Assuming Pharrell and Robin Thicke still filed a pre-emptive settlement (PAYMENT).

People seem to have this impression of Marvin Gaye as being all cool with other musicians. But he was actually gone before he could see how his legacy as an innovator played out.

Marvin was an architect of modern soul to the very end (the sublime 808-based "Sexual Healing"), and sampling of his catalog would follow his death.

I am reminded of a story from jazz musician Bob James. He said he was soured on Hip Hop due to early sampling without permission, credit, or licensing. He spent a good part of the early 1990s fighting for his copyrights.



The first time Bob James heard his master recording used without any mechanical request or publishing credit was DJ Jazzy Jeff & The Fresh Prince's "A Touch Of Jazz". They sampled Bob James' "Westchester Lady".



The other main sample in the track was Marvin Gaye's "T Plays It Cool" from the Trouble Man soundtrack. Now, do you really think that usage was paid for or credited if "Westchester Lady" wasn't?



Now, if Marvin Gaye had spent the late 80's and early 90's fighting for just basic credit on brazenly sampled hip hop tunes like "A Touch Of Jazz", do you really think he would play it cool when it came to Blurred Lines? hmmm

As far as BL goes, I anticipate he would've held a similar opinion as his peers from that era, Stevie Wonder, Nile Rodgers and George Clinton.

Welp, George Clinton became very litigious fighting for the ownership of his own songs in the era they were being used.

Nile Rodgers sued over a 1979 rap single ("Rapper's Delight") and Chic took 100% of the writing credit.

So... you think Marvin Gaye would be like who? hmmm

Yeah, Clinton's tunes have been sampled a lot, as have Nile's, they should have been paid for those samples without question.

Marvin Gaye would probably dismiss it because though Blurred Lines SOUNDS like Got To Give It Up, they are in fact two different songs.

As for Marvin Gaye releasing Pharrell produced hits? it's possible but also sad. He just wouldn't sound like Marvin with Pharrell at the helm. Like BL SOUNDS like GTGIU.

Marvin Gaye had so much trouble with the IRS and financial problems in general, plus he would take no shit from anybody, so I doubt he´d allow people to make money off of his back by stealing his melodies.

Then again, if he were compensated for it and the end result was positive I believe he would´ve felt honored. Erik Sermon´s "Just Like Music" is a good example of paying homage to Marvin Gaye without butchering his music. I wonder if Mr.Sermon had to pay licensing fees to the Gaye family.

Watching those clips that Cinnie posted reminds me of my naive childhood and teenage days in the 80s when I knew very little about the original tunes from the 60s and 70s. I loved so many melodies on rap tracks only to be disappointed later when I found out how some rappers and DJs blatantly just stole the instrumental tracks without really adding anything of substance to them or without compensating the original artists.

The good thing about it though is that they helped me discover those artists in the first place.

And these days, I own the originals where all those samples came from and enjoy listening to them.

that's how it was all set up then, to give the impression they was making the music when they was featuring music of past artists all along

Eric Sermon did a brilliant job featuring Marvin Gaye's music in "Just Like Music"

he brought Marvin Gaye back to life on record
