Fan Sues Rolling Stones for Canceling Gig

NEW YORK -- "A Rolling Stones fan has filed a class-action lawsuit because the Stones called off their show last week in Atlantic City, N.J. The New York Daily News reported that Rosalie Druyan has filed the $51 million class-action suit because she contended that the cancellation cost her and other fans a lot of money on nonrefundable hotel reservations. The Stones called off the show because Mick Jagger had a sore throat -- and announced that they will make up the date on Nov. 17.

The Stones have also called off Friday's show in Vancouver, B.C., because of Jagger's sore throat. The group will also delay Monday's show in Oakland, Calif., by a day and push back the Los Angeles show from Nov. 18 to Nov. 22. Another show, set for Honolulu, has been canceled. Tuesday night's show at New York's Beacon Theatre, which was to be taped for a Martin Scorsese film, was delayed until Wednesday night, according to a theater representative."[i]

obviously someone with too much time on their hands and connections to a bad attorney. what grounds are they filing suit on? breach of contract? intentional infliction of emotional distress? negligence? i'm amazed at the stupidity of people.

this case will be dismissed for failure to state a valid cause of action. i suspect the ticket was purchased with the strict understanding that the show is subject to postponement or cancellation at the band's decision. even if it doesn't say that on the ticket, which i'm sure it does, a rock n' roll band cannot be held liable for our desire to see them perform live. if this person were permitted to sue and win it would basically prevent anyone from cancelling anything without the threat of being sued. on top of that, its a purely economic loss with no intent on the part of the band. even if this were a legitimate case, there would be very little a court would do about it besides order the band to a refund of the ticket price, which is probably being offered anyway to those who can't attend the rescheduled date.

i'm just curious to know what the cause of action is. i'm also interested in knowing where the suit was filed and if proper jurisdiction can even be applied. what a crazy world.

Who cares if he has a sore throat? Dude could never sing in tune anyway. Maybe whispering the vocals might actually be a good thing?

It's not like the Rolling Stones forced her to buy hotel rooms. And what kind of fan sues the band they love?

And what kind of hotel costed them $51 million to rent?

That's what I was thinking too.

its a class action suit so there are multiple plaintiffs from various states. my guess is they are trying to say that the cost of airfare, hotel, car rental, lost work, and emotional stress, plus attorneys fees equal 51 million. crazy asses.

what they're probably hoping to do is corner the stones and get them to shell out a few "measley" million bucks in an out of court settlement. thing is, this is never gonna make it to court and in the end it'll cost the plaintiff a bunch of cash cuz that attorney is sure to get paid either way.

come to think of it...maybe the lawyer isn't so dumb after all.
