To tell you the truth, I am very disturbed with this topic. In the first place, I would never dream of supporting bootleggers or any such nonsense, but now I realise I might have been unknowingly helping these people. I will admit I have bid on certain things on ebay listed as "rare", "one of a kind", etc., but only because I haven't found other retailers for the items I was interested in including 1-800-new funk, etc. I have an old computer that isn't compatible with all the new things on NPG's website...the ONLY reason I haven't joined. I would gladly pay my $100.00 bucks for a years service and not complain like the rest of the people who's posts I see here all the time. Older fans like me have to sort out where their money goes according to priority: mortgage, insurance, utilities, food, then what I want or need, like more Prince in my life! I thought nothing of plunking down $800.00 to take me and my love to a one night stay in Cleveland for "One Night Alone" this spring, even though we only live 85 miles away. Got to touch the tour bus as it was leaving! The thought of Prince looking into my personal files is absolutely ludicrous. I'm sure he has much better things to do with his time. The fact that I bid on ebay auctions that were pre-empted due to impingements on the artist's rights do not leave a bitter taste in my mouth, even though I was high bidder in several instances. After ebay informed me that the auctions were ended prematurely, I was contacted outside ebay by people not affiliated with those particular auctions offering the same item(s) for sale, although I did not buy. I wish he'd just go ahead and put up for sale things from the past, esp. old live concert video, the infamous Miles recordings, etc.

For those of you who may feel a bit fuzzy about what I wrote about being careful with writing SLANDER and LIBEL about someone on the web here's a good example of what you shouldn't do. This was taken from another discussion group I visit and this asshole is a LAWSUIT waiting to happen! He made some very SLANDEROUS comments about OPRAH and BILL CLINTON. Yes his email address is listed with these irresponsible remarks and if Oprah and Clinton find out, they'll be WIPPING THEIR ASS WITH THIS GUY! But the author of this trash thinks that he is ANONOMOUS, and that no one CAN FIND HIM!

So here it goes word for word what he wrote...

I think Prince has a fan database anyhow. Back when he had that thedawn.com site, he got fans to submit a questionaire that asked all sorts of questions.

I suppose because he is an artist & celeb, as well as a businessman who owns a company, he would have the law and police co - operation on his side, and rightly so.

However, If Prince was going to use techniques to track fans down, they should be valid reasons, such as a threat to his personal security, a stalker or something illegal, such as bootlegging.

This is the internet. It gives people personal freedom to have a voice, something which Prince sung in his lyrics may times (b glad that u r free), so weather someone says something positive or negative shouldn't be a reason to track that person down for slander. The lawsuits would run into the millions, it would be a complete waste of everyones time and energy.

Negative comments can work to Prince's advantage, it at least lets him know how fams feel about issues. Everyone is entitled to a view, and they should have a right to exercise it.

This kinda sounds like "Jay & Silent Bob strike back" movie where J & SB goes to everyone's house that bitch about them on the internet and kicks their asses!

obviously prince can find us. obviously he can track us down. that's not the issue. the issue is whether or not he has a cause of action regarding what may be published here on prince.ORG.

death threats, yes he has a cause of action. gossip, and speculation among the 'fams', no cause of action.

first, by definition the tort of 'slander' doesn't exist in this forum because the term 'slander' applies only to oral, or spoken, transmissions. this forum is purely written, and so by definition any defamatory remarks posted here by members of prince.ORG would be considered libelous.

second, because prince is a public figure, as are those who associate with him in certain instances, the standards regarding slander and libel do not apply to him and his cronies the same way they apply to average jane or joe on the street.

a public figure like prince must not only prove the libelous statement was made, but also that the statement was false, that the one who made the statement knew it was false and made said statement with a reckless disregard for the truth, meaning, maliciously. even so, it's much more difficult for a public figure to succeed on this basis.

unfortunately for prince, he cannot sue folks for expressing their opinions or for speculating on his personal life here on prince.ORG. those of us who post here and comment on prince's personal life enjoy what's known as a 'qualified privilege' to do so because prince, as a public figure, has willingly and knowingly exposed his life to the public eye.

I actually had the FBI come visit my roommate in college my freshman year to investigate his "bootlegging" activities...lol...that was freaky...apparently they only wanted information, not to haul his ass in or anything...my roommate didn't know just how "big" the people he worked for were, I guess...lol

Apparently it's amazingly easy to find out information from an e-mail address. I didn't sign up for my e-mail address using my real name or home address, but yet I always get spam mail with my real name, including my middle name, in the subject line, or with them using my home address. This has happened countelss times, with sites I've never visited, and the e-mail address it gets sent to is one that I only use to e-mail friends. Meaning, I don't shop with it. It is scary.

I am sorry but the "article' you linked is not something I would call a reliable source of information. Don't take my words as legal advice either, but please see that this website does not provide you with clear and correct facts. In fact I see this "article" more as a disguised form of advertising for all those privacy "protection" software they want to sell you.
It is also a bit outdated in internet terms, published already two years ago.

I will quote some of the claims they are making and debate them for you.


The first assumption fallacy these people make is that you would be somehow truly anonymous on the net; you are not completely anonymous and never have been.
Secondly, criticising is allowed within the scope of freedom of speech. Pure slander and libel is not and never has been, thus the law has not changed in anyway. In fact it has remained consistent. This article makes it seem as if "criticising" someone is illegal. That is very bad journalism. Worse, that is not journalism but badly produced and incorrect information designed to make you buy their products.



The fundamental right to privacy is what they should be concentrating on, instead they continue producing propaganda about freedom of speech, when it is clear that slander and libel are not part of your "freedom" of speech. These people may have missed some important connections.
Don't take my word on it, but if you really think these companies actually can and really want to protect your privacy in exchange for dollars you are wrong.
