Michael's close gay friend Freddie Mercury giving his legendary Live Aid performance at Wembley Stadium. Somehow he manages to sound good despite being in an outdoor stadium. Wonder how he managed that. Maybe it has something to do with being a good live singer. Just a thought.

Yeah it's almost as if he doesn't have a choice if he doesn't want to be panned by critics, which may happen anyway but I think it's what the fans really want. At least the ones that are no longer impressed with theatrics and want something organic.

Michael Jackson is claiming ignorance when it comes to the lawsuit filed by his former publicist, Raymone Bain.

Bain is suing for $44 million in unpaid publicity and management services, receiving a default judgement after she was unable to serve Jackson. In one attempt to deliver the papers, a security guard told the process server to "get the fuck out."

Jackson claims to have never been served nor to have any knowledge of the lawsuit.

But we imagine that Jackson is aware of very little these days!

Michael Jackson Finally Takes the Stage in D.C. Court

His plans for a comeback tour are still on hold, but Michael Jackson may have managed to avoid a different financial disaster this week when lawyers appeared in federal court to fend off a potential default judgment against the pop star.

On Monday, attorneys from Dewey & LeBoeuf filed an appearance for Jackson at the U.S. District Court for the District of Columbia, 11 days after the court clerk’s office filed entry of default against the performer. Jackson didn’t respond after his former publicist, Raymone Bain, filed a $44 million lawsuit against him on May 5. Last week, Judge James Robertson held a hearing with Bain’s attorney, Frederick Samuels, name partner of Cahn & Samuels, to discuss a possible default judgment for his client.

Yesterday, Jackson’s legal team, which includes Dewey partners Henry Asbill and Donna Gordon, filed a motion to clear out the default entry, claiming that Jackson was never actually served with the suit.

Earlier this month, Bain filed affidavits showing that copies of her suit had been handed off to a security guard at Jackson’s Los Angeles Home, and to a former representative of his company, MJJ Productions. But the documents never made it to Jackson, his lawyers said.

Instead, Jackson allegedly heard about the suit on June 7 from friends who had read about it in the media (news reports of the suit broke the day it was filed). You can see The National Law Journals coverage here, here and here.

“Despite rumors and innuendos that may have surfaced before that date, Mr. Jackson did not conceive any lawsuit would be possible” because of an agreement Bain allegedly signed, his lawyers wrote in their motion.

Besides asking Robertson to get rid of the default entry, Jackson’s lawyers have also filed a motion to dismiss Bain’s suit. The publicist alleges that Jackson never paid her money she earned by arranging a series of lucrative business deals for the star. But Jackson's lawyers say Bain signed a release agreement that paid her $500,000 in return for waiving her right to any future earnings.

Today, several key motions were filed by Michael's defense to both respond to and oppose Raymone's claims. A summary of the VERY REVEALING claims as made by Michael's attorneys is included below:

- On December 27, 2007 both Michael Jackson and Raymone Bain entered into a "Payment and Release Agreement" whereby Raymone acknowledged that she was "not owed any additional monies under any other agreement from the beginning of time until December 27, 2007." As such, Michael's team claims that "any monies allegedly owed under the May 30, 2006 agreement between the parties were extinguished under the Payment and Release."

- The defense notes that this Payment and Release form is, not surprisingly, "completely and conspicuously absent from any of Plaintiffs’ pleadings and filings with this Court."

- More legal jargon which ultimately reiterates their stance that Raymone's claim is legally "not only without merit, but is frivolous."

- A deposition from Londell McMillan confirmed that Raymone Bain, as part of the Payment and Release Agreement she signed into in2007, was paid $488,820.05 and was fully satisfied, with total acknowledgment that NO OTHER MONEY was owed to her under ANY past agreements. This makes it clear why she avoided mentioning that release agreement in her complaint.

- The actual payment and release agreement states, in part:

Mr. Jackson shall render a payment made payable to you [Plaintiffs] in the amount of four hundred and eighty-eight thousand, eight hundred and twenty dollars and five cents ($488,820.05) as full and final satisfaction of any and all monies, known or unknown, to be owed to you by the Jackson Parties with respect to any and all agreements whether verbal or written that you may have entered into with the Jackson Parties from the beginning of time until December27, 2007 (the "Payment").

Except as otherwise set forth herein, in consideration of the Payment and other consideration provided herein, you [Plaintiffs] on behalf of yourself, your respective predecessors in interests, successors and assigns, representatives, partners, parents, subsidiaries, affiliates, members, officers, directors, agents, attorneys, employees, insurers, donees and licensees and each of them as applicable, do hereby absolutely, fully and forever release, relieve, waive, relinquish and discharge the Jackson Parties and each of their respective predecessors in interest, successors and assigns, representatives, partners, parents, subsidiaries, affiliates, members, officers, directors, agents, attorneys, employees, insurers, donees and licensees and each of them as applicable of and from any and all manner of action or actions, suits debts, liabilities, demands, claims, obligations, costs, expenses, sums of money, controversies, damages, accounts, reckonings, and liens of every kind or nature whatsoever, whether known or unknown, suspected or unsuspected which you shall or may have, own or hold, or which they at any time heretofore had owned or held against the Jackson Parties by reason of, arising out of or in connection with any matter whatsoever.

This agreement contains the entire understanding between and among the parties hereto and supersedes any and all prior understandings, agreements, representations, covenants, warranties, and releases, express or implied, written or oral, between any of the parties...

