Jury Instructions Read In Michael Jackson Wrongful Death Suit

LOS ANGELES (CBSLA.com) — A judge issued jury instructions Monday in the wrongful death lawsuit filed by the family of the late Michael Jackson against entertainment promoter AEG Live.

Los Angeles Superior Court Judge Yvette Palazuelos read the 64-page instructions to the jurors, who will be tasked with reaching a verdict in the high-profile suit.

Michael Jackson’s mother, Katherine Jackson, alleges the concert giant was negligent in hiring and supervising Dr. Conrad Murray to care for the singer as he prepared for his ill-fated “This Is It” comeback tour.

Jackson died in 2009 after receiving a fatal dose of the anesthetic propofol from the doctor. Murray was later convicted of involuntary manslaughter.

AEG denies any wrongdoing and maintains Murray was brought on at Jackson’s request.

The first question jurors must answer is whether AEG Live hired Murray. If the jury’s answer is no, the case is over and the Jackson family loses.

If jurors determine that AEG did hire Murray, or if they decide AEG and Michael Jackson both hired the former doctor, the jury will go on to decide the question of negligence.

According to the jury instructions, jurors can determine that both parties were negligent in contributing to Jackson’s death.

“A person’s negligence may combine with another factor to cause harm,” the jury instructions read.

The document goes on to say “AEG Live cannot avoid responsibility just because some other person, condition or event was also a substantial factor in causing plaintiffs’ harm.”

If the jury decides both Michael Jackson and AEG were negligent, they will then be asked to determine the percentage of negligence for each party.

“The jury for example could find that AEG is 75 percent at fault and that Michael Jackson was 25 percent at fault,” said Kevin Boyle, an attorney for the Jackson family. “In that case what would happen is that the verdict amount would be reduced by 25 percent.”

AEG Live lead attorney Marvin Putnam told CBS2′s Randy Paige he does not believe the jury will be asked to make that determination.

“I believe they never get there,” said Putnam. “Because they have to have found other things before they get to that point. In other words, they have to find that we hired him. They have to find that we hired him negligently. They have to find that we were to blame for his death. But despite all that he also had some blame.”

Attorneys for both sides will begin closing arguments Tuesday morning. They are expected to last for three days before the case goes to the jury.

New documentary to showcase Michael Jackson’s final photo shoots! » DamienShields.com

A brand new documentary showcasing the King of Pop’s final photo shoots is set to be released in the U.S. at some stage before February 2014; and possibly even earlier on the international market.

“‘Michael: The Last Photo Shoots’ is a fascinating behind the scenes look at Michael Jackson’s last magazine cover photo shoots and the struggle to make them happen,” says the Noval Williams Films press release.

“It is a unique story told through the eyes of several of Michael’s closest friends, photographers and stylists that had helped Michael prepare for his planned comeback.”

The photo shoots took place in New York in September 2007 – one for L’Uomo Vogue; the other for Ebony/Jet magazine.

“Michael wanted to be photographed in an artistic setting and the Brooklyn Museum gladly accommodated us all,” tells Harriette Cole - Ebony/Jet magazine’s editor in chief. “We shot in the midst of ancient and contemporary history, and it was powerful to be in that space.”

“We worked with celebrity fashion stylist Phillip Bloch to develop concepts for wardrobe and then he and his team went shopping. We really wanted him to look elegant and timeless on the cover. We found a number of looks that would achieve that and presented them to Michael. He ultimately chose what he would be happy to wear, which turned out to be far more outfits than we had time to shoot.”

“Michael Jackson was the perfect fit for everything we put on him,” added Cole. “He’s got the body that any woman or man would die for! At 49 years old, he’s got a slim dancer’s body … It was a lot of fun to work with someone who looks great in clothes, who knows how to move his body and who understands the camera. It was magic!”

‘Michael: The Last Photo Shoots’ delves deep into the archives of never-before-seen footage of Jackson having his make-up done, interacting with the crew, striking poses and even dancing on set.

“For a man nearly 50, he was still incredibly limber,” said Ebony/Jet Magazine’s Bryan Monroe of Jackson. ”He showed of a few of his classic moves during the photo shoot – the leg twist/kick move in particular … He’s still got it.”

“What I loved the most about working with Michael Jackson is how kind he was to everyone,” recalls Cole. “He was gracious to the elevator operator, the guard and the executives in the museum. He made sure to thank each person who was in ear shot when the shoot was over. He was generous and kind. Did some people feel intimidated by him? I don’t know if that’s the right word. More, I think some people were mesmerized. Some were pinching themselves wondering if they actually were in the presence of the King of Pop.”

UPDATE: I received the following statement from Craig Williams – writer and director of ‘Michael: The Last Photo Shoots’:

“As for the release; we expect the US initial TV broadcast to be before February 2014. As for foreign territories, it could be released sooner as we are already entertaining offers. As for pay-per-view and DVD; Since we are producing a series of 3 positive and informative documentaries (at least), it would make most sense for us to do a DVD release once we have finished the 3rd in the first quarter of 2014″

As much as I would like to see those tracks named and shamed once and for all, in the greater scheme of things there are more important things threatening his legacy right now, such as the BS claims of Wade Robson.

During Dubai’s music week Quincy Jones, Bruce Swedien and Rod Temperton recalled their memories of working with Michael.

Quincy Jones:

“I was working on the soundtrack to Sidney Lumet’s film ‘The Wiz,’” the producer Quincy Jones recalled. “Michael was there and he said: ‘I got a deal to record a solo album, will you help me find a producer?’ I told him: ‘Michael, I don’t know what you are talking about because I only have one song for this film. I have to work on this first.’”

