lyrics or ideas that a fan later might claim Prince stole from them) so he chooses instead to NOT take that chance. Yet he throws his guitar into the audience where each time he chances his guitar getting destroyed or at least damaged, or that someone might get injured in the chaos, or pissing off a vocal concert attendee who will whine and moan about the situation and give bad publicity (this last one is minor compared to the previous two examples, yes, but still can be a headache..)
It perplexes me why Prince plays it safe legally with fan mail and fan gifts and such, yet he risks both the safety of his guitar and other legal issues by continuing to toss the guitar into the audience.
Let me make it clear that I think it looks very cool when Prince throws that guitar. I love it. But it seems inconsistent when held up to his decision to be careful legally in other situations -- and I *do* think that when you have all types of people attending your shows you have to either: cave to the lowest common denominator fan (i.e. naive, casual, dumb, asshole, sue-happy, etc) and cut that part of the act OR make it EXPLICITLY CLEAR before the show starts that anything thrown into the audience during the performance is NOT meant to be kept and will be retrieved by a stagehand or security. In this day and age, it's practically mandatory to SPELL OUT EVERYTHING to a consumer so that there is never a chance for misunderstanding or potential legal trouble. You cannot expect anybody to 'just know' ANYTHING....you're asking for trouble if you take that mentality. Look at all the foods that instruct you to take the wrapper off before you eat it (duh) or like how birth control pills say they won't prevent STDs...most people do know these things, but there are still lots out there who don't, and those are the ones you have to take into consideration. This. How the fuck is any casual concert goer supposed to know "Oh, I don't actually get to keep this, despite paying a fuckton to sit in a place where I could actually catch it"? Nevermind the people who clobered him to try and "hold it for a bit".

Fuck off to anyone who thinks any of this is reasonable or excusable. That's not how the real world works, and just because Prince doesn't live there does not make it okay. Get a reality check, I think ya'll have been spending to much time in P land here.
I own every single album P has ever put out, and been to three different shows, including this one, and I would be bewildered if I was asked for that guitar back, especially after getting thrown to the floor for it. Does that make me "not a real fan"? Do I -need- to be a real fan to see him play live?

He would run out of guitars and would have to drop in back home to grab more if he did that! It's not like it's something that can be easily replaced like a drumstick or a tamborine, well more easily replaced than something expensive like a guitar. | |

Uh, what precedent was set that guitars thrown into the audience are gifts? Especially if its tossed into a special section of up close people. That motherfucker paid the money and got to hold P's guitar. I can't walk out my door and pay that fee. It's special. It's exciting. It's part of a rock and roll show. And if you aren't into rock and roll shows or you ain't funky, then no you shouldn't come to the show. | |

Well, now that we all agree about the stupidity we see in that man's assumptions, here's my big souvernir tip:
- Everybody has plectrums - Everybody has tambourines - Nobody has the very snares he played on the guitar
So, next time bring some capable scissors and cut some snares when you get close enough to that guitar in the crowd.
My rationale:
The guitar will need re-adjusting anyway after it has been in the crowd. So better with a fresh set of snares, perfectly tuned. So you removing the snares is no big harm, also w.r.t. value of a set of replacement snares.
So, yes, this is point somewhere where we were and the opinion of that man.

The most interesting thing there is two comments below the story...
I was at this show and was one table behind this guy. I actually have a picture of the guitar in the air. He caught the guitar and fell backwards as he was trying to hold onto it. Then he landed on his back hitting his left shoulder on the base of one of the tables. I did not see anyone beating on him at all, just fans holding onto the guitar. The gentleman behind him was actually trying to help him up....no fan beating took place.

This man is lying. I was one of 5 people who caught the guitar. It was not handed to anyone. There was no eye contact. There was no frenzy until he initiated it. He screamed it's mine and yanked so that 2 girls let go but I had the middle and another man the top and he pulled us all down to the ground - he hurt himself and me as well in his antics. I have bruises and cuts.No one beat him. No one touched him. Just three of us with a good hold on the guitar that was tossed to a group of us within heavy security.
So basically, the guy's an asshole. We don’t mourn artists because we knew them. We mourn them because they helped us know ourselves. | |

Well, I don't think a lawsuit was ever the point really. If Prince wasn't going to win one, he could easily settle out of court with the money he got from the recent tour. It's the bad publicity for absolutely nothing he is getting recently that's hurting him. It may be a bit extreme for an example, but Michael Jackson never lost a lawsuit...
Based on the two comments on that site and on this guy's story he seems an asshole to me. I'd really like to know whether those comments are true or not, I guess we'll never know.

Someone needs to call Paisley Park and submit themselves as a witness in case this man(who i feel is obviously just trying to get publicity in the news) tries to sue Prince... will ALWAYS think of like a "ACT OF GOD"! I was really finding it hard to believe that Prince actually threw the guitar and didn't just hand it to this chode, as is most often done at his shows. But if these reports are true, then Prince is a fucking moron for opening himself up to a liability such as this - no matter what kind of guitar receiving skills Prince thinks his increasingly idiotic fan base may possess.
And I'll never understand why grown-ass folks were fighting to put hands on the guitar after this knuckle-dragger had it in his possession. They should have saved their $750 for some classes on how to behave in public.
Another thing... Prince's guitar tech should punch our former hero in the dick every time Purps gets this wonderful idea in his giant empty noggin'.*

First of all, it's "kept." Not "kepted."
Second, Prince would be able to demonstrate to the court's satisfaction that he has, on numerous occasions, tossed or handed a guitar into the audience, and that in no case was the guitar ever abandoned nor was there any intention that the act constituted a gift.
Anyone with a lick of common sense would know that the intention was not for the guitar to be "kepted." We don’t mourn artists because we knew them. We mourn them because they helped us know ourselves. | |

I hope that man does sue! So Prince can be the one that's laughed out of court. There is VIDEO of him throwing his guitar away from his possession, all willy-nilly, into the audience, then turning around and walking away...like it didn't matter to him! There is not a JUDGE in this country that will not rule in that man's favor!
The first thing a Judge is going to say is..."Mr. Nelson, you didn't seem too concerned about the guitar NOR the audience when you arbitrarily threw the guitar into it. What would your position be, had NO ONE caught the guitar and it HIT someone or it landed on the ground smashing into pieces?"

I think the judge could only base a decision on facts and the guitar hitting the ground and smashing into pieces is hypothetical which probably wont happen judging the crowd he threw it to who would most likely catch it. If Prince states it was part of the show on what grounds would the judge say it was not. Its funny he's been doing this for a long time and I don't recall anyone being in a hissy fit over it until now. I would say Prince should not be throwing things in the audience that could hit and hurt someone but that wasnt the case here, the injuries came in the aftermath, it's more what was his intention to give it away or keep it. if I was him going forward I would leave it out the show.
