Remy Ma Files For An Appeal Link November 21, 2008 Remy Ma’s legal team has filed for an appeal on her eight-year prison sentence. Remy (real name Reminisce Smith) was convicted March 2008 of illegal weapon possession, assault, and attempted coercion following a violent argument with Makeda Barnes-Joseph, a former friend of the rapper. Remy was sentenced in May. Remy’s lawyers claim the trial left a trail of errors on the judge’s part. No further details of what those errors were, have been disclosed. The lawyers hope to have the rapper out in time for Christmas. "THE TRIAL COURT'S ORDER FORBIDDING DEFENSE COUNSEL FROM ARGUING DURING SUMMATION THAT MAKEDA JOSEPH WAS SHOT DURING A STRUGGLE FOR THE GUN DENIED MS. SMITH A FAIR TRIAL," a document reads. "MS. SMITH WAS UNFAIRLY PREJUDICED BY THE INCLUSION IN THE INDICTMENT OF THE COUNTS REGARDING THE VIOLENT GANG ASSAULT AT THE PLAYER'S CLUB, AS TO WHICH THERE WAS NO EVIDENCE OF HER COMPLICITY, BUT WHICH LIKELY COLORED THE JURY'S CONSIDERATION OF THE REMAINING COUNTS." In addition to claims of bias during the case, her attorney would like her possession of a weapon charge dropped. "THE GUN POSSESSION CHARGE MUST BE DISMISSED BECAUSE PENAL LAW 265.03 UNQUALIFIEDLY BANS THE POSSESSION OF HANDGUNS OUTSIDE THE HOME," it reads. "OR PLACE OF BUSINESS AND IS THEREFORE UNCONSTITUTIONAL." Remy, who called the shooting an “accident,” is currently serving time at the Bedford Hills Correctional Facility for Women in New York. | |
