New topic Printablestrawberryletter23 said: I am not sure what the point is - if it is about money, what do they have to lose by having them make money billed as the band they have always been? It isn't like the ticket sales or new material would take away from any sort of thing from the Estate's pockets on The Time material Prince wrote, right? Fucking ridiculous. How can the estate claim to be acting in Prince's best interests and then turn around and fuck Morris Day, a long time friend of Prince, over a name he's been using for decades. A name which Prince himself had no problems with.

Thus, in 1982 Prince himself had Morris Day (& The time) signing a contract where Morris or The Time “has no right to use or register [the name] THE TIME in any form” — (which presumably includes concerts and recordings)... That's what 40 years ago ? Prince is dead ? I'm absolutely no expert, but do contracts still count when someone is 'dead'? Morris apparently signed this contract that says “acknowledged that PRN Music Corporation, an entity which, at the time, was wholly owned by Prince, is the ‘sole and exclusive owner of all rights in and to’ THE TIME.” OK. So, Prince used Morris Day & The Time as well as other protegées, as prostitutes, so he could make money out of them performing and giving face to his songs... Quite pimp-ish in fact. Anyway, a contract is a contract, i do understand that. Both parties somehow agreed. But still after Prince's death ?! Someone needs to explain that to my simple European brains... - He can still change his name to ''Morris Daye & The Tyme'' -

Didnt PRINCE do this when he was alive? Wouldnt let him go out as "The Time" so then Morris seperated himself. Why do I have feeling this is coming down to calling it "THE TIME" If he played on the words I am sure he could get around this, like Prince got around things with the symbol, cause we know "his spirit didnt tell him to change it, his bank account did"

It looks like the issue is in the combination with “the time”.

I did some checking and since billboard pointed out who the attorneys for comerica are? I discovered the law firm and the bank have social media pages. Maybe fans can sway some changes if those in charge start getting DMs and emails explaining how this will impact profits by angering the fans. Treat it like we do when we contact our senators and leaders about something we don't like. You can click their social media links on their main webpages.
The law firm of Fredrikson and Byron main website is fredlaw.com
The bank site is comerica.com.

Since Prince’s passing, when “The Revolution” and “The New Power Generation” bands play, does the Estate get a cut, e.g. due to licensing? There may or may not be something coming!

The ban simply shows the inability of the Estate to come up with a licensing agreement that Morris c.s. can agree with. I.e.: a missed opportunity for an income stream. You can seach the US (Patent and) Trademark website (USPTO dot GOV) - the TESS system - to find out who owns what trademarks.
Looks like the lawyers of "Paisley Park" have been at work trademarking several things recently. Below is what they "own" at the moment, many just recently claimed.
In addition, the Variety article says the lawyers have documents that prove Morris signed the legal rights to "The Time" to Prince. The lawyers WANT to license the name to Morris Day. There is certainly value to the name, as Morris acknowledges. It belongs to the estate, and the lawyers will act to protect the value of the estate.
Morriss Day DID file a claim to "Morriss Day and The Time" for live performances. However, that claim was just cancelled. I take that to mean the Estate lawyers threatened a lawsuit - and Morris Day's lawyers thought they would lose:

And why is the Original Seven album gone, no streaming outlets have it to my knowledge and not even to buy anymore anywhere, is it because of the "Band formerley known as the time". So then why are "The Revolution" allowed to tour with that? Because they were never a seperate entity? if thats the case why can ALL the NPG go out as the NPG with new singers filling in for Prince, why doesnt the estate have an issue with that? because Morris hayes helped on Welcome 2 America"?

The estate is a fucking joke. They could be working with the record labels to move along the release of new music from one of the most prolific artists of all time, but instead they're pulling this greedy bullshit. Meanwhile, there hasn't been a major release since last summer, with seemingly no announcements on the horizon

The remastered version of The Time's debut album(whom was produced, written, arranged & performed by the creator of The Time Prince(r.i.p) ) . I've been listening to recently sounds great. It's a full circle moment for me to FINALLY hear it like it suppose to sound. "That mountain top situation is not really what it's all cracked up 2 B when was doing the Purple Rain tour had a lot of people who knew 'll never c again @ the concerts.just screamin n places they thought they was suppose 2 scream."

Until we know all the facts, it's probably best not to jump to conclusions/sides/etc. We don't know everything. There may be a reason for this. Also, I'm reading there could be merchandise selling involved etc. Also, it looks like Morris and The Estate ust can't reach an agreement yet. So rather than jump onto one or the pther party's bandwagon, it's best to collect more informaton.

What's not being said is that the Estate very likely wants a 20% cut for use of the name "The Time" and/or concert proceeds going further. I know the NPG have a similar arrangement with the estate. Unfortunately they can't release any future NPG albums, live or otherwise, without the estate's consent. Pretty shitty move by the estate - as "Morris Day and the Time" was never trademarked by Prince. Greedy? I don't know what kind of money they expect to earn from the Time. What do they earn, $50 per year for ther meager album streams. This move by the estate sucks and maybe it is motivated by greed, but they arne't likely to make any additional bucks controlling the name.

The remastered edition popped up sometime last summer on Spotify. Pretty good sound quality. Far better than the original release anyway. Shame it didn't have any proper bonus tracks though. In a perfect world, we'd get a remaster series of The Time's albums that included Prince's original versions included as a bonus.

Why do they have to come up with an agreement with Morris? They don't have to do squat. Morris doesn't own the name 'The Time'. Do you know that Morris filed for a copyright 2-3 weeks after P died, for something he didn't even own?
- E-mail - orgNote - Report post to moderator |
exactly and I don't think that the estate really has any future plans for 'The Time'.They're not gonna do anything with that name,so they should just let Morris and the guys continue to use it and do their thing.
