Maybe I read it wrong but in the article I posted, it was prosecutors who are saying the defense was bringing this up (charging witness for crimes because they kept a "doctored tape", they say) and Jim DeRogatis will probably NOT testify if he pleads, what, the fifth?

I gotta say the defense will probably NOT get their way by the end of next week. hah!

Ex-Kelly employee testifies singer appears on sex tape

CHICAGO (AP) — A former employee of R. Kelly testified Tuesday that she was "110 percent sure" the Grammy-winning R&B singer appeared with an underage girl on a sex tape at the center of his child pornography trial.

Lindsey Perryman, who said she worked as a record producer and personal assistant to the singer and his family off and on from 2000-2007, told jurors that she first saw the tape in December 2007, after being approached by prosecutors.

At that time, she said, she was not sure it was Kelly on the video and didn't want to believe it because he was a great boss and "very, very good to me."

"I was in shock and I wanted to be 110 percent sure," so looked at an album cover with Kelly on it before viewing the videotape a second time, Perryman said. She said she then was sure it was Kelly; she also identified the alleged victim, who had visited Kelly's studio.

Kelly, 41, is charged with 14 counts of child pornography for allegedly videotaping himself having sex with an underage girl. He has pleaded not guilty and faces up to 15 years in prison if convicted.

Kelly's attorneys have said he is not on the tape, even noting that the singer has a mole on his back and the man on the tape does not. The alleged victim, now 23, has denied she is on the tape.

Two other witnesses on Tuesday testified that the female participant on the graphic 27-minute videotape was the same person prosecutors say was as young as 13 at the time. Prosecutors claim the tape was made between Jan. 1, 1998, and Nov. 1, 2000, and that the young female in the tape was born in September 1984.

Tjada Burnett, a family friend of the alleged victim, said she recognized the female participant by her "cheeks, her nose, her facial structure," and said she could have been about 12 or 13 years old at the time the tape was made.

Under cross-examination, a defense attorney asked Burnett whether the alleged victim wore braces and showed the jury a photo in which she appeared to be wearing braces.

Burnett testified that the alleged victim had braces sometime between 1997 and 1999, and acknowledged she would have had the braces after the tape was made.

Kelly lawyers accused Raven Gengler of lying to help the prosecution's case when she testified that she's certain the girl on the videotape was her childhood friend. Gengler, 22, said she first saw the video after downloading it several years ago from an Internet file-sharing site in 2001, after the tape had become the talk of her neighborhood.

"You know the difference between a truth and a lie. And you lied before, didn't you?" defense attorney Sam Adam Jr. said.

"I'd never lie," Gengler replied, pulling nervously on her long hair.

Within hours of their opening statements last week, prosecutors entered the VHS tape into the record as "People's Exhibit No. 1" and played it in court. Also last week, several witnesses, including a relative of the alleged victim, testified that they recognized her in the videotape.

Although Kelly won a Grammy in 1997 for the gospellike song "I Believe I Can Fly," his biggest hits are raunchy ballads like "Ignition" and his current single, "Hair Braider." He is scheduled to release a new album in July.

His defense seems like it's struggling to scramble whatever they could to say Robert didn't do it. Now they're trying to prove that because the girl wore braces that the girl in the tape didn't and that's supposedly is supposed to convince people it wasn't her but they still are willing to charge the witnesses for possessing illegal material because they "didn't report it to authorities". The girl who says that she engaged in a threesome with Kelly and the girl will testify today so let's see what they come up with.

CHICAGO — R. Kelly's child pornography trial was adjourned Wednesday after a lawyer for the R&B singer said he received a call from a man who claims to have information relevant to the case.

Judge Vincent Gaughan said attorneys needed time to depose the man, who potentially could impeach someone else's testimony, but didn't elaborate. Kelly attorney Sam Adam Sr. said the man was flying to Chicago Wednesday night from another state.


Kelly, 41, has pleaded not guilty to 14 counts of child pornography for allegedly videotaping himself having sex with an underage girl. He faces up to 15 years in prison if convicted.

His lawyers maintain he is not on the tape, and the alleged victim, now 23, has denied she is on the tape.

But a dozen witnesses have identified the same person as the alleged victim who prosecutors claim was a minor when the tape was made. Prosecutors claim the tape was made between Jan. 1, 1998, and Nov. 1, 2000, and that the female participant was born in September 1984.

On Wednesday, a high school basketball coach testified that one of his former players is the young female who appears on the sex tape at the center of the trial.

Jacques Conway said he recognized his former player, in part, by a distinctive cross worn by the female participant on the graphic 27-minute videotape. He said he had seen his former player wear the necklace.

Kelly attorney Sam Adam Jr. asked Conway about the alleged victim's character.

"At any time did you see anything that would lead you to believe she would sell her body for money?" Adam asked.

"No," Conway responded.

The man on the videotape is seen handing money to the female participant.

A middle school basketball coach, who said he got to know the alleged victim through some of her friends, also testified Wednesday that she was on the tape.

