Michael Jackson sues auction house for sale plans

LOS ANGELES (AP) - Michael Jackson has filed a lawsuit to try to stop the scheduled auction of thousands of his personal possessions.
The King of Pop's company, MJJ Productions, filed a lawsuit in Los Angeles Superior Court on Wednesday against Julien's Auction House. It claims founder Darren Julien promised to send Jackson an inventory of sale items, but that the singer hasn't given permission to move them all.

The suit claims many of the items are "priceless and irreplaceable" and describes the attempt to sell them as "malicious, fraudulent, extreme, outrageous and without any legal justification whatsoever."

Julien was out of the country Wednesday and did not immediately respond to an e-mail and phone call seeking comment.

Turns out someone may be trying to sell the glove right out from under Michael Jackson.

One of the potentially comebacking King of Pop's companies has filed a lawsuit against Julien's Auction House, saying that the West Hollywood outfit is not authorized to sell off a treasure trove of Jackson memorabilia in a five-day bidding spree scheduled for next month. (View the lawsuit.)

Per the auctioneer's website, the "Once in a Lifetime Auction," to take place online and at the Beverly Hilton, is set for April 22-25, while looky-loos are free to take a peek at the items, which include Jackson's iconic glove, the gates to Neverland Ranch and a robotic head from Moonwalker, starting April 14.

Jackson's complaint, filed Wednesday in Los Angeles Superior Court, claims that Julien's has "effectively stolen Michael Jackson's personal property" and has refused to return any of it "despite repeated demands."

The goods were removed from Neverland after Jackson's estate underwent a "financial reorganization," and while Jackson's rep, Dr. Tohme Tohme, arranged for the auction house to pick up the items, he informed CEO Darren Julien that the Thriller artist would have to sign off on the inventory himself before anything was sold.

Julien assured Tohme that Jackson would be consulted before they proceeded with an auction, according to the suit.

Julien presented Jackson with a consignment form to authorize the sale in August, but Jackson never signed.

MMJ Productions is seeking damages and the immediate return of all of Jackson's doodads.

Julien is traveling out of the country and could not be reached for comment. In the meantime, the auction website is peddling a five-volume catalog, signed and numbered by Jackson himself, for $500.

confused This is just so odd. The catalog of items has already been printed up and the details of the auction items has been widely reported in the press for weeks. Why now all of a sudden does Michael not wanna go thru with the auction? All this time I thought Michael had authorized this--you would think that all this stuff would've been sorted out a long time ago before it got to this point.

In December, Julien's company announced it would administer a five-day auction in April featuring more than 2,000 of Jackson's personal items, including his American Music Award for "Thriller," a velvet cape given to him by his children for Father's Day in 1998, a pair of rhinestone-trimmed socks from 1981 and a basketball signed by Michael Jordan.

Platinum and gold records, a customized Harley Davidson, a Rolls Royce limousine and his own original artwork were also set for sale, according to the original announcement.

MJJ Productions authorized the auction house to remove the items from Jackson's Neverland Ranch, according to court documents, but not to sell them without Jackson's permission.

"There was no other intention when we picked up the items" but to put them up for sale, Julien said. He said that Jackson's camp had since requested some items be returned, which the firm honored.

"Up until two days ago we were working with his managers," including final details such as a date for the catalog to be ready and signed, he added.

Julien, who is in Ireland on a promotional trip and had not been served with the lawsuit, said he would be getting in touch with the Jackson camp before deciding what to do next.

The array of curiosities to go under the hammer include Jackson's iconic white-jeweled glove, a golf cart with Peter Pan-emblazoned cushions, the razor-hands Johnny Depp sported in the movie Edward Scissorhands, a basketball signed by Michael Jordan, MTV Award and Grammy nomination certificates, concert costumes, fabulous furniture, sculpture, fine art, and, not least, the grandiose entrance gates to his infamous Neverland Ranch.

Part of the proceeds will benefit the MusiCares founded by the National Academy of Recording Arts and Sciences of the United States.

As the "Thriller" singer is said to be in debt to the tune of over US$300 million, there is speculation that the sell-off is part of a plan to pay back his creditors. But Darren Julien said that it was not a forced sale, and the reclusive megastar just wanted to move on.


"When he closed down Neverland, he did not want to put everything in storage," Julien said, "It took him more than 30 years to collect all these items." he added.

After his acquittal of child molestation charges in June 2005, Michael Jackson never returned to his Neverland Ranch; in a Fox News interview the star said he no longer saw the place as "home." The 2800-acre California ranch, including a theme park and a zoo, was once used to give special treats to young children, the ill and the disabled. But prosecutors accused Jackson of carrying out child molestations there, and meticulous police searches of the ranch included cutting the mattress on Jackson's bed into pieces.

"He hasn't been there since the trial," Jackson's elder sister La Toya, 52, told The Sun in January, "He says he never wants to see it again. He doesn't want to be there. The memories are so awful."


On November 11, 2008 Jackson transferred the Neverland title deeds to Sycamore Valley Ranch Company LLC, a joint venture between Jackson, and an affiliate of Colony Capital LLC run by billionaire Thomas Barrack Junior. According to a story in the Wall Street Journal last June, Colony executives "consider the residence completely toxic to Jackson's image, and are urging him to restore the property's original name, Sycamore Canyon Ranch, and to sell it as quickly as possible". This stark assessment may have prompted Jackson to green light the auction.


"I don't think that he will be giving us any other items after this auction," Julien said, but the veteran auctioneer is confident that Jackson "will come to view the exhibition."


"But it is not likely that he will come to the auction," he added, "However, with Michael Jackson, you never know."


Michael Jackson is living in a lavish mansion in the swanky Bel Air district of Los Angeles, his spokesman said. Even though there is no sign of new album from the "King of Pop", rumors have appeared in the British press that the singer is in final talks on a £150 million deal to stage 30 concerts at the vast O2 arena in London from July.
