Nice to see the xmas spirit flowing with goodwill to all men !!!!

I'm happy Irish got a refund, he paid allot of money for his tickets and did not receive the best VIP tickets as promised by Ticketmaster/AEG at the time they were sold, which is the experience of most people who bought VIP and have posted here, the gratuity Irish received for access to the VIP bar on another occassion was offerred to me also, AEG were very clear this was gratuity from themselves, and in no way was given as compensation/refund from AEG/Ticketmaster (they did not want to set a legal precident), so Irish and anyone else who received gratuity from AEG should still be entitled to a refund, as the lack of VIP quality tickets was never resolved.

AEG/Ticketmaster must have made a bundle out of this VIP fiasco, there were 21 nights in total, i'm guessing they sold at least 500 packages per night on average, thats over £2.5 million, it will be very limited in what they refund, most people will unfortunately just pass it off as a bad experience and not pursue refunds, so they've made a killing on selling average £31.21 tickets for £250, the VIP reception was a drink on entry and 3 vouchers, plus some finger food, total value per person i'd put at about £20, so that and a £31.21 ticket means they made £200 on each VIP ticket sold, so for me, I'm happy for anyone who gets anything out of AEG/Ticketmaster, I hope everyone who bought VIP complains and takes them to the cleaners !

I don't personally care if wolfie did get more than his "fair share" and i don't care if ecnirp98 sold tickets at higher than face value.

let's please, all focus on the most important issue here, which is getting people who didn't get refunded (and still want a refund) their money back.

Personally, i wish wolfie the double best of luck, a goodwill gesture is not a refund, and he's done nothing wrong by going back for seconds, he was misled re: his rights and mis sold, his getting his money back only strengthens the case of everyone else who deserves it.

so two questions.

who is still trying to get their money back?

what arguments have the people that got their money back successfully employed?

Wolfy, and that helps glyn how exactly?

Glyn, go to your local County Court start a small claim against AEG and Ticketmaster and hold them jointly and severally liable

It doesn't cost much

They will refund you in full as its cheaper to do that than fight it

Simple really

I'm still trying to get a refund out of ticketmaster for 2 VIP tickets which cost £474.95 , i've made quite a few phone calls to AEG/Ticketmaster and sent in 2 letters so far.

Ticketmasters response is that its upto AEG, and ticketmaster have sent on my complaints to AEG.

My argument is that I was promised 'The very best seats' as part of the VIP advertisement (I copied in the advert screen dumped from the web), I was in Block E1, row C, directly behind the drumkit and Keyboards (plus brass section most of the time) so these were restricted view tickets and not worth £474.95 (though I must say better than some of the horror stories I've read of people in block F).

I complained when I received the tickets 4 days before the gig on 11/08, I was told by ticketmaster that I could complain afterwards, my arguments was I knew these tickets were bad from what people had said/stage layouts, so I wanted moving to enjoy the show rather than complain after the event, they even suggested the drumkit might be in another area of the stage when I attended, I pointed out how ludicrous this was and artists generally did not change the layout of their stage/performance for when I attended !!! I copied in all the conversations I had with their staff with names and dates at the time and afterwards.

I re-sent the letter last week as an email as Ticketmaster claimed they did not have a record of it (even though I received a standard response letter from them after sending it that the mater was being investigated, this was in September), I have informed them they have 28 days to deal with the matter or I will pursue legally.

I've also never sold any tickets for profits !

Has anyone done this and won against AEG/Ticketmaster for the Prince VIP tickets? if so, did they have to attend or did AEG/Ticketmaster settle/refund before ?

What you have here is a prima facia case of a false trades description

Ticketmaster and AEG simply bounce the complainants back and forth between each other hoping they will give up

I daresay a percentage have

Particularly as you have the original advertisement you can also take your complaint to Trading Standards in your local area

Tell them its a false trade description i.e. you didn't get what was advertised

Make sure you make a claim through the County Court too

If you don't want to take my advice feel free to contact your local Trading Standards office

This advice comes from two Chief Trading Standards officers within the London area

ok, let's be clear, I have got my money back.

I was i think one of the first to. my concern is, if there are many others that wish to get refunded, and have good cases, that they get the same treatment as i did. Without having to go to the lengths i did. (turning up at aeg's head office)

So let's unite to help those who didn't get their money back yet.

I told wolfie to go back to ticketmaster, ad told him the technicality i thought he could use to get his money back (that he accepted goodwill, not compensation/ a refund) He seems to have done this successfully..

Ecnirp98, it sounds like you are doing all the right things, and so it's likely a matter of just remembering to call ticketmaster and check they have everything, They took their time getting back to me, but they did eventually.

My response to ticketmaster when they told me they were waiting for AEG was that it's not up to AEG, the law holds ticketmaster liable (sale of goods act and also price indication- resale of tickets regulation 1994) Ticketmaster have broken the law here. The Law won't care whether or not Aeg wants to give the money back. It's not their fault IMHO, but they have. And i want them to do the right thing without having to go to court.

