a sample has to be cleared with 2 parties: whoever owns the master of what is being sampled, and the person that owns the the publishing for the song (songwriting). if the "sample" is actually a re-played segment of the song, and not a real sample from the record, it only has to go through the songwriter.


so, if this is an official release, Prince had to have approved it.


also, I don't know if anyone's noticed, but ever since Prince's music publishing shifted over to Universal handling it, his songs HAVE appeared in more samples, commercials, and television shows. There was the Chevy ad with Little Red Corvette. One song was used on Eve's TV show, and there have been more samples. Not a lot, but more.

So shit like THIS can never happen.

Prince would be compensated in some way via his publishing rights (which I'm sure he still owns). I do believe that he must be given credit (although last I knew this was still a bit of a grey area).
