Ginuwine said it was because he liked the song and Prince said well just call a brother and say you like it, don't redo the song. I have to dig out that mag and quote it directly. Ownership of the masters and ownership of publishing rights are two separate things. The Chaka example wouldn't apply if she owned neither the masters nor wrote the song. So, you are probably right- A&S must have okayed it. I'm not an expert either, but would agree with the posts above that both the record company and the artist (who wrote the song and owns the publishing- not always the person known for the song) both have to agree to use of a song in a commercial. If that were not the case, record companies would be selling songs left and right for commercials. Ask where they're going, they'll tell U – "Nowhere"

there's a difference between a cover and a sample. anyone can cover any song. you have to get permission from the publisher to sample it, because you're radically changing the song or incorporating it into your own work.
