The family of the late musician Prince, who died of a fentanyl overdose in 2016, is suing a doctor who the family says failed to treat his addiction and provided him with narcotics without a proper prescription, ABC News has learned.


The lawsuit, which was filed in Minnesota district court Friday morning, alleges that Dr. Michael T. Schulenberg, the Twin Cities physician who treated Prince twice in the days prior to his death, failed to properly treat the musician as he was suffering from an opioid addiction.





He failed to appropriately evaluate, diagnose, treat and counsel Prince for his recognizable opioid addiction, and further failed to take appropriate and reasonable steps to prevent the foreseeably fatal result of that addiction,” reads the lawsuit, a copy of which can be read below. “These departures from the standard of acceptable medical practice had a substantial part in bringing about Prince’s death.”



According to John Goetz, the attorney who is representing Prince’s family in its ongoing suit against the Illinois hospital that treated Prince days prior to his death, the lawsuit brings the fight for accountability back to the musician’s home state.


“Prince lived in Minnesota all his life and passed away here,” Goetz told ABC News. “So we always thought his family's lawsuit belonged in Minnesota.”



According to Goetz, the family intends to eventually dismiss the previous lawsuit filed in Illinois against the hospital, and proceed with this new action in Minnesota, which could itself eventually be expanded to include other parties.


“The Minnesota lawsuit is against all parties whom we now believe share legal responsibility for Prince's death,” Goetz said. “But it is possible that we will identify and add other parties as we move forward with the case.”




So Prince asked for help from Dr. S. And he didn’t provide it? I mean you can’t force treatment on someone. The current Administration wants the death penalty for fentanyl dealers. Good.

It sounds like they do recognize that he had an addiction, which is appropriate given that the evidence from Carver County’s investigation into Prince’s death makes it clear that he had a serious addiction to opioid painkillers.

Or perhaps, plead the 5th?

I thought the family was only looking to sue healthcare providers who "failed to assist" Prince, not Kirk/Phaedra? Again, deep pockets?

He did not go on the last NPG tour overseas and is not in the latest band photos.
Personal injury attorneys usually take 1/3 of any judgment. They have no interest in garnishing wages. They are looking for deep pockets. Something happened to cause them to dismiss the lawsuit against the hospital in Moline, and now go after Dr S.

Sounds like a bunch of messy mess, if they just dropped the lawsuit of the hospital then they had not real reason to go there in the first place, which means they can just as easily do not have a real reason to go after the doctor. Grasping at straws?

I was trying to be silly about the garnishing of Kirk J. I understand the deep pocket logic, not to mention, I am sure Dr. S has malpractice insurance.

He did. He got pills illegally from the Dr and gave them to Prince. He had the Drs. write the scripts in his name. Correct?

He did. He got pills illegally from the Dr and gave them to Prince. He had the Drs. write the scripts in his name. Correct?

That is what I thought. Dr. S was fined for doing this, $30k. Or was I wrong?

It's illegal to give your prescription meds to somebody else. Kirk got them in his name and gave them to Prince to take.

It's illegal to give your prescription meds to somebody else. Kirk got them in his name and gave them to Prince to take.


But people do it. I remember when my mom was having some shoulder/neck pain that wasn’t going away. My brother-in-law gave her a bottle of Vicodin he had left over from after a surgery he had. She took one and got so sick off of it she threw the rest away. Not exactly the same situation but I’ll bet it’s common.

I thought that Kirk worked for many years, even up to the time of Prince's passing, for the Lifetime Fitness that was located near Paisley. When did that association end? It was my understanding that Kirk's employment at Lifetime Fitness was why they (Paisley Park) would use Lifetime's parking lot for large events at PP when lots of parking was needed and they'd utilize a shuttle bus between PP and Lifetime, and that the plane Prince was on that night it landed in Moline was actually owned by Lifetime Fitness (or one of that Lifetime Fitness' franchise owners or something). At any rate, it ws my understanding that Kirk was very involved with that Lifetime gym and worked there for quite awhile and while he was also employed by Prince.