The defense argument goes on to describe how the court will have to uphold the agreement put in place by Raymone and Michael Jackson in2007, and how her claims exist based on " hearsay lacking any evidentiary support." Also, information and past court cases are cited as to why she cannot freeze any of Michael Jackson's assets or accounts without first obtaining a judgment, which again would be very unlikely given the release agreement acknowledging that she was owed nothing more regardless of any past agreements.

In conclusion, with this BINDING AGREEMENT now revealed and on the table, Raymone has "no viable case against the Jackson Parties and are therefore unlikely to succeed on the merits."

Reason for the delay in responding

In addition to the bombshell information I mentioned previously, Michael's side also explained the delay in response, and why the original notice of default should be tossed now that a formal response has been made within the allocated time the court provided.

According to the claim, Michael Jackson only became aware of this case on June 7th whereby he quickly acted to appoint the legal team he now has in charge of it. He was only informed of it through Frank Dileo who learned of it via the media, and never through a formal summons. Raymone alleged that a summons was given to a security guard and to Dr. Tohme Tohme, but none of them actually made their way to Michael. Dr. Tohme Tohme no longer has any personal nor professional association with Michael Jackson, nor did he at the time the original summons was served and he did not in any way communicate the information to Michael.

In addition, the lawyers state that "because of the existence of a valid and binding payment and release
agreement between the parties, this action came as a complete surprise to [Michael Jackson]... Despite rumors and innuendos that may have surfaced before that date, Mr. Jackson did not conceive any lawsuit would be possible based on the payment and release agreement executed by Raymone K. Bain."

Michael Jackson submitted a signed declaration to these facts.

P.S., Also revealed and confirmed was the official termination of Dr. Tohme Tohme, which went into effect May 5th and disbarred him from having any subsequent affiliation with Michael Jackson or any of his numerous established entities (including MJJ Productions and the newer MJJ Kingdom).

The defense is also calling for the dismissal of Raymone's complaint based on the agreement she signed into which prevents her from profiting any further from Michael Jackson and contradicts her very claim.

Ricky like Madonna works with Jamie King who got his start as a Michael Jackson backing dancer on the HIStory Tour before going on to work with Prince.

I really like Jamie's work. I've never seen that performance of Ricky before which is a shame because I really like him.

I think his favorite designer is Armani. That's who I thought could dress Michael and I think there were rumors for awhile--or was it Versace? Anyway, I like Ricky's look. He always looks fashionable, comfortable, and sexy without being flashy.

I am assuming that your argument in a

nutshell is

Michael can only sing now in short bursts. It doesn't mean he can't sing a note, but just that his vocal cords are so damaged he will never again be able to sing live for any extended period and even then it won't sound like it once did, particularly in more vocally demanding songs.


This sounds rational enough, and I think you would find most fans would agree in part with you. Makes me wonder what all the back and forth was for in the first place.

You seemed hung up on the whole he just sings due to dancing defence, that as you'll notice from my first post was not what I was ever stating. I asserted it may have begun that way, then you informed me of what songs were mimed in the later parts of the BAD tour, and I agreed then that those songs weren't intensive dancing and thus we probably due more to strain on the vocals and/or laziness. A point you don't even address, yet claim I am dodging your point of view.

I've stated repeatedly that I think the reason for the lipsynching is a mix of a decline in his voice and a need for perfection. I've seen a lot of great shows in my time and have noticed a lot of singers have their voices worn by the time it comes to the later part of the show (especially if it's a 90 minute + show). Some of my most favourite acts sound hoarse by the end of the night. It's a fact of performing. So as I have often stated when you throw a mix of Michael's decline in vocals, physical fitness due to the dance routines, potential laziness, and pressure for perfection it's perhaps understandable that in his mind he sees lipsynching as a way of giving the fans what (in his mind) they want and putting on a great show. I think it's a combination of all these factors, wouldn't you agree?

And I personally take offense at being called dishonest for being right. As for knowing where TWYMMF and MITM were in the setlist, I honetsly didn't know. Like I am aware he performed Dirty Diana and Another Part of Me live during the Bad tour, but don't know if they were song 7 or song 12. I just know when he toured Australia he introduced I just can't stop loving you and Bad as the final two songs. So I made the logical assumption that the inclusion of these two songs might have been encores. Then you have a go at me for being correct? And you call me dishonest for making a correct assumption?

Also I reviewed your I'll Be There clip and agree it's not a great performance. No denying that. As I mentioned for every bad clip, good to great clips will also be put forward. And as I mentioned the show I went to when he sang live it was great.

Also, there were no live ad-libs in his "Earth Song" performances on tour

No denying that when he sings he still draws you in.

Anyway, I am not deliberately trying to inflame you or convince you of anything. All I have been trying to do is offer an expanded reasoning behind the lipsynching.

I guess we will see where Michael's voice is at during the upcomming shows, should he realise that what excites the fans more than any song and dance number are those moments of spontaneity that comes from a true live performance.

I'm coming from Australia too, but I have opening night tix. smile I've never been overseas.

As for not watching footage, I have done it for other concerts- I didn't watch anything on youtube or news reports prior to seeing Stevie Wonder and Justin Timberlake.


Wow opening night - that is awesome. Would love more info from you with regards to where you are staying etc, to help a fellow Aussie out when I make the trek.

The "screaming ninis" as I call them sadly aren't exclusive to Michael. I was at the 3121 shows and had some next to me for that and it almost killed one night for me. I even had one at a Radiohead gig. And don't even try to see a Panic at the Disco show, lol.
