I feel the same about Phaedra. It may have not been intentional, but her immunity from liability defintely has some smoke to it. This will be interesting on how it plays out. The way Tidal is setup, from the documents, seems shady, but I can (and usually am) be wrong.

But no where do they say it is a fake document. They only question the clause concerning his image and according to Tidal that is only pertaining to his image being used to promote other streaming services which we know from Prince's own comments he would not have been promoting.
It seems to me their whole case rest on if anyone in Prince organization had the right to sign this agreement with Tidal. If they really believed it was fake why would they just not come out and say so?
Someone sent those files to Tidal after Prince died and I think it was Phaedra who had probaly already been fired from her job by Lonnie and releashing them may have been beyond the scope of her authority. I do not think for one minute that Prince worked with Tidal/Aspiro and did not receive equity or some form of payment. He promoted that service right up until the week before he passed.
Who would believe he was sending videos and music to Tidal for free? Remember Tidal is a subsidary of Aspiro. This is not some ex-rapper running a business out of his basement and being represented by the Mickey Mouse law firm.
To imply that docs are fake would meant that meaning parties are involved with a massive fruad that could easily be uncovered by the employees that worked for Prince who should have been present when this deal was put together and could certainly verfity their own signature.

Comerica has questioned the authenticity of the documents. They are also questioning the alleged Power of Attorney. That is why they are requesting the documents from Tidal that evidence a Power of Attorney. | |

This is not questioning to me "All documents and communications that evidence, refer or relate to the July 23 Power of Attorney" Seems like this is a part of the discovery. Why not just come out and say it is not real. They are looking for additional communication concerning it which should be avaliable via NPG LLC attorney, manager or Paisley Park server.
How likely do you think it is that this document is fake? I bet the estate managers wish that it is fake which would be going against what Prince wanted and should tell you the mindset.

When I read, the best to my ability, my take away was the Comerica is looking at numerous "angles" on how to argue the case. I thought Comerica's wording was done itentionally not to accuse or threaten Tidal with allegations. I took it as a tactic used by lawyers. Being sublte. With that, I would imagine, again, I am not a lawyer, that Comerica would have reached out to employees and Phaedra to get copies of their paperwork, then compare them to what Tidal provides via discovery. I am not sure if that is the norm. I was under the impression, Tidal is dragging it's feet. Again, the jargon in the documents goes over my head at times. | |

I am with you. As soon as these "claims" are dismissed and all appeals are exhausted, the heirs can focus on getting the Estate going (when it is released from probate).
The Tidal suit is another big hurdle. But a necessary endeavor if there is a violation on their behalf. | |

I am sorry either there was a POA that gave Pherdra authority to execute contracts or one has been fabricated. I just do not see how this should be difficult to prove. What I do know is that Tidal is where Prince wanted his music on Tidal and that is a matter of record. I can assume that some heirs do not want the music on Tidal because the subsciption base is smaller and the revenue will not be as much as it would if it was on other platforms however, I do not see how the heirs can break the contract because it is not what they want. If some of you think Tidal has done something sneaky like fabricated a legal document but nothing is sneaky about breaking a contract that was already in place because it is not convenient anymore you lost me. This did not work in the Quincy Jones/MJ case a few weeks ago. Not sure why anyone thinks it will work if this Tidal contract is real. Somebody sent those files to Tidal and it was not Jay-Z or Prince. Is it not logical to think that someone at NPG LLC was involved with this and knows exactly what transpired and maybe calming up for financial reasons? You already had two crooks, a bank, a law firm and two associates go out of there way to lie and committee fraudulent acts. Is it really such a stretch to expect it to continue. Cousins case is still pending. He just filed in June 2017. The attorneys that filed an appeal in regard to their attorney fees is still pending. Uh oh....I just looked and it appears the girls case has been dismissed? I dont have time to look more closely at the case until later tonight.

It's common for people to lease flight time on an aircraft that is owned or leased to another entity. Instead of owning/leasing his own plane, Prince (or anyone else with the means and contact with the fitness center, where Kirk was a ersonal trainer (?)) just books a flight if the owner/leasee isn't using it that day. It was never a PRN plane. | |

I figured it out. The Court of Appeals dismissed the girls appeal of the Judge's Orders naming the heirs. Their other appeal is still active and they had Oral Arguments on July 26, 2017. They are awaiting a written decision from the Court of Appeals. | |

It could have been an arrangement for Prince to keep his travel low-key. Kirk leased/rented the jet from the owner of the fitness center. It is a good relationship, the owner recieves money for the plane use, helping with expenses. Prince can travel in a private manner, does not have the overhead of maintaining an expensive aircraft. I think Kirk was more involved in daily affairs that is believed. He wore a lot of "hats". I do not think the plane was a shady deal. If Prince was downsizing and trying to control costs, then this was a smart move. Also, speculating, but maybe this also provided Prince more comfort in travelling than commercial air. | |
