I'd think the chances of this outcome would have been far more likely with the owners of sites that actually hosted copyrighted material. But I honestly think part of what did these guys in is the fact they have been such jerks through all of their legal dramas.
I recall occasional notices by them on the site (not that I file share ) effectively thumbing their nose at artists and record companies who unsuccessfully went after them. That sort of thing is childish and ultimately did nothing but invigorate subsequent legal efforts, when any number of other sites would have been more obvious "examples" of which to be made... at least outside of Sweden. I recall occasional notices by them on the site (not that I file share :lurking:) effectively thumbing their nose at artists and record companies who unsuccessfully went after them. That sort of thing is childish and ultimately did nothing but invigorate subsequent legal efforts, when any number of other sites would have been more obvious "examples" of which to be made... at least outside of Sweden. Technically, while it's true that they had not hosted any illegal files themselves, they did provide links to torrents to such files, at which point someone with a BitTorrent client could download that material. While I agree with them in principle about being allowed to post links to files which people want to download, and that the movie studios and record companies need to go after actual pirates in their own studios or in post-production facilities who leak copyrighted material, they did act like punks during the whole ordeal. (Not surprising since they are mostly college-age students.) I think that the conviction had as much to do with their attitude as their alleged actions. But now what happens? Are they going to go after Google for providing links to Rapidshare,.Imagevenue, and Megaupload which have the same types of files which were being shared on Pirate Bay and the other torrent tracker sites? From what I've heard about Rapidshare, they do take down illegal copyrighted material once they know about it, but it's very easy to disguise such material and split it into pieces without the copyright owners even knowing about it.

It'll be darned interesting to watch. This is certainly a landmark precedent, though I think Tremolina is correct in saying Google and Youtube, for example, are somewhat insulated from such actions. They present a very lucrative marketing function for entertainment media as much as a siphon from their profits. Meanwhile, Pirate Bay is still up and running, and they've turned even this latest development into a joke. Check out their "Press Conference" link. [Edited 4/17/09 20:07pm] Ὅσον ζῇς φαίνου

If you can't beat them...join them. http://www.pcworld.com/ar...ulu.html YouTube Adds Movies and Shows, Goes After Hulu Daniel Ionescu Apr 17, 2009 7:51 am Google took the wraps off a partnership with Hollywood studios bringing movies and TV shows to U.S. consumers via its YouTube video network. Some of the big-named partners inking a deal with YouTube are Sony, CBS, Metro-Goldwyn-Mayer, BBC, and independent film studio Lions Gate Entertainment. Each agreed to showcase some of its catalog content on the Google-owned video site. Separated from the plethora of user-generated videos, the shows and movies are situated in a dedicated Shows section on YouTube, available from the main page. The content offered will be free to view but it is supported by ads -- the revenue being shared with content owners. YouTube's move to premium content comes to counter the ever-growing popularity of sites like Hulu, which freely offer movies and TV shows for viewing. However, most of the studio movies and shows added on YouTube are more than a decade old (Fantasy Island, Alf, Party of Five), while NBC-owned Hulu offers most of the new shows just a few days after they air on TV. Google is hoping that these full-length movies and video will help YouTube salvage through advertising revenue some of the over $500 million some predict it loses yearly on bandwidth costs. Google TV Ads, also introduced yesterday, will place commercials into the ad breaks of TV programs watched online (the ads cannot be skipped). According to measurement firm Nielsen, YouTube accounts for two-thirds of all video views in the U.S., and last month the site had over 90 million visitors according to comScore. I knew from the start that I loved you with all my heart.
