where someone got married is completely irrelevant. but, for the record, they were married in Hawaii. Where you file for divorce depends on where the Petitioner resided the 6 months prior to filing the divorce which, in this case Additionally, where you got married or are getting divorced has no bearing whatsoever on where you own property. I can get married in Las Vegas, get divorced in Texas, own property in 50 states, and with no pre-nup or statutorily law providing that the property is not community property, then all the property in 50 states is subject to the state's community property laws based on the state that I filed for divorce in.

Did I explain that clearly? Going back and reading it, it sounds kinda confusing now lol

Location of Marriage: Irrelevant
Location of Property: Irrelevant
Location of Divorce: That state's laws determine what is and isn't subject to community property in the absence of a prenup, regardless ofwhat state the assets are located in

Thank you for clearing that up for me. I'm not a lawyer so I was not sure how this went. I know what people have said, but still was not sure they were correct. How did you come to know all of this information?? Just curious.

It is interesting that for the first time in a long time, majority of people posting are agreeing with CJ. I thought these are private people and the divorce was sealed. It seems that someone really want this out now and with CJ at her best we got the message. I am just wondering, when Prince brought down his house in Minnesota, do anyone know what happen to his other properties? As we do not know it will be better for all concern to with hold judgement. Divorce is not a good thing to go through. I hope they will find a solution soon and avoid further pains amd hurts.

im willing to bet the discovery will be sealed wink discovery process in litigation is just like it sounds, they get to ask the other party questions in writing, to which they have to answer if it not an otherwise "objectionable" question. there is a set number of questions you can ask though and objections are based on legitimate objections listed in the law (i.e. the question is irrelevant to the current litigation). you can also require them to produce docuemntation of certain things, you just have to specify exactly what you are looking for, and if it is not a "privileged" document under the law (i.e. attorney-client privileted documents do not have to be produced), they have to provide it. soooo, i am willing to bet Prince's attorney moves to have the dicovery sealed before they respond to the discovery request wink

So then with your experience and I know your response is purly speculation since we don't really know what is going on, but if he has a pre-nup what are her chances of taking him to the cleaners or will the pre-nup really protect him and his assesets. And normally what would someone be looking for in a discovery?? Would he be required to take care of her since she does have her own company now??

I think this is an interesting perspective on how people are able to change so much, yet so little. She started out as some kind of retail lady, originally in charge of making sure shirts and accessories were properly in stock, probably the toilet paper as well. She slowly made her way to be some kind of assistant to the man then as we all know she became the girlfriend and eventually the wife.

Now...well...in much less time she's made her way from the wife to the angry ex asking for more than she deserves. And ultimately she'll end up back as the retail lady. Kind of a full circle thang. Granted she'll have some money, and a charity, but along the likes of the Britney Spears Charity, helping children in need.

Prince made her what she is, otherwise she'd still be in the background bossing people around to deliver shirts, necklaces, incense and candles.

that's why I find Mani amazing but I'm not sure if its in a good, bad or envious way, LOL! I mean that gurl made plans, set a goal and it worked!!! Now she's going after P's assets. I don't know what happened so I shouldn't make judgements. As with any couple going through this I hope all is well in the end.

that really is hard to speculate on as far as the prenup. A prenup basically is whatever the parties agree to. Brittany Spears is a good example. Her prenup provided for certain support based on the years of the marriage, and kept her assets from Kevin. I would imagine his prenup is something along those lines...it provides for a certain amount of spousal support, keeps his assets to himself, probably discusses what happens to income/property acquired during the marriage, detailing what is separate and what is community, etc. Spousal support is really dependent on the state and I don't know the Minne laws. I can check and get back to ya on that. Odds of her taking him to the cleaners are slim to none with a solid prenup. Of course, everything has loopholes, that depends on who has the better attorney wink If it was well written by his attorney, her attorney could find loopholes, and vice versa.

As for the discovery...she is probably looking for assets that would be considered community property under the prenup, possibly a house.

You are awesome, thanks for shedding light on the legal aspect. If you do look into the MN laws please let me know what you find. I curious now myself. I do agree I thought his case was sealed so it is interesting that this CJ person has this information. I wonder if Prince knows.

True true. but I also find it very hard to believe that Mani didn't know that Prince wasn't no prince. she was a fan like us, on fansites, collecting. she then worked for his company, then became his personal assistan. I have no idea why they are divorcing but she kind a got what she wanted. She knew what she was getting into. ofcourse I have no proof but that is my gut feeling.

I also have to add that it doesn't excuse Prince if he did something wrong either.
