lol I raised my brow, @ the intro because I detect Faze-O's Riding High, I think its a silly suit if it's real.

There are so many songs that have similarities the courts would be backed up for years if every artist acted on it.

Just posting something without proof to back it up, proves nothing.
were's the publishing and copyrights.

Here's something from earlier this year, mind you the parties invovled had up to the end of the month to reply. This article was written in Barbados on Feburary 21 of this year.

I guess they are still pursuing the copyright lawsuit and more.

Prince, Lee in $80m lawsuit
Published on: 2/21/07.

by RICKY JORDAN

A MASSIVE COPYRIGHT LAWSUIT has started in Barbados, targeting two of the entertainment industry's most prominent personalities, Prince and Spike Lee.

American artiste manager James Branden, holder of the copyright for a song written in 1994, has hired local attorney Ernest Jackman to file a US$40 million (BDS$80 million) suit against the United States-based producers, claiming the song was infringed by artiste Prince and moviemaker Lee in a movie/soundtrack titled Girl 6.

Both Jackman and Branden told the MIDWEEK NATION yesterday that Branden, who co-owns a company in Barbados, had tried to get a song called Phone Sex onto a big label through Prince's company, 40 Acres and A Mule, in 1994. In the process, he made it available to one of that company's executives but heard nothing about the song afterwards.

"This was, of course, until a movie came out two years later called Girl 6 with the title track sounding very familiar," Branden said.

He and members of his now defunct band Gomob then took both songs, Phone Sex and Girl 6, to a leading musicologist in the United States who perused them and wrote her findings, which showed basically that the songs had similarities exceeding the amount allowed by poetic licence.

"It was copyright infringement. I tried to pursue the case in the United States and got the runaround with attorneys, some of whom worked for the big companies. I was just a small man," Branden said.

However, late last year a multi-channel feature was aired on Lee's material, including the movie Girl 6 which again featured the controversial song.

"This represented another infringement. Between December 2006 and last month, the feature was shown with other Spike Lee films
on several channels and stations," Jackman said.

Branden sent the rights to the song to his Barbados-based company and hired Jackman, who has in turn sent letters to 40 Acres and a Mule and all the companies involved in the movie's subsequent reproduction between last December and January.

"There's a deadline up to the end of this month for the parties to talk with us. If they do not acknowledge, we will look at further action for compensation for breach of Branden's intellectual property rights, as well as some way to ensure future regulation for use of this material," Jackman added.

For those who might never have even heard of the song or movie, Jackman said "it's not a big hit, but that does not really matter. What Branden feels strongly about is the fact that he and his band Gomob delivered original stuff to Prince's company and they didn't even
tell him good morning.

"We don't even know how much it earned but for the two months it was airing on Fox, HBO and other channels, it showed to a massive audience," he added.

"Branden and members of his former band deserve recognition and compensation. It is sad but that's how the industry works. These fellows don't take you on until you put them in court," Jackman said, referring to Madonna's recent suit of Mary J. Blige, Dr Dre and Eve for copyright infringement via Blige's track, Not Today.

Meanwhile, Girl 6 is the title track to Prince's March 1996 soundtrack album. Credited to the New Power Generation, the lyrics of Girl 6 are sung by Prince. The album is also a soundtrack to the Spike Lee film of the same name and comprises previously released songs from Prince and related artists such as The Family, Vanity 6 and New Power Generation.

"We're asking for US$40 million as a thrown-out figure, but when we get a better picture on its earnings and potential, that figure will be reviewed," Jackman said.

Ummm, are you kidding me? This article isn't even accurate. 40 acres and a mule is Spike's company not Prince's. Where are these people fact checkers?
