A sound recording covered by copyright is being used. That's the issue.
This track's just been released and will earn hardly anything. It wouldn't be worth the Estate's time and costs to pursue it. | |

He sampled Prince's actual performance. It's a recorded piece of music owned by the Prince estate and protected by copyright.

Initially I was thinking the same, but did you listen all to way when the man starts singing? Same melody, here and there same lyrics, same harmony and similar singing style. That's a bit naughtier than just using some chords or even a sample
Prince wouldn't have liked that. Whether the estate likes it or not, I don't really give a care about. But they have the law on their side ...