Although Kelly won a Grammy in 1997 for the gospellike song "I Believe I Can Fly," his biggest hits are raunchy ballads like "Ignition" and his current single, "Hair Braider." He is scheduled to release a new album in July.

disbelief The defense sounds desperate and unorganized.

Today some woman called on Wendy mentioning that the girl in the tape looked willing and experienced and that was basically her only point. Why do people keep brining that up? She could have been a 10-year veteran with a damn doctorate in the Kama Sutra and a thesis on The Joy of Sex but she was still underaged. Hello? Boundaries, anyone?

I bet if this guy doesn't make it, that the judge will hold the defense in contempt and R. Kelly could find his bond revoked putting him in a cell for the remainder of the trial. That just seems so ill-fated for them to suddenly bring it up. And here I thought the prosecution would be the ones pulling straws. disbelief

An FBI forensic expert testified Thursday that the male and female in a sex tape at the heart of the R. Kelly child pornography trial weren't computer-generated or altered.

In more than an hour of highly technical analysis, George Skaluba told jurors that the video appears to depict "real people in a real environment."

The defense maintains the R&B star is not the man in the video and has repeatedly suggested that his likeness could have been computer-generated onto the 27-minute tape.

Kelly, 41, is charged with child pornography for allegedly videotaping himself having sex with a girl who prosecutors say was as young as 13. He has pleaded not guilty and faces up to 15 years in prison if convicted.

Skaluba also told jurors that even if someone wanted to create digital images, it would be costly and could take years.

"It would be very, very time consuming and very hard to do," Skaluba said.

Under cross-examination, Skaluba conceded he wasn't in a position to say if the male on the tape was actually Kelly or a look-alike.

Kelly's attorneys have also noted that the singer has a mole on his back and they claim the man on the tape does not. The alleged victim, now 23, also has denied she is on the graphic video.

The tape obtained by prosecutors is not the original, but a copy several times removed from the original, Skaluba said.

Earlier on Thursday, prosecutors said they needed more time to interview a potential defense witness before he can testify. The man told Kelly's attorneys he had information that could impeach the testimony of a prosecution witness.

And what would the motive be for someone to do a CGI set up or have a stunt double? Have him punished for all the crappy music he's released to the world. Even if there was a mole, depending on the kind that could be removed.

The mole that R. Kelly's defense team said would set him free popped up in court Thursday when the sex tape at the heart of the case was broken down for the jury.

In a near frame-by-frame analysis of the 27-minute video, an expert pointed out a few seconds in which a mole appears on the male participant's back. The blemish is just left of the man's spine, a few inches above his waistline.

Police photographs of a semi-nude Kelly taken after the R&B superstar's arrest in 2002 show a dark mole in a similar location. His attorneys last week said Kelly has had the mole since childhood.

"There's a mark on this man's back [in the police picture] about the exact same size and position as the man in the video," testified Grant Fredericks, a forensic video analyst.

Kelly, 41, faces child pornography charges stemming from a sex tape that authorities say he made with a girl as young as 13 between 1998 and 2000. He has pleaded not guilty to the charges.

The frozen video image appears to undermine the defense team's assertion that Kelly could not be the man in the video because that person has an unblemished back. The defense downplayed the tape for jurors Thursday, saying the mark disappears several times during the poorly lit, amateur recording.

"There, not there," lead defense attorney Ed Genson said as he showed the tape at half-speed. "There, not there. There, not there."

Kelly's bigger concern, however, may be the upcoming testimony of Lisa Van Allen, a 27-year-old Georgia woman who is expected to testify next week that she engaged in a three-way sexual encounter with both the Grammy winner and the alleged minor in the sex tape. Her court appearance was postponed Wednesday after Damon Pryor, 33, contacted the defense with information he said would undermine her testimony.

Van Allen's fiance, Yul Brown, said Pryor is Van Allen's ex-boyfriend and the father of Van Allen's 5-year-old daughter.

During a phone conversation from his home in suburban Atlanta on Thursday night, Brown described how his fiance met Kelly when she was a 17-year-old extra on the set of his "Home Alone" video in 1998. The video was shot in Alpharetta, Ga., the adopted hometown of the Connecticut-born Van Allen, Brown said.

The two soon became romantically involved, despite the fact that Kelly had married Andrea Lee two years earlier, Brown said. In 2001, Van Allen played the role of Kelly's hair braider in his "I Wish" video, Brown said.

"They had a serious relationship," Brown said. "You have a child who was impressed with an R&B singer. She was young."

After moving to Chicago to be with Kelly in the late 1990s, Van Allen met the singer's goddaughter, an Oak Park girl who authorities say is featured in the sex tape. The two teens maintained a regular presence at his downtown recording studios, his former assistant Lindsey Perryman testified this week.

Brown said the girls' relationship evolved to include group sex with Kelly. The "I Believe I Can Fly" singer videotaped a three-way sexual encounter with himself, Van Allen and his goddaughter on at least one occasion, he said.

"Yes, a tape existed," Brown said. "I won't say if I have any knowledge of what happened to the tape."

Sources familiar with the case say Van Allen sold the tape to one of Kelly's representatives for a significant amount of money. Kelly's defense team also is expected to accuse her of offering to switch her testimony in exchange for cash when she takes the witness stand Monday.

