Good point. In the internet world, youtube could be synonymous with the USPS.
Then again, would Youtube be the USPS, or would the internet in general be the USPS, thus making Youtube more like a third party such as Mailboxes, Etc or a caterer? | |

Now there's a doozy. Such a lawsuit would be dismissed after the Postal Service filed a motion under Rule 12 of the Federal Rules of Civil Procedure asserting that he had failed to state a claim for which relief could be granted. Until Congress makes a radical change in the law, there is no cause of action against the Postal Service based upon the fact that it accepted and delivered a mailable article that turned out to constitute pirated artistic content. Finally, my 27 years of experience as an attorney for the Postal Service comes into play on the Org! | |

U c my point tho. As much as I admire Prince 4 what he's trying 2 do, and wholeheartedly agree with him in principle. It's a case of shooting the messenger in relation 2 sites hosting files etc. Ultimately the onus is on the fans, if thats what we wanna call ourselves, as 2 whether or not we upload/download any of the material we all well n truly know we shouldnt. Public broadcasting/transmission of copyrighted materials which is in effect what embedded videos/audio files r, could really only, in my own opinion, be taken down at the request of interested parties and that should b the end of it. Most sites have mechanisms in place 2 report infringing posts as well. There's only so much they can do, and still provide a valuable service 2 the many people who utilise it in the manner in which it is intended. Problem is, as soon as theyre gone from here, they pop up there, perhaps 2fold. The argument could b that the postal service doesnt directly profit from the parcel they deliver, although postage charges may constitute a profit. Most websites/servers stipulate in their terms of service that copyrights should not b infringed, in effect covering their asses and again putting the onus on the individual. 4 owners of copyrighted materials being transmitted, it really is somewhat of a dilemma. I mean it'd b quite a task trying 2 finger every single individual involved by IP address or whatever and issuing proceedings against them. Besides it'd become quite an xpensive venture me thinks. Perhaps the simple solution is, if u don't like how the industry has evolved, get the funk out. Early retirement mightn't b so bad afterall. | |
