A friend of mine told me that if the audio was broadcast on the radio it can be sold....but I am not sure but he said: "that is why they are all over Amazon."

Even if it’s illegal, they’re too busy squabbling and flogging T shirts.

Colour me cynical but I’m starting to think that the only Audio and Visual we’ll ever get will be either ill conceived Warner releases or what’s on offer from the bootleggers.

*Take that all as hyperbole born of frustration before anyone gets thier knickers in a twist.

Those live releases that are taken from broadcasts are bootlegs but they are legal because of some loophole regarding broadcasts of live recordings from deceased artists. They may be legal but I recommend all fans treat them as bootlegs and trade free copies instead of supporting these sketchy labels.

I don't think the estate can do anything about these. Lots of releases of many artists fall under this loophole. If they could be stopped someone would have done it by now.

The estate should focus on bootlegs that are not "legal". There are plenty of bootlegs and pirate copies being sold on Amazon, Ebay, etc. for them to deal with.

After looking closely at the European loophole in a past thread, our undertsanding of the law was that it was a European extension of a British law that concerned things that were broadcast or aired in the UK, though possibly extending to any EU broadcast.

In any case, some of the songs on this release were never broadcats or aired on either British radio and TV or on any other EU country radio or TV (the Second Coming show wasn't even broadcast anywhere, it comes from the ConcertVault site and their YT channel, which cannot possibly fall under the loophole law since it predates the internet: theorically ConcertVault could also sue since they have a claim on that specific recording's copyright, same with the various US TV channels owning the rights to the US TV broadcasts).

This release, therefore, cannot possibly be legal or semi-legal even in the EU.

Both, because for one thing owning a TV or radio broadcast does not automatically gives you the right to release it for purchase on audio or video, it has to be contractually agreed with the artist. So even if the estate doesn't own the rights to a recording they can still oppose it being released whether by the legitimate owner or a third party.

And I suppose there's also the "brand" Prince, which is why Prince threatened to sue Pepé Willie if he kept releasing records credited to Prince instead of 94 East, and why the whole Ian Boxill thing probably couldn't have worked even if he had owned the masters. Just imagine for example Ninety-9 releasing her EP with Prince under the name "Prince" instead of "Ninety-9": even if she could get away with releasing the recordings, she probably couldn't get away with using the "brand".
