They don't have to be German citizens. If you go to another country as a tourist/military, you can't go by your home laws if they conflict with their law. Why do you think some folks vacation in Amsterdam, where prostitution is legal? They're not breaking the Amsterdam law. It's like some states in the US recognize gay marraige and others don't.