Exactly, Ticketmaster are jointly and severally liable so they can't get out of it

Once you take out a claim at the County Court the clock starts ticking and they either have to instruct an expensive solicitor, who will tell them to settle, or they settle before it goes anywhere

As for irishwolfhound getting his money, I wil believe that when I see the cheque myself

Thanks for the advice, I emailed Ticketmaster my original complaint letter last week with a copy of the original VIP ad which was on www.3121.com at the time the tickets went on sale that linked to the ticketmaster website.

This is a fairly straight forward case, AEG and ticketmaster are bouncing between each other to try and delay the process and hope a percentage of refund claims are given up.

I will give Ticketmaster/AEG 28 days to respond as stated in my letter, then I will start county court proceedings, hopefully they will settle within 28 days as they have now started giving refunds, the precedent has been set.

Make a claim via moneyclaim online (joint claim against AEG and ticketmaster). It will cost you £35 to do this but it is added to your claim. I did this (on behalf of ny husband) as our VIP tickets were in block E2 (restricted view behind the band) and not the 'very best seats' as advertised. As a result, my husband was very pleased to get his money back. You have a very strong case if you were in the blocks behind the stage as they were restricted view and not as advertised at point of sale.

Good luck and Happy New Year to you all !!

i already got my ££ back from ticketmaster UK via my credit card 4 the sum of £239.95.
they refunded the postage n packing as well as i collected the ticket on the day from the 02 box office.
my next credit card statement prints on the 11th of jan so i will have the proof then...i have seen it refunded on the internet banking website.
i just basically sent them letters n pestered them all the time n thats the only way 2 deal with them.
as it was with ticketmaster i bought from it was them who refunded.
AEG r not responsible 4 issueing refunds although they gave 31.21 back 2 a lot of fams.
if all else fails n U r getting no joy then go n sue there ass off cause if U got a shite view after paying that big ££ then U do have a case.
its natural 4 markland 2 not believe me as n a previous post he hoped i would choke on it.
well markland the £££ i got back has been spent on xmas so easy come easy go...it was the principle of the matter n not the £££ that motiviated me n i got a free concert n 2 nights n the backstage bar 4 nowt....i went there 18 times so its the least AEG could do 4 me,,lol.
im just glad i didnt have 2 spend £££ on courts...legal fees etc.

Here's a copy of the details I put for my claim via moneyclaim online (it just fits into the 24 line limit):

Purchased 2 Prince VIP Tickets for £235 each on 14/5/07 instead of the standard £31.21 as they were described as 'very best seats in gold circle with preshow party, entertainment, complimentary bar, buffet and transfer to seats'.When tickets arrived they were in restricted view area behind band at back of stage.NO MENTION OF RESTRICTED VIEW WHEN I PURCHASED TICKETS.Contacted Ticketmaster to exchange tickets but they refused and referred complaint to AEG.Ticketmaster then released tickets in gold circle area at front of stage for £31.21.Went to concert, not as advertised for preshow party or seats!Spoke to AEG on 5/9/07 who offered replacement VIP night or refund within 2 weeks.Requested refund as couldn't go again.Still not had refund despite calling AEG (those that have received refund were only sent £31.21 per ticket not the full amount).I want a full refund under the Sale of Goods Act as the tickets and services differed to those advertised at the point of sale.

Hope this helps anyone else that is going to claim the same way! (it worked for me, have now had a full refund)

Thats great, thanks for that Lisa.

I emailed ticketmaster again yesterday asking for confirmation they received my complaint letter via email on 22/12/07, I now have a response that the letter has been received and they are speaking with AEG. I will give them 28 days to respond or deny my claim, then I will pursue legally.

When you went through moneyclaim (website is down until 31/12/07), did you have any interaction with AEG/Ticketmaster, or was the matter just decided online and the refund issued?

Paul.

Hi Irish

Who has no problems refunding now? from what I've read here you got a refund from Ticketmaster while Lisaf appears to have been refunded through AEG.

Ticketmaster have confirmed they have received my complaint letter again on 21/12/07 (they have lost the original letter sent in September) and they are forwarding to AEG, so I await their response, if nothing in 28 days I will follow Lisaf's advice and pursue them in the claims court.

Have you heard of more people being refunded ? if so, who settled and how? I get the feeling its AEG refunding, either directly or ticketmaster.

Happy new year all !

As soon as you got your money didn't you tell the moderators the issue was resolved and to delete/lock the thread?

well..there is a handful of folx on here including myself who have now been fully refunded.
under the law its the company who sold the ticket ..ie ticketmaster UK n this case 2 fully refund as they sold tickets advertising best seats n the house....they later changed the discription after i had bought my ticket n may.
as i was seated in F2...the worst seats n the house i put all this down in my letter 2 AEG n ticketmaster n after 30 calls at least bitching 2 them they finally caved n as they knew they misled me.
its the fact i was n F2 after paying £239.95 that i was pissed off at n hence i caused a huge fuss,,,,granted i got an extra nite n the backstage bar...was 4 drinks n some food...hardly £25 if that i consumed.
when i heard of glyn n others getting there £££ back i pushed hard n won.
i advise U n others 2 pester the hell outa ticketmaster n U should get ur dosh back.
i know its a pain but when u get ur ££ back U will have a smile on ur face.
