They can't "mess with you" in that they can successfully sue you, but your video can be taken down just the same. The same rule applies here. If you use somebody's creative content (even if it's "just" an arrangement), they have the copyright.

Yea, I was speaking strickly regarding youtube with Prince and his peeps taken down covers of his songs; But when he does a cover of somebody elses song and if one put version of his cover of that other artists song on youtube could he and his peeps still have that taken down also?

This is a subject about which the new Prince, as was the old Prince, is passionate. He is an advocate for artists' rights and feels that the powerful corporations should not own aim artist's music. He talks about the compulsory license law, where anybody can take my song and sing it, against my will. I'm a writer. Stephen King is a writer. Can I take a page out of his book and call it Prince's Shining? Can I take a scene out of a movie and call it my own? They say the law, helps the writers. I don't need help; I don't need your money. Let us steward our own music.

prince b mad cuz peeps cover his songs better than he does

prince b full o shit cuz he covers songs too .. crimson and clover wild thang on lotus was pretty recent .. plus his live set is chock full o the worst cover versions ever heard

prince has the logic of an alchoholic .. none of his quotes on the subject make much sense

funny since his live shows are full of covers... confused but in the george lopez interview some years ago I remember he said he only wants his friends to do covers of his songs...they can do it..the others he's not happy about it..

This thread is a mess.

The law says that:

- You can cover a previously released song by anyone without anyone's permission unless you make significant changes to the original song, in which case the author may prevent you from releasing it. What constitutes "significant changes" may be left to the appreciation of a judge if both parties can't agree on something.

- You can't cover an unreleased song, though (for example the cover of Extraloveable that was put on YT before P released it in 2011 was illegal, but now the same recording would be legal as long as royalties are being paid).

- You have to pay proper royalties for any broadcast, stream, release or live performance of a cover, though, therefore it can be removed from Youtube if you just put it there -whether you make money with it or you just do it for fun- without paying royalties, since YT doesn't automatically pay royalties for the content put on the website by its users (radios and TV pay royalties, but the content is aired by themselves, not external "users"). The fact that you distribute/broadcast/stream it for free doesn't mean you can escape giving money to the original author. I don't know in the US but in France even shops, malls, bars, nightclubs and restaurants have to pay royalties for the music they play.

- Covering a cover is a very odd concept, I doubt it would stand in a court of law because arrangements as such don't count as a composition and don't imply the payment of royalties. I guess it would need to be ruled by a judge on a case by case basis.

- Record companies have nothing to do with that: they own the MASTERS, i.e. the factual recordings of a song. They don't own publishing rights and can't prevent anyone, including the original artist, to rerecord the song. They don't get any money from covers eithers. Warner Bros therefore has no say in people covering When Doves Cry.

- Samples, on the other hand, need to be licensed from the owner of the original master recordings, since they involve said recording, and of course are also submitted to royalties payment to the original song's author.

- Licencing a song (in a movie for example) also involves asking permission to the master recording's owner, but not from the authors (though they will once again receive royalties).
