Croke Park fiasco rumbles on - now in the US courts

MCD pursues Prince for €2.2m through US court

MCD PROMOTER Denis Desmond is pursuing Prince through the American courts to recover €2.2

million in damages which have not been paid.

Documents filed in the Central District of the Los Angeles Superior Court are seeking recognition

of the High Court judgment given last year against Prince.

If judgment is granted, Mr Desmond will be able to target Prince’s assets, including his home, if he

does not pay.

MCD is seeking interest payment of 8 per cent on the settlement, which would add another

€176,000 to the total owed by Prince to the promoter, if he does make payment by March 26th.

Mr Desmond sued Prince when the temperamental superstar cancelled a concert in Croke Park

scheduled for June 16th, 2008, just 13 days before it was due to take place.

A total of 55,000 tickets had been sold for the event. Prince never gave a reason for the

cancellation and has never made a public comment about it.

The case went to the Commercial Courts in February last year and was settled after a four-day

hearing. Prince agreed to pay €1.6 million in damages and a further €600,000 in legal costs to Mr

Desmond.

However, Prince didn’t pay the money by the agreed date of March 10th last year. As a result,

judgment was entered into against him followed by a European Enforcement Order Certificate,

which allowed MCD to pursue Prince’s assets within the EU.

The documents, seen by The Irish Times , state that MCD has obtained preliminary attachment of

approximately €692,000 held in Prince’s bank accounts in France and Portugal but have still not

received any money.

Speaking after the judgment last year, Mr Desmond said Prince had been badly advised. “His own

side says he is just not communicating. It is sad that an artist of the calibre of Prince has found

himself in this position. He needs to surround himself with good advisers.”

I am so tired of people saying P needs new advisors. If his own side is saying he is not communicating then it means he does not want to pay the money.

Back in 1984 the photographer that got beat up by Big Chick sued Prince and the case stayed tied up in court for years and the photographer dropped the case in the early 90s.

You get judgements against people but you cannot make them pay you.

As someone who thinks Prince's music can at times be better than The Beatles, U2, James Brown, Stevie Wonder, and Elton John combined....when it comes to his ethics, and business sense, he is a total nutjob. Ask any local businesses in the Twin Citites, and they will tell you to "Avoid business with Prince at all costs."

Sad, because he's still young enough to change this perception, but need I remind myself....this guy let Tony M in the band.

I'm not completely unsympathetic to your position, but........

The artist's contract with you only extends as far as the price of the ticket. Traveling a long distance for a show is your choice, and you assume the risk in the event that the show is canceled. Complaining about it is pointless.

That quote regarding the advisors is from last year. But we all can't decide not to pay our bills if we just don't feel like it.

And as for dragging out legal proceedings, that might work with an individual who doesn't have the time and resources to fight a long legal battle.

That's not so effective against a corporation owed enough money to make a long litigation worthwhile.

If he eventually lost in that manner, he'd have to pay the initial sum plus a great deal more legal fees.

What exactly is a Croke Park? Is it a park or an arena? Does it really warrant all of this attention? I mean seriously, Prince cancelled the first show of 'W2A' @ Izod and the tri-state area didn't burn to the ground over it!

When eye go 2 a Prince concert or related event it's all heart up in the house but when eye log onto this site and the miasma of bitchiness is completely overwhelming!

Do you think this promotor is a large corporation? Lots of people do not pay their bills and if P has put property and bank accounts in that names of corporations the promotor is going to have a hard time getting his money. He by all means has the right to try a collect but it is not going to be easy.
