Also now a bootleg can refer to an unofficial remix, especially remixes of two separate songs merged together.

Teen pop acts are even doing this now in the UK, so it's pretty passe - But the original bootlegs, stolen or unauthorized studio or live recordings are still great smile

it is usually a collection of words, sometimes mixed with music, played to a large or small audience of people who paid money to hear this vocal performance. Duplication is not permitted. BUT...

stores sell blank audio tapes, blank VHS tapes, blank cdr-s, VCD, etc. to what?...duplicate copywritten material.


Remember, its not illegal to own a bootleg, just to sell.


You can tape Rick Dee's top 40 onto a cassette

You can tape Friends, the Simpsons etc. each week on VHS

You can record you favorite movie off HBO, Showtime, etc.

You can record the Rolling Stones right now on HBO, and burn it to cd or VCD.


You can record it, but you can't sell it.

No it isn't. All sorts of material can be bootlegged, and in the case of words or music, the existence of an audience is irrelevant to any definition. Generally, it is the illegal creation or duplication of material. Subsequently, the material itself acquired the name 'bootleg.'

In music, the term 'bootleg' is generally applied to either a recording which has yet to be officially released by an artist, or an unauthorised recording of a live performance. Such unreleased studio recordings are copyrighted, and the copying of such material is therefore generally illegal. However, possessing a copy of the recording is generally not illegal. The term 'bootleg' is used, usually, to distinguish it from a pirate recording, which is generally an illegal copy of an authorised official recording - very often masquerading as the genuine article.

Recording a live performance is often expressly forbidden as part of the contract a concert-goer enters into. If such activity is not expressly or implicitly forbidden in the contract, it could be an offence to tape a concert under legislation (In America, it might not be breach of copyright, but such taping could be treated as an offence as if it were breach of copyright). Owning a copy of an unauthorised live recording generally may not be illegal.

All of these items are distinct from making copies of authorised released musical product (or copies thereof) which is illegal.

Officially, tapes are made and sold simply to record material. Some people copy material under copyright with permission - which is legal. Some people copy copyrighted material without permission. Generally, this is breach of copyright and illegal unless it can be copied legally using a fair defence (e.g. a small portion of a book is quoted for purposes of literary criticism). What amounts to 'fair use' in this way is the sort of thing copyright lawyers make their money on.

Of course, all of these are oversimplifications. All of the examples you have quoted appear to be breach of copyright. That doesn't mean to say they are illegal, but it will depend upon what you then do with the recording, and what the copyrightholder allows you to do.

If you record Friends onto VHS and hold on to the recording for over a certain period of time, in some countries that could be an illegal act in itself.

If you record your favourite movie on HBO and then show it as a public performance (regardless of whether you sell tickets to the performance), that could constitute an offence.

If you record the Rolling Stones and burn a copy onto VCD and then submit that in its entirety without comment as part of your thesis on 'Why Mick should retire', that could be a breach of copyright where 'fair use' would not be upheld.

In all cases, the material was not sold, but a potential offence may have still been committed.

I guess you can always pick it to pieces, state by state, or by country, or by offense, or by product, or by application. There are so many ifs, ands or buts depending on the copyright holder and the location of the potential offense. It happens everyday in every way, if its Bart Simpson on a shirt, or a fake Rolex on the street corner, a copy of Sign o the times on dvd at best buy. I was just speaking in general terms

  • A great song that you want to crank up to 10 but then it pisses you off because it's a bootleg and it really sounds like shit.
