Will.I.Am cleared "Not Just Knee Deep" on a 2006 song for Kelis "What's That Right Here". He samples often and always clears them, so I wouldn't be surprised if someone else did the remix of Shut Up or something.

Someone probably rushed it out and didn't think no one would notice. Too bad. lol

Well the writing credit on a remix doesn't change, but you still have to clear the sample.

Here's how Bill used it on Kelis: http://www.youtube.com/wa..._U#t=2m58s

sad Did George not get paid by any of these artists for sampling his music and borrowing **cough** stealing his lyrics?

George Clinton's Atomic Dog is the most often used P-Funk sample of all times. He may had gotten paid as a songwriter, but almost never as a publishing rights owner. And lets not forget about the issue of master recordings.

I've been trying to tell people that Elephunk was an album that is still worth buying. Even with the addition of Fergie, there was still some balance left.

According to the complaint, Clinton became aware of the Black Eyed Peas' use of his old song when a record producer for the band came to him in 1999 and requested a license for a new remix of "Shut Up."

Clinton says he rejected the request, not knowing at the time that his song had already been sampled by the band in a prior version. He says the sample was used by the Peas anyway on the album The E.N.D, which was nominated in 2009 for a an album of the year Grammy.

The timeline on this is really confusing. Was the remix to 2003's Shut Up actually the 1999 original? If so, how is Fergie on it?

What song from 2009's The E.N.D uses "Knee Deep"?

I worked in an HMV the summer this album came out, and I got awfully sick of it. It sorta ruined Beyonce's debut for me too! sad

I'd be surprised if he DIDN'T pay royalties already. Wasn't Prince trying to get George Clinton a paycheck at the time?

From The Motherpage:

An artist can use a sample getting a license, which is free. Then, the Clinton camp gets paid based on however much you might make from the sample.

Yep...I stand corrected....Mong's right. I seem to remember them giving up the early ambitions for royalties from these (seemed dumb to me....what advantge over any other tracks he ever released?...esp being hardly their best work on these songs)..but he hung in there & didn't reap much reward apparently.

An experiment in IP that failed (the concept of releasing "sample discs" with largely the same licensure & payout headaches as any other sample).

Well, he was right wbout them not being public domain (an idea that was bandied about in the mid-90's).

It's still the same problem... and still the same debate. What should be free?..and how to fairly compensate the artist?

Giving up on licencing fees but NOT royalties added little to the historical debate..and here we are with lawsuits.

Even if the current system IS fair, you'll always have those who fail to pay...and would STILL have lawsuits.

Samples are a mess. I think I'd stay away from 'em if I were a major market player.