Brown would not comment on the specifics, saying he didn't want to jeopardize the case.

"The truth will be out there," he said. "Lisa is looking forward to setting the record straight."

The defense, prosecutors and Van Allen cannot comment because of Cook County Judge Vincent Gaughan's gag order.

Brown said his fiance officially ended her relationship with Kelly in 2005 because she no longer wanted to be the mistress of a married man with three children. It was an amicable parting, though the singer tried to stop her, Brown said.

"He didn't want to break up with her," Brown said. "But she wanted more out of life. She just grew up. She wasn't a teenager anymore."

Van Allen, who is four months' pregnant and works for her fiance's investment company, looks forward to testifying, Brown said. The couple traveled to Chicago for the trial this week, but was sent home Thursday after defense attorneys met with the witness they say will undermine Van Allen's testimony. They plan to fly back Sunday, Brown said.

The couple realize that Van Allen will be thrust to the forefront of the high-profile case, but they're prepared for the media onslaught and an intense cross-examination by Kelly's defense team, Brown said.

His fiance—whom he described as "funny, opinionated and beautiful"—has no reason to lie about her involvement with Kelly or his alleged victim, Brown said.

"She knows her reasons for coming forward," Brown said. "Like she says, why would she tell everyone she had sex with a minor if it wasn't true? She knows the truth."

Seems like the guy who will try to undermine that witness' testimony is no willing participant either, it seems:

The defense witness, Damon Pryor, flew in to Chicago on Wednesday night after telling defense lawyers he had information about Van Allen. Prosecutors began taking his deposition Thursday morning, but the interview was not completed, and Pryor refused to provide his Social Security number for a background check, prosecutors said.

I wonder why he didn't wanna do that... anyway, the girl's fiance said that the girl "has no reason to lie about anything" and that Damon won't undermine anything because Damon was her former boyfriend and her baby's father.

Her court appearance was postponed Wednesday after Damon Pryor, 33, contacted the defense with information he said would undermine her testimony.

Van Allen's fiance, Yul Brown, said Pryor is Van Allen's ex-boyfriend and the father of Van Allen's 5-year-old daughter.

During a phone conversation from his home in suburban Atlanta on Thursday night, Brown described how his fiance met Kelly when she was a 17-year-old extra on the set of his "Home Alone" video in 1998. The video was shot in Alpharetta, Ga., the adopted hometown of the Connecticut-born Van Allen, Brown said.

The two soon became romantically involved, despite the fact that Kelly had married Andrea Lee two years earlier, Brown said. In 2001, Van Allen played the role of Kelly's hair braider in his "I Wish" video, Brown said.

"They had a serious relationship," Brown said. "You have a child who was impressed with an R&B singer. She was young."

After moving to Chicago to be with Kelly in the late 1990s, Van Allen met the singer's goddaughter, an Oak Park girl who authorities say is featured in the sex tape. The two teens maintained a regular presence at his downtown recording studios, his former assistant Lindsey Perryman testified this week.

Brown said the girls' relationship evolved to include group sex with Kelly. The "I Believe I Can Fly" singer videotaped a three-way sexual encounter with himself, Van Allen and his goddaughter on at least one occasion, he said.

"Yes, a tape existed," Brown said. "I won't say if I have any knowledge of what happened to the tape."

Sources familiar with the case say Van Allen sold the tape to one of Kelly's representatives for a significant amount of money. Kelly's defense team also is expected to accuse her of offering to switch her testimony in exchange for cash when she takes the witness stand Monday.

Brown would not comment on the specifics, saying he didn't want to jeopardize the case.

"The truth will be out there," he said. "Lisa is looking forward to setting the record straight."

The defense, prosecutors and Van Allen cannot comment because of Cook County Judge Vincent Gaughan's gag order.

Brown said his fiance officially ended her relationship with Kelly in 2005 because she no longer wanted to be the mistress of a married man with three children. It was an amicable parting, though the singer tried to stop her, Brown said.

"He didn't want to break up with her," Brown said. "But she wanted more out of life. She just grew up. She wasn't a teenager anymore."

Van Allen, who is four months' pregnant and works for her fiance's investment company, looks forward to testifying, Brown said. The couple traveled to Chicago for the trial this week, but was sent home Thursday after defense attorneys met with the witness they say will undermine Van Allen's testimony. They plan to fly back Sunday, Brown said.

The couple realize that Van Allen will be thrust to the forefront of the high-profile case, but they're prepared for the media onslaught and an intense cross-examination by Kelly's defense team, Brown said.

His fiance—whom he described as "funny, opinionated and beautiful"—has no reason to lie about her involvement with Kelly or his alleged victim, Brown said.

"She knows her reasons for coming forward," Brown said. "Like she says, why would she tell everyone she had sex with a minor if it wasn't true? She knows the truth."

Exactly. That guy who refuse to give out his SS# is suspect IMHO. It's like if you ain't got nothing to hide and you wanna help R. Kelly out then what are you afraid of? The judge may end up dismissing him from the witness stand just for wasting his time. lol
