Palin Trooper Probe Moved Up 3 Weeks

Alaska lawmakers moved up their deadline for finishing an investigation into Gov. Sarah Palin's firing of the state's public safety commissioner on Friday and warned they will issue subpoenas for witnesses next week.

The report into Public Safety Commissioner Walter Monegan's dismissal had been scheduled for October 31.

But now that Palin is the Republican nominee for vice president, lawmakers want to avoid an "October surprise" that could sway the November presidential election, the investigation's managers said.

"We are satisfied that the report can be finished by no later than October 10, 2008," state Rep. Jay Ramras, the Republican chairman of Alaska's House Judiciary Committee, said in a statement announcing the decision.

Palin is battling allegations she sacked her public safety commissioner in July because he refused to fire Trooper Mike Wooten, her sister's ex-husband. Watch Wooten tell his side of the story »

Meanwhile, investigators said they plan to issue subpoenas next Friday -- but have agreed not to subpoena Palin.

"She has told the public that she welcomes the investigation, and I have every faith that she means it," Alaska State Rep. Nancy Dahlstrom, a Republican, said in the statement.

Dahlstrom said the special counsel, Stephen Branchflower, could meet with Palin on the campaign trail or take her statement over the phone, "whatever is most convenient for her."

The governor, first elected in 2006, has denied wrongdoing and filed papers Monday in an attempt to get the investigation transferred to the state Personnel Board. Since then, seven witnesses have told the special counsel hired by the Legislature that they would not sit for depositions, the lawmakers said, and Palin's lawyer has called on lawmakers to drop the inquiry.

Those moves spurred the investigation's managers to set a September 12 hearing of the two chambers' Judiciary committees to vote on subpoenas. State Sen. Hollis French, the Democratic Senate Judiciary chairman who is leading the investigation, said a previous vote on subpoenas had been called off because everyone Branchflower contacted had agreed to sit for questioning.

But French came under fire Friday for comments a Republican lawmaker said damaged the "arm's-length, nonpolitical" nature of the investigation. Republican State Rep. John Coghill called for the state Legislative Council, which commissioned the inquiry in July, to replace French as the investigation's manager.

"He made some statements to several media outlets about this being a credibility problem," Coghill said. "He talked about this being an 'October surprise.' All those may be true, but as the manager of this unbiased investigation, I think he stepped out of bounds."

French's office had no immediate response to Coghill's call for his removal. But critics have begun to accuse Palin of trying to stall the investigation until after the November 4 presidential election.

The decision on subpoenas comes after the head of Alaska's state police union said on Thursday that Palin's aides improperly obtained her former brother-in-law's state police personnel files.

John Cyr, executive director of the Alaska Public Safety Employees Association, said the aides cited information from those records to raise complaints about the officer.

"It's apparent to us that the governor or someone on her staff had direct access to his personnel file, as well as his workers' comp file, and those are protected," Cyr said.

But a spokesman for GOP presidential candidate John McCain's campaign released documents late Thursday indicating Wooten signed a waiver during his divorce that allowed his entire personnel file to be released.

"When you're a real reformer like Sarah Palin, who isn't afraid to take on entrenched political interests, scurrilous attacks and empty allegations come with the territory," campaign spokesman Taylor Griffin said.

In an ethics complaint filed Wednesday, the union names the governor and three aides, one of whom cited Wooten's records in a tape-recorded call to a state police lieutenant in February.

Monegan, the former commissioner, said he believes his refusal to fire Wooten led to his firing. Monegan said no one directly demanded Wooten's dismissal, but the trooper was the subject of "constant" questions or comments "either verbally or in e-mail saying, 'Is this the kind of trooper that should be representing the troopers?' or 'This is not the kind that we want to have as a poster child.' "

"In the center of all of the controversy is Trooper Wooten's continued employment," the former police commissioner said. "My job was to provide passion and support to 900 people -- almost 900 people -- in the Department of Public Safety, and one of them -- which included Trooper Wooten -- was an irritant to her."

Palin said Monegan was sacked because of disagreements over the state budget. His firing is under investigation by the Alaska Legislature, but Palin's attorneys filed papers this week to request Alaska's Personnel Board take over the investigation.

In August, Palin said members of her administration had contacted people in Monegan's department more than 20 times regarding Wooten since she took office in December 2006.

"The individual inquiries taken by themselves are one thing. Many of these inquiries were completely appropriate; however, the serial nature of the contacts understandably could be perceived as some kind of pressure, presumably at my direction," she said.

But in papers requesting the inquiry be transferred to the Personnel Board, Palin's lawyer called Wooten a "rogue trooper" who threatened the governor's family during a bitter divorce and custody battle. Thomas Van Flein, the governor's attorney, said it was appropriate to complain to the head of the department about a trooper the Palins believed posed a threat to their security.

