[Edited 2/26/10 6:12am] I figured it would go there, it was a gamble on both parts, everybody cuts losses and avoids paying more legal fees. Forget the verdict, the legal fees alone will kill you. Most times its easier and cheaper to settle than a long protracted legal fight. Mr Desmond added on Friday that he was "a very chilled cat".

Prince & MCD settle concert case
Friday, 26 February 2010 14:06 A legal action by promoters MCD against the singer Prince and his agent has been settled at the Commercial Court. MCD had sued the singer and his agents William Morris Endeavor Entertainment for €1.7m over the cancellation of a concert at Croke Park in 2008. The details of the settlement have not been disclosed but afterwards Denis Desmond of MCD said he was relieved it was over and that MCD was not out of pocket. Mr Desmond said he looked forward to doing business with Prince in the future, but said if he was Prince, he would get a good manager. He said he was still disappointed for the fans over the cancellation, but said systems had not been changed for booking acts as this was a unique situation. During the case it emerged that Prince had spoken about Mr Desmond and said 'tell the cat to chill, we will work something out.' Mr Desmond added today that he was 'a very chilled cat'. | |

Court action against Prince settled
Pop superstar Prince has settled his action with promoters MCD over his decision to cancel a concert at Croke Park in June 2008. At the High Court this morning, MCD counsel Michael Collins said the case had been settled, and asked that it be put in for mention in a month’s time to allow for the completion of the settlement. Prince was sued by MCD for his refusal to play a concert at Croke Park scheduled for June 16th. MCD had claimed €1.7 million in damages plus costs. The Purple Rain star only confirmed cancellation 13 days before hand and offered no explanation. His counsel Paul Sreenan SC confirmed that a settlement had been reached. Mr Justice Peter Kelly asked if the settlement had been “confirmed” and if so, did the verb confirmed “in Prince speak mean the same as it means in English?” Mr Sreenan said it had been confirmed “in a different sense to how it had been confirmed on the previous occasion”. Mr Sreenan was referring to an email sent by Prince’s assistant Ruth Arzate confirming that the Dublin concert would be going ahead. Mr Justice Kelly said he was glad that the parties had reached a settlement and he stood the matter over until March 26th to allow the terms of settlement to be implemented. No details of the settlement were announced in court. MCD promoter Denis Desmond said he was “delighted” with the outcome, but sad for the 55,000 fans who had bought tickets for the event. He said MCD would not be out of pocket as a result of the action. Mr Desmond said he was particularly happy that the damages he sought were agreed between both parties and were not inflated as had been suggested at an earlier hearing. He said he would “gladly” have Prince to play a concert in Ireland and urged him to get a good manager. | |

Nobody knows if he took a loss as it's out of court, MCD went into court asking for 1.7m did they get it .....NO ....what did they get a sum that was less and more than likely fair to both sides which cover any costs they may have had or given to Prince so he's not lost anything he just given them back the money given to him in contract which must have had some cancellation cause. My guess is he took a loss - and I guess he has been advised to settle along with the other defendant and get out of it as cheaply as possible
The judge didnt sound too impressed given his comments to the Barristers when the settlement was announced; his comment about 'confirmed' in Prince's way says a lot ; this will have been obvious to both sides as the trial was going on ; and likely they Defendant counsel advised it was better out cheaper than paying full whack in damages I guess P will take it on the chin and the Claimant will feel vindicated to some extent; its business. At the second dinner in the singer's home he said the opportunity to discuss the concerts did not arise, as the singer left the room after dinner and his security guard returned to thank him and tell him the dinner was over. Asked by his counsel if he asked him to return to discuss matters, Mr Sarkisian said: 'You don't tell Prince to come back'. Mr Sarkisian outlined a number of emails to Prince's personal assistant Ruth Arzate during which he says the Dublin concert was clearly confirmed. As they started to have difficulty getting a final say on other European dates he was advised by Ms Arzate to send a note to Prince. He said he had to be careful how to write the note and normally took direction from Ms Arzate who would 'interpret' for them. He said he was told not to try to force an answer from the artist as it would probably make him do the opposite. However he said at no stage in the process was it mentioned that Dublin would be cancelled and he was sending regular updates on tickets sales to Prince's personal assistant. The first time he was definitively told that Prince would not be going to Dublin was at a meeting on 3 June. He said at this meeting Prince was agitated when presented with his options on canceling the concert and said 'you guys got me into this'. He was also willing to speak to Denis Desmond and said: 'tell him he'll have to chill'. During cross-examination by counsel for MCD, Mr Sarkisian said at all times they acted as agents for Prince. Asked if he was still the singer's agent he said: 'technically yes'. It was put to him that Prince's name was still on WME's website and he replied: 'well I think Elvis is still on our website'. However he said at all times WME acted on Prince's behalf and with his consent and everyone understood this both before and after tickets for the Dublin gig went on sale. The WME Executive's testimony is really telling. It shows that Prince seems to think certain rules don't apply to him and that he can do whatever he wants regardless of how it affects others. Of course, we sort of already knew this, didn't we? And what else would you expect from someone who's lived in his own world, firing anyone who dared to tell him, "No" since the age of 18. .
