you're mixing up WHY prince is counter-suing with his legal argument FOR the counter-action. Prince is arguing that the taking of the photo infringed copyright and trademark laws which we all know is complete bollocks. I have plenty of reasons to WANT to take legal actions against people but that doesn't mean I have a legal argument that stands up in court.

What you're saying is that becuase of what the kid has argues, Prince has a legal right to sue him for anything he pleases ??

By the way, Naomi Campbell's argument was completely different as she was arguing about privacy and the fact that she was leaving a clinic. Prince could hardly argue that being seen in an airport infringed his privacy as he didn't want the fact he uses airlines known publicly.

Do you realize that in the eyes of the law it is assault if his bodygaurded touched him or anything he was holding onto? So as soon as he grabbed the camera it was automatically assault. The kid has never claimed that he was beat up. You should go back and read the original inerviews with the kid and the attorney.

Your 2nd statement is just putting words into my mouth though cos of my mix-up , I thought Prince was countersuing because he allegedly instruced the bodyguard to assault the guy ,I was wrong . No I dont think Prince can sue the guy for anything he pleases , but I never said that anyway .

As for the other comment about "Going back and reading the interviews with the lawyers" , sorry,I've much much better things to spend my time with , I've only got a passing interest in ths , but seeing as AGAIN its become a huuuuge thread thought I'd see what was happening,Prince does like to make some bad PR decisions doesnt he .

Actually, it's battery. Battery is touching. Assault is apprehension.

But anyway, you guys do realize that if Prince is sued and papers are filed, he HAS to answer them or the other party automatically wins the case after a certain time. He can't just say "oh, my bad-let's see how this turns out." He either HAS to say-"I did all of it," or "I didn't do it for these reasons, and even if I did I had an excuse because....." The claims of copyright infringement, etc. are just counterclaims. I am sure that Prince is also raising some defenses such as saying that he instructed his body guard to refrain from "battering" people in the airport, and that by acting thusly, the bodyguard was NOT acting within the scope of his employment and Prince is not vicariously liable for the actions of the bodyguard. His lawyer is just trying to hit the kid with everything he's got to get this suit settled. That's what 99% of defendants, and ALL lawyers do.

Just playing it from the other side.

Yes, you are right, he could say, no I didn't do it and that's it, BUT I don't know one lawyer that wouldn't advise a counterclaim if one was at all possible. Not one. It's general practice to pile them on. Don't get me wrong, I don't think the kid's camera should never have been taken,, but once the bodyguard grabbed it you had a battery. Even if Prince had given it back right then, there would still be a battery, and I bet there would have still been a lawsuit. Rich and famous types always get sued and they sue back. It's just par for the course.

None of us knows the whole story. There are always 3 sides to every sorry. In this case Prince side, the student and the truth. I think it is obvious that he is counter-suing to get this kid to drop the case. I don't think Prince is going to pay $50,000.00 for a digital camera.

Forget about whether the kid is wrong for trying to take a picture of Prince, or whether Prince's bodygaurd was wrong---The picture here is the only real wrong committed. Mostly because they are in love with the sound of their own voices. Maybe that's Prince in a nutshell. Just one of those excruciatingly boring, always-right types. It's dull, dull, dull. You can hear that on the collection of non-songs on Musicology. Here's a guy with a world-class drummer and yet he uses a PLAYED-THE-FUCK-OUT drum sampler. We ain't got to give up on shit and I don't think he's worried about shit you got to say because drum sampler or not, that's why he ranks at the top of the summer concerts and his tour his doing quite well. You can hate all you want.
You want to talk about boring, that's why Britney Spears won't be able to finish her tour. Prince was in a public airport, therefore, he has no privacy whilst there. That's all there is to it.

He acted like a typical spoilt celebrity brat.

Is he going to sue the airport for all the times he appeared on CCTV during the time he was there?

Prince may make fantastic music, but he acts like a total fuckwit in situations like this. I'd love to see this kid win his case and make a total fool of Prince and his people.

I hope the kid don't get shit! I've said this before I am a Prince fan just like the rest of you and I don't have everything good to say about him, but I defend him on this. Just because you are fan don't give you the right to take pictures unless you are at a distance where you aren't coming up too close. Plus I don't believe the kid was beat up or that he's loosing sleep. If this kid got beat up a roughed up. Let's see a videotape of it. I'm sure the airport has video cameras everywhere in case stuff like this happens.

I'd like to see Prince make a total fool out of this kid and keep remaining the untouchable. If it was really bad, I wouldn't defend him, but people think that if they see a celeb they have a right to invade their privacy and NO you dont.
and he can keep shaking his ass with Beyonce or anybody else on tv if he wants too.
