NPGMC is been sued The NPG music club is been sued by Nature Publishing Group. Thats why the site has gone. Apparently the Nature group are suing as NPGMC want to go into selling books, liturature etc and that may cause conflict with what Nature Publishing Group do which is sell books. So until the legal jargon is sorted Prince can't, and depending on court decision, may not be able to trade using NPG logo. Notice that he started wearing the symbol necklace again and not the NPG logo, that may have something to do with it too! Just thought i would let you know. I dug up info that indicated he was been sued fron trade and commerce and then a few quakers have also come up with the info that it is Nature Publishing Group who are suing.

apparently they use NPG logo in the books and apparently from what i have learnd NPG paisley have applied to trade selling books using the same logo, Prince may have been planning to bring out 3121 mag, or remember there was the journal in retail that had the NPG logo on the front. i posted links to the document on housequake. Breakdown basically is:
NPG Music Club started using the "npg music club" for commerce in 2001 (as alleged in their application for trademark) Nature Publishing Group started using the "NPG" in 1999 (as alleged in their petition). Nature has alleged that the two entities were able to "co exist" using the NPG until NPG music club filed its application for trademark in 2005 stating that they would be selling, among other things, books. their whole allegation is that npg music club selling books could confuse a consumer into believing that the books are being published by Nature Publishing Group. Paisley Park must file an Answer to the lawsuit by August 15th. I will post that document when it is available. | |

correct, Paisley Park filed for trademark of "npg music club" in 2005.
Nature Publishing Group filed in March of this year. However, Nature is alleging they used the name first, as they allege they first used it in 1999, Paisley Park's application alleged that they first used it in "commerce" in 2001 (commerce being the operative word here). Nature alleges they co-existed until NPG Music Club attempted to "sell books" under the name of "NPG" Now the name just "NPG" (as opposed to NPG Music Club) was filed by Paisley Park with first use in 1997, but that application/trademark does not state it is in use for "commerce", merely for "entertainment services, live musical and vocal performances and selling jewelry". That being the case, there is no infringment in using NPG for musical performances and selling jewelry, only in the use of commerce in selling books. NPG Records is also filed as a trademark by Paisley Park, but here again, for musical purposes only, and not for the use of commerce in selling books. So this one cannot be objected to either. I don't see why the whole site would have to be closed down, as even if they are intending to sell books, they aren't at the moment, and therefore are not in direct conflict just yet.
And if Prince wins the case proving he's been using the ngp moniker since '91 (pretty easy to prove I would have thought - there's this album called Diamonds & Pearls, see...!) then will he counter-sue and make them change their name?! | |