Van Flein had no immediate response to the union complaint.

Palin had been complaining to state police officials about Wooten since before she became governor. In March 2006, Wooten received a five-day suspension for drinking beer in his patrol car, illegally shooting a moose under his wife's hunting permit and using a Taser on his 10-year-old stepson "in a training capacity."

Wooten, in an interview with CNN's Drew Griffin, said he wanted to be "the best father I can be to my children" and "the best trooper I can be to the state."

"You know, I was young and I made mistakes," Wooten said. "And I was punished for those mistakes. I learned my lesson. They're behind me."

Van Flein said Wednesday the Palins were unaware any action had been taken against Wooten until after Monegan's firing.

In the February 29 call by Frank Bailey, Palin's boards and commissions director, to state police Lt. Rodney Dial, Bailey complained there had been "absolutely no action for a year on this issue." During the call, he said there was some "really funny business" about a worker's compensation claim Wooten had filed and suggested he lied about a health condition on his state police job application.

"That's extraordinary for them to reference that," Cyr said. Police application files contain results of background checks and reference letters, "and those are sealed. Even Trooper Wooten doesn't have access to those."

Also during the February conversation, Dial questioned how Bailey had obtained information that was "extremely confidential."

"I'm trying to find out how it was determined by anybody that he had indicated something on his application that later was found to be not true," he said.

Bailey replied, "I'm a little bit reluctant to say." But he added, "Over in admin is where, you know, we hold workers' comp right in there."

Efforts to contact either Bailey or his attorney on Thursday were unsuccessful.

There's definitely truth in there, I think...

This could very well serve as a positive for McCain and Palin. There are aspects of this case that rarely get mentioned that could help tilt how the public views this whole thing. But mostly, just getting it done with and out of the way does seem like a move that is designed to help Palin, and not hurt her.

Gov. Sarah Palin is being asked by a local Republican activist to release more than 1,100 e-mails she withheld from a public records request, including 40 that were copied to her husband, Todd.

Palin had claimed executive privilege for documents copied to her husband, who is not a state employee, in responding to an open records request in June made by Andree McLeod, an activist in Anchorage.

The administrative appeal filed Tuesday by McLeod's attorney, Donald C. Mitchell, argued that by copying Todd Palin on sensitive state correspondence, the governor and her aides shattered the privilege rightly afforded elected officials.

"She has allowed Todd Palin -- who has not been elected by the people of Alaska, who is not a state employee -- to entangle himself apparently as he sees fit in the operations of the executive branch of the state government," Mitchell said.

"From the case law, if government voluntarily opens up that internal decision-making to what I would call civilians, then that is waiver of that protection of the government policy decision-making process. That is what happened here, and it happened because Sarah Palin doesn't understand it," he said.


Todd Palin was frequently copied on e-mails relating to Alaska State Troopers and the union representing public safety employees, according to McLeod, who received four boxes of redacted e-mails in response to her request.

At the time, both Sarah and Todd Palin were complaining to the state public safety commissioner about a disciplinary matter involving her ex-brother-in-law, a state trooper.

Palin also routinely does government business from a Yahoo address, gov.sarah@yahoo.com, rather than from her secure official state e-mail address, according to documents already made public.

"Whoops!" Palin aide Frank Bailey wrote, after addressing an e-mail to the governor's official state address.

"Frank, This is not the Governor's personal account," a secretary reminded him.

Calls seeking response from the governor were not immediately returned.

Palin last month described McLeod as a disgruntled former employee, although in 2004 Palin endorsed her as a state House candidate "not afraid to stand up for what's right."

Mitchell's appeal, addressed to Palin in her capacity as the decision-maker on the earlier records request, questions the wisdom of the governor and her aides in shipping messages about state business between their public and private e-mail accounts "with complete and total abandon."

Her supporters and her attorney subsequently labeled the probe politically motivated and have pushed for the matter to be handled by the three-member State Personnel Board, which is appointed by the governor.

A few months ago, before she was selected as the Republican vice presidential nominee, Alaska Gov. Sarah Palin promised complete cooperation in the legislature's investigation into whether she improperly fired her public safety director.

How things have changed.

A joint legislative committee Friday voted to subpoena Palin's husband, Todd Palin, and a dozen others as part of its probe into whether the Alaska governor used her office to settle a personal score.

Lawmakers took that step because several members of Palin's administration in recent days canceled interviews with the legislature's investigator, former prosecutor Stephen Branchflower. In a statement, Palin's second in command, Lt. Gov. Sean Parnell, called the investigation a "complete farce."

"I'm disappointed by the complete hijacking of what should be a fair and objective process," Parnell said. "It is troubling to see partisan Democrats and Obama supporters abuse their power, the legal system and trust of Alaskans to smear Governor Palin to score political points."


