While I respect the spirit of your decision, it strikes me as a bit disingenuous on two counts: 1. I find it hard to believe that you had no idea that buying unauthorized recordings of Prince's performances was wrong until you learned of his stance; and 2. If you were truly being principled about your stance you would DESTROY all copies of unauthorized recordings, the mere possession of which IS considered a violation of copyright law.

Well true and not true, the Rave album was just not good, there was nothing there to market to the places he was trying to go, he was trying to bring his sound to a new generation that doesnt care about him and never will that simple, the same goes for Clive Davis. Lets be real here Prince has never been "a seller" in terms of big albums, the albums before Purple Rain all sold mostly after Purple Rain came out and people just went back, 1999 was a bonafide hit but also alot of business overall came after PR, and then the first few albums after PR sold because everyone was still into him. Prince as i have said before has a loyal base and he pretty much can pull off a gold album now and then, which is EXACTLY what Rave was a GOLD album, it sold what it sold. Clive Davis thought he was going to make this huge spectacle getting Prince, but that record was not what it was gonna take, "Musicology" did that more for him, but lets also be real that 70% of "Musicology" sales were give aways.

You know, when you say it's wrong to own copies of his "unreleased babies", , you shouldn't be owning them yourself either.

As for these being "unreleased", that is only in as far as never "officially". But "factually" they HAVE been released and as some of the bootleg threads can explain, Prince often played a crucial part in those releases, because he gave away tapes or was sloppy with them.

Once Prince gives away just one copy of a song, a studio jam, a concert whatever, it is RELEASED and FACTUALY FREE to be copied and distributed without his permission. At THAT point he loses control. Because he can't stop the copying, not even with technology. All he has left then is the law, but the law is just rules and people don't abide by the rules.

Your and/or Prince's problem seems to be that people don't abide the rules and therefore disrepect him and even "steal" from him, to put it dramatically. However, no "stealing" takes place of course when a song is copied without permission. From one copy there are simply made more. Hence why the law does not call that theft but copyright infringement.

But there are many ways of infringing on copyright, one worse than the other. When you make thousands of copies and sell those you are considered a criminal. When you make one copy and give it to a friend so s/he can also enjoy the music, you have done something nice for a friend that's tecnically "wrong" but something most people have done and that helps promote the music of the artist.

When an artist or copyrightowner cannot respect that, cannot understand that, or will not understand that, because he remains of the opinion that nobody may copy without permission and that those who still do remain in jeopardy of legal action, then that's his right surely, but it it's not a right that he will be able to enforce.

Because once just one copy is released, the song is free.

I'm just going to say this, for a Prince fan forum there seems to be a lot of people taking distinct pleasure in anything bad that happens to him.

One of the reasons I go on this site is to see what's coming up in the Prince world, taking pleasure in his music and interest in whatever he's doing, reading some of the "fans" in this forum makes me wonder about the integrity and reasons why they are part of a fan site when every comment I read is mocking and disdain for a musician.

They will be the same people who will cry the loudest and announce how great a fan they were when he dies, stepping over the crowd to have their voice heard first and going on ebay to buy a bottle of Prince's perfume that they ridiculed.

But I guess that's the way of the internet, people with no talent, who feel they are owed perfection unable to obtain satisfaction except from a paragraph or two of self imposed rage disguised as pseudo criticism simply because they can.

And to illicit a response from another total stranger such as myself.

I stopped reading when you said this. You are saying everybody here is mocking and disdaining. That's such a lie.

As for those who do, I am not saying it's "good", but what do you expect when Prince has a long history of doing bad business and sueing people himself, including fans and colleagues. That creates bitterness with people, so they start enjoying it when he gets sued himself. That's sad yes, but has a lot to do with Prince himself.

I'd say the same about Prince tho...I mean what is the detriment to Prince of a short clip of a baby dancing with his music on the back ground...yet he threatens to sue.

Before you can sue you need GROUNDS to sue. See the tile: Judge says 3121 perfume company can sue Prince. If they wouldnt have grounds, the judge would have tossed it. So this company appears to have grounds, based on FRAUD to be exact, the judge said.

This case proves people do anything for money? This company produced the perfume and PAID Prince a lot of money to promote it. He didn't, they claim, and then it tanked. They lose, Prince got paid already. So they sue to get their money back. What would you do?

