He defaulted. He had the opportunity to come and contest the lawsuit, but instead he failed to pay his lawyers and didn't show up to defend his case. So he lost his chance to argue that the allegations of Revelations are false. His new lawyers are just trying to get the amount of damages reduced.
So Prince not being available to defend HIMSELF cost him.
I remember TRYING to buy this perfume when it came out. Its was to be sold EXCLUSIVELY in Macy's. Well Macy's only had it available is a few stores since they believed Prince's brand wouldn't generate any interest.
I tried to get the bottle in my area, the northeast USA and it wasn't available up here. I was told be an employee of Macy's that "We won't sell that cheap mess here. We prefer to sell our customers oils by designers with quality oils from France."
So the Revelation company should have sued Macy's for not promoting the product also. Half the stores I called never even wanted to sell me their "exclusive" product. After contacting six stores, I finally found the product sold in the Chicago store, they refused to ship it to me.
So I said fuck it... called the Revelation company directly, let the representative know of the many hurdles I came across at just trying to buy a bottle. He apologized but told me that the perfume would be on back order because they were currently overwhelmed with the success and demand for the product.
So if you can't buy the perfume... how are you supposed to get it? By the time the perfume became available to buy online.... I lost total interest. Prince got into business with a mickey mouse bullshit company and Macy's, a department store that has the lousiest customer service ever.
Prince is only part to blame at best... I think Macy's hands are just as dirty for not pushing its own "exclusive" product.
Why Prince did not have a rep in court for him I'll never know.
It's quite simple. He did have lawyers to represent him, but he failed to pay them, so they withdrew. Hence there was no one to represent him in court (and he didn't show up to represent himself).
If Prince had paid his initial lawyers, I'm sure they could have put up a vigorous defense to the allegations made by Revelations. But he didn't pay them. So this is really just a story about what happens if you don't pay your bills. Based upon what I have read and Princes knee jerk reaction history to almost any scenario that he's obligated to is to quit. Then it should come at no surprise that he would be sued. I recall watching a show about MTV that cited the most difficult person they worked with was Prince. The under the cherry moon promo in Wyoming almost cancelled because prince refused to proceed to meet the winner. This was in the limo on the airstrip. My only question is how the could be awarded 4 million. They would have to prove the potential dollar amount they lost. But with no previous criteria to support this (get wild was a previous perfume failure) I don't see how the judge or magistrate would rule this type of restitution.
That's why you guys need to read the report which explains in detail what evidence they presented and how they arrived at the 4m figure. It's not an arbitrary decision by any means. Prince, in you I found a kindred spirit...Rest In Paradise. |

Why Prince did not have a rep in court for him I'll never know.
According to the report the initial deal was with Macy's in Mpls. It sounds like they had plans to expand to other Macys stores as well as other retailers but the marketing plan fell apart and the other stores refused to support a venture that was doomed from the start.
The funny thing that came out in court is that the company had very limited experience with A-list celebs or top of the line fragrances. Prince basically partnered with a "drug store" perfume manufacturer known for stuff like Wind Song and such, Seems like they thought they could break into the higher end market with Prince on board, (tsk, tsk)
What makes me laugh is that even if Prince was fully on board, you would still be dealing with a very second-rate fragrance.
I remember reading that Prince chose the company based on the name "Revelations" because it sounded biblical...

It's especially ironic given Prince's penchant for using lawyers to issue cease and desist letters threatening his fans and former bandmembers and associates. Those tactics only work if you're afraid that the person making threats (i.e., Prince) could outspend you in a lawsuit. In light of what happened here, I'm not sure he's willing to put his money where his mouth is.

I remember reading that about why he chose the company.
He should have just sold it in Target, got a following of retirees for the fragrance.
Now many celeb fragrances do very well in CVS and other drugstores. Mary Kate and Ashley did great. $$$$ So did Britanny and Jlo Heck Prince should have followed the successful strategies of celebs banking millions on stinky cheap fragrances.
Gotta cast a wide net with a new fragrance if the perfume company isn't established. |

The court relied mostly on the testimony and exhibits proffered by the accountant who served as an expert witness. There was no rebuttal from the defense. [Edited 9/7/11 18:47pm] Prince, in you I found a kindred spirit...Rest In Paradise. |

[Edited 9/7/11 18:47pm] [/quote] But if there was no precedent then how could the testimony have significant magnitude for the Judge to approve such a high dollar amount? "your honor we could have made millions" just doesn't cut it. It's not like suing for a no show concert as we can look back and show the potential profit and lose. |

Google it. This perfume is for sale all over the 'net -- on Amazon, etc. In fact, the publicity from the lawsuit alone may have revved up interest in the product. Revelations could still realize signficant profits. It's possible. The judge has the final say, so let's hope he/she decides to mitigate the $4 million recommended by the arbiter. In a perfect world, P would have fought back earlier and harder, with a saner defense than the one he came up with, but that's over and done with. $4 million is a nice chunk of change, even to someone of P's means. When you don't have a case, yell RACE! |

I actually like the incense more than the fragrance. I remember the scent of the incense flowing while we were standing and waiting for the shows to start in Vegas for 3121. Awww the memories....If he still had an online retail store I would have gotten more |

Again, just read the information already posted...
The referee, Louis Crespo, awarded $3.9 million to Revelations Perfume and Cosmetics to cover expenditures it had made in reliance on Prince's commitment to promote a perfume, 3121, named for the CD.
Mr. Crespo, however, rejected Revelations' claim for an additional $3.4 million in lost profits, finding they were too "speculative." He also denied Revelations' assertion that it was entitled to punitive damages.
They were awarded actual expenditures NOT punitive damages. Prince, in you I found a kindred spirit...Rest In Paradise. |

For the life of me I still can't understand why he didn't partner with a manufacturer of quality fragrances instead of being drawn by the name Revelations. That's not a sound basis for a decision. Prince, in you I found a kindred spirit...Rest In Paradise. |