Democrats and Republicans on the committee hotly disputed that. While one Republican sought to delay the subpoenas and another voiced opposition to them, other Republicans said the investigation should go forward.

"I do not support Sen. Obama," said Sen. Charlie Huggins, a Republican from Palin's hometown of Wasilla, who was wearing camouflage hunting pants. "I'm simply here today, with a short break in my moose hunting, to say, let's get to the facts."

At issue is whether Palin, her husband Todd or her aides acted inappropriately when governor sacked Public Safety Director Walt Monegan in July after he refused to dismiss Palin's former brother-in-law, Mike Wooten, a state trooper whom the governor said had threatened her family. The trooper has denied making such threats.

The investigative report is due Oct. 10 — well in time to become grist for the presidential campaign.

Unlike her subordinates, Palin has not called the investigation unfair.

In an interview with ABC New broadcast Friday, Palin said, "There's nothing to hide. Commissioner Monegan has said, 'The governor never asked me to fire him, the governor's husband never asked me to fire him,' and we never did. I never pressured him to hire or fire anybody."

Branchflower said he wants to speak to the governor, but lawmakers said Republicans could not agree to subpoena her.

In the ABC interview, she did not say whether she would be willing to speak with the investigator.

In a reflection of how the case has assumed national significance, the committee room in a downtown office building was packed with reporters and television cameras.

Sen. Gene Therriault, a Republican on the joint committee who voted against the subpoenas, said: "To the general public in Alaska, the view has gone up that this investigation has taken on an increasing political flavor, and it's unsettling to them," he said.

Branchflower sat in the witness chair and told lawmakers he needed the subpoenas because several state officials had canceled sworn interviews with him in recent days on the advice of the assistant attorney general, who works for a Palin appointee.

In a letter released Thursday, the Assistant Attorney General, Michael Barhill, said he would go to court to block the subpoenas.

In addition to taking testimony, the committee voted to demand the cellphone records of Frank Bailey, a Palin aide who was placed on leave last month. Bailey was recorded discussing personal information about Wooten, raising questions of how he knew those details.

Todd Palin, Branchflower said, is a "central figure," in the case because he had met with administration officials and criticized Wooten. "The first gentleman," as Branchflower called him, was not satisfied with the five-day suspension given Wooten in 2006 for misconduct that included using a taser on his 10-year-old son, shooting a female moose, and driving his patrol car after drinking alcohol. Wooten denies drinking and driving but admits the other allegations, saying his son asked to be tased and wasn't injured.

Branchflower said he needed subpoenas to interview several Palin aides who had been in meetings about the matter. And in one case, he said, he needed to compel the interview of a state contractor whom he said may have lied to him.

Murlene Wilkes owns Harbor Adjusting Services in Anchorage, which has a contract with the state to process workers' compensation claims, Branchflower said. She told him the governor's office did not pressure her to deny a claim for Wooten, he said. But in August, one of her employees called a tip line and claimed there indeed was such pressure, Branchflower said.

"I remember at some point in the conversation she had mentioned or said something to the effect that either the governor or the governor's office wanted this claim denied," Branchflower quoted the tipster as saying. "I don't care if it's the president who wants this claim denied, I'm not going to deny it unless I have the medical evidence to do that."

Wilkes may have had a financial incentive to cover up, Branchflower said. Wilkes did not respond to a voicemail left at her office Friday afternoon.

Therriault said he believes the Palin administration will "ignore" the subpoenas, setting up what he called "a branch versus branch smack down."

After the hearing, Rep. Bob Roses, a Republican who voted against Palin's signature oil and natural gas proposals, said he doesn't believe the investigation will effect the presidential campaign.

"The main question is, did she lie or didn't she?" he said.

But even if the investigation uncovers evidence that Palin did fire Monegan because he refused to take further action against Wooten, he said, "So what? This is much ado about nothing. She can fire her public safety commissioner for any reason. He's a political appointee."

Five state Republican lawmakers want a judge to stop an investigation into Alaska Gov. Sarah Palin's firing of a public safety commissioner.

A bipartisan oversight committee had unanimously approved an inquiry into whether Palin, now the Republican vice presidential nominee, dismissed the commissioner because he wouldn't fire her ex-brother-in-law, a state trooper.

In Anchorage Superior Court on Tuesday, three state representatives and two state senators sued to stop the investigation. Palin had said months ago that she welcomed the inquiry. The lawsuit called the investigation "unlawful, biased, partial and partisan."

Mike Wooten is someone who SHOULD NOT have a badge!

But either way, it sounds like Palin and her administration were trying to settle a personal score using the office of governor, and THAT is wrong. And now she's crying Executive Privilege (which is a bunch of bullshit in the first place) and she hasn't even gotten the office of VP yet! What gall!

I'm seriously thinking about voting for Obama if for no other reason than to stop this woman from getting anywhere NEAR the White House. confused