Croke Park Anything for money? They got the confirmation he would play for 3 million dollars, paid his manager an advance, booked the park, made promotion and sold 55.000 tickets. Then Prince cancelled 10 days before the show, citing no reason. What would you do? Sit back and say: poor Prince I understand?

The let's go crazy baby mama no case? Why did the judge say it was fair use then and what universal did possibly a case of copyright abuse? Anything for money? That woman ain't gonna get no damages paid, other than hopefully for her, her legal fees, which is what she sueing Universal for, not Prince.

I don't know what promotion Prince undertook with 3121 perfume. What I do know is that IF he didn't have any money, they wouldn't sue.

The rest of your lesson is in answer to my "anything for money" which happens to be lyrics from a song from someone who was constantly sued and also someone who was a victim of extortion. Next time I'll put "anything for money" in quotes, my mistake.

Truth is. America is the most litigous society in the world. About Prince's legal or illegal acvities I don't comment much because a. I don't know him and b. I haven't seen the case complaint or facts so wouldn't know which legislative article he allegedly breached or what in the law would be applicable for his defence.

Well i gotta agree on the America part, we are sue happy. Mainly because its a business, why go to law school if all you are gonna do is sit in an office, lawyers need work, and this is how they get it. Now im not saying that Prince did or didnt properly promote this perfume that no one but his fans would even buy if even that, but for the most part, this is a company that lost money on a venture with a big star and now wants its cash back. Whether Prince did or did not do what he was obligated to do NONE OF US KNOW for sure. Its very easy to say, Prince is a poor businessman and therefore of course he broke the contract, because he has a history of not promoting things, but for all accounts this could just be a company that is losing money and thought for sure it would make money on someone like PRINCE. So without knowing word for word the terms of this contract we dont know anything, just like when Prince signed with WB in 1992 for 125million, everyone thought that money was given to him, well years later its learned that 75% of that money never got to Prince and was actually reverted back to WB to get out of the contract, so again, we dont know the whole story

Nope. Definitely not. The crazy thing is that dude is not dumb. He KNOWS right from wrong, and he knows how a good business SHOULD be run. He just chooses not to do it. More, he chooses to just straight up ignore legalities that even people who DO run businesses poorly would pay attention to. It's all in line with my complaint on repeat about how he keeps his brag on about being "free" (independent), but really isn't. It's laziness. Cha-ching.

Yes America is a very contentious and litigious society. However, once you paid somebody a lot of money and you feel he didn't perform his side of the contract, people sue, no matter what society. And Croke Park was in Ireland.

We don't know much about Prince's side in this case yet because Prince has yet to file an answer. According to this article however we can assess that this company says it paid Prince a lot of money, but thinks Prince didn't promote the perfume like he was supposed to. It remains to be seen whether that is the case, but the judge said the grounds for fraud may proceed. If true, he will probably have to pay them back (part of) his payment and some damages. If not, bad luck for them. We will have to wait and see, but if you ask me: I can see another settlement out of court coming.

I would be really interested to see what the grounds are on which they are trying to sue Prince. You can't sue him because his perfume stinks. You can't sue him because he played a concert at Macy's or something and people didn't line up in droves to buy perfume.
I won't deny it appears Prince has done quite a few ahem...questionable and outright lame business practices over the years, but I don't know on this one. It sounds like someone drank the purple kool-aid thinking a perfume was gonna make them rich. It didn't, and now they want the money they wasted.
If Prince did agree in writing to do more promotion, like magazine ads, spoken appearances, etc and didn't follow through, then sure.. they should go after him for breach of contract. But unless they said "and Prince hereby guarantees that every said purple minion with at once pull out their wallet and buy 3121 perfume, or we get to take all our money back", they probably don't have much of a case.
And Prince please don't write a song about the perfume company and call it "Trapped in a Large Bottle of Perfume Woes and No Ventilation". On second though.. please do. I need a good giggle smile

At the end of the day, we don't have the contract nor were we part of the talks, so we don't know what went on with this deal. I asked if anyone had facts, yet all we have is more speculation coupled with the requisite Prince bashing. More times than not, this place is such a joke.


But if you had to speculate you'd say going on his past record he probably fucked up, no? I mean, come on. lol