While recording the soundtrack, Jones first experienced Michael’s trademark determination; the then 20-year-old memorising all the soundtrack’s lyrics and associated dance steps.

“I knew we had to work together,” Jones said. “The record label said no to us working together because they said ‘Quincy was too jazzy’. We went on to record ‘Off the Wall’ and that became the highest-selling black record of all time at that period.”

Rod Temperton On Michael’s singing style:

“He always sat on top of the beat and really pushed it along and gave it a lot of melody,” described the British songwriter Rod Temperton, responsible for penning classic tunes including ‘Rock with You,’ ‘Off the Wall’ and ‘Thriller.’ “Writing for him, I knew he loved songs with a strong melody with a lot of short notes in it. The other thing I noticed about Michael is that he loved a lot of vocal harmonies on the song, so that was something I included. I always tried to make the words melt into the melody.”

Bruce Swedien On Acusonic Recording:

“Some people thought that it was an actual device and one guy from Japan wanted to buy it,” said the assistant producer Bruce Swedien about the famed Acusonic Recording Process used to record the albums. “It actually means accurate sonic recording, which is what Quincy and I do all the time.”

Swedien says he incorporated a lot of sonic techniques to give the three albums a cutting-edge feel: “Sometimes I would have Michael sing close to the mic and double [track] it and then tell him to move back further and the third time even further. What that does is create a sonic energy with the sound and then you can stagger it, making the sounds come from the left [speaker], the right and the middle. When it all combines together on the record, it just sounds magical.”

‘Thriller’ was called ‘Starlight’

The aim with ‘Thriller’ was to be Michael’s “mature” album: “The transition from ‘Off the Wall’ to ‘Thriller’ was to say that he has moved from being a youth to man,” Jones said.

This explained the adult themes in the lyrics and the more aggressive sounds. After completing the melodies, it took a while for Temperton to come up with the appropriate lyrics to match the song’s drama. “I never write lyrics until the very end,” Temperton said. “So ‘Thriller’ was actually called ‘Starlight’ and that was just some rubbish word I put down to demonstrate to Michael how the melody went. Then during breakfast the next morning, the word shot into my head. It was like electricity and immediately I started thinking of the lyrics. That’s how ‘Thriller’ came to be.”

Michael the songwriter

When it came to the last of their collaborations, ‘Bad,’ Jones pushed Michael to take the songwriting reigns. “He wrote two and half [songs] in ‘Off the Wall,’ four in ‘Thriller.’ And when it came to ‘Bad,’ I told him it’s time to go against all the publicity and walk into the eye of the fire and tell the truth about everything.

“He eventually wrote nine songs for ‘Bad.’ The album had five No 1 records.”

Michael’s legacy

“There was no one like him,” Jones said. “He focused on everything he did and he would never give up. I have never seen anyone like him.”

Temperton believes Michael’s personality was largely responsible for the magic on the albums. “All the inspiration was driven by Michael,” said Temperton. “He was a very quiet man off the stage but once that tape rolls, you realise no one has that electric energy that he had.”

The Jackson family just LOST their bid to hold AEG Live accountable for Michael Jackson's death.

The jury ruled AEG Live did hire Conrad Murray. That's huge. The jury then ruled Conrad Murray was NOT unfit or incompetent to treat MJ. Katherine and the kids lose.

So here's the thing. The question that ruined Katherine's case was whether Murray was competent to handle Jackson when he was hired, and the jury said he was. Ironically, a jury in the criminal case ruled Murray then went off the rails and did things that ultimately killed MJ. But because he was competent at the outset -- the Jackson family lost.

My Money's On

Katherine Jackson and Michael's 3 kids were suing AEG, claiming the company negligently hired and supervised Dr. Conrad Murray and pushed MJ way beyond the limits for his "This Is It" tour.

AEG claimed Michael hired Murray and what went on between them was a secret to all ... including AEG.

The verdict is exactly what it should have been. The jury made the only possible call. MJ was not well, and made a lot of really bad choices...as people who are addicted to drugs often do.

4:34PM PDT: The jury foreman just explained the logic behind the verdict. They felt Murray was competent to do the job for which he was hired -- to be a good general practitioner. Jurors felt Murray had gone to a good school and was qualified. The juror added, "That doesn't mean we felt he was ethical. Had that question been in there, it could have been a different outcome.

Katherine Jackson has a rather tortured analysis of the jury verdict -- she seems to be saying even if she didn't get any money, she still kinda won.

Katherine says, "We have said from the beginning that this case was a search for the truth. We found the truth. AEG hired Dr. Conrad Murray, the man who is in jail for killing Michael Jackson."

She's right to this extent ... the jury did say AEG Live hired Murray. In fact Katherine scoffs at AEG, saying, "AEG has denied for years, and continues to deny, that they hired Dr. Conrad Murray. The jury found unanimously that AEG hired Dr. Murray."

But then the jury delivered a knockout punch to the Jackson lawsuit, by deciding essentially that when AEG Live hired Murray, they had no reason to believe he was an incompetent general practitioner ... which was the whole point of bringing a doctor on board in the first place. Therefore, AEG was not negligent.

Katherine is pissed, saying, "AEG has repeated the mantra that this lawsuit was a shakedown. Such a statement is a slap in the face of the entire judicial system that allowed this case to go to a jury."

Katherine and her lawyer, Perry Sanders, say "All options regarding the balance of the jury verdict (the ruling there was no negligence) are being considered."
