Didn't know that...funny how jam and lewis used large samples of the tune for Janet Jackson. I guess they must all have liked the song. I remember a BBC interview with Jimmy jam in a series about producers going on about it...very much the style of music he listened to as a young man.

alandail said: BigDaddyHQ said: Ohh geez You can't sue anyone over a simple phrase like Purple Rain. Purple is a color... Rain is... well... rain. Thousands of songs re-use simple phrases again and again. There are only so many words in the English language. it has to be more substantial than that to even consider a case. as far as the color of the clothes. If they want to call a color Purple Rain... they can. Prince could only have a beef if he already gotten legal rights to a particular sgade of purple he called Purple Rain. And why do most of you assume these major corporations haven't already dotted their 'I's and crossed their 'T's over this stuff? It may well be Prince is receiving payment for this shade of Purple being called Purple Rain due to whatever legal wrangling was applicable. actually you can trademark a phrase. And Prince had trademarked the phrase "Purple Rain" for use on apparel among other things http://tess2.uspto.gov/bi...uq543j.2.5 If the sweater said "Purple Rain" on it, there would be a problem. I don't believe it being the name of a color will actually infringe in his trademark, but if it did, he'd certainly have to send a cease and desist letter to JC Penny to protect his trademark. Once you stop actively protecting it, you run the risk of losing it. I've learned a lot about trademark law since staring my custom t-shirt and apparel business - http://designer.inktastic.com/ - One thing I did was create a bunch of baby clothes with baby's names to draw traffic. I used the list of most popular names. Turns out people name their baby's with names like Chanel, which is trademarked for use on apparel, so we can't promote personalized clothes for baby's with that name. Thanks for the insight, that is interesting. RIP, mom. I will forever miss and love you.

Not really shopping, per se, but looking through a JC Penney magazine that I received in the mail, as I said in my originating post. I posted the web link above as proof that the "purple rain" color sweater was legit. I knew that if I didn't, people would be saying, "Where's the link to prove it?" RIP, mom. [Edited 11/14/08 5:15am] True, as someone stated above, the phrase "Purple Rain" was already used in a song. But we all know how Prince seems to be ready to sue whoever and whatever for even using something that is even remotely something that he thinks he came up with first. RIP, mom. Don't mean to sound condecending... just speaking straight forward. After the past couple of years and 2000 threads about Prince with his potential and actual legal concerns all involving Copyrights, Trademarks, etc..... I assume by now that the average Prince fan who post here should have at the very least a basic understanding about some of this stuff. Yet we'll likely get another 2000 threads with people still in the dark and sounding clueless about these things. When you start your post with the words, "Ohh geez", it comes off sounding condescending. Maybe you're not aware of it, but it does. I'm sure that I speak for others on this forum when I say that I don't have time to read each and every thread about Prince and his legal concerns regarding what he can take legal action on, and what he cannot. I have more important things to do with my time and my life than to read each and every post and to remember everything that I read. If there are so many threads about it, why let it concern you? Just skip over them and move on to another thread. Not trying to be argumentive here, just speaking straight forward, as you did in your post. RIP, mom. I will forever miss and love you.

I think that Prince has more important things to worry about than a legal battle with JC Penney over a cheap shirt. I don't know why people think he is that petty, I know he's seen worse and just laughed it off.

I disagree with this post. Prince sued that mom who had the dancing baby on Youtube, because there was a song that he wrote that was used in the video. It's not so much that we think Prince is petty so much as we think that Prince is a bit overly protective of things that he feels that he created and that people are using without his permission. That's all. [Edited 11/14/08 15:23pm] RIP, mom. I will forever miss and love you.
