The cd has shipped, nothing will happen. He can't stop bootlegers from using his image, symbol or unreleased tracks and he will not touch this case. The 'cease and desist' is exactly that, 'Please stop using my symbol or we will go to court.'

Just ship 2 million cds and say 'we won't do it again.'

These aren't bootleggers. These can be ordered removed from shelves by a judge if it goes that far. C&D letters are sent in case you end up in court. Then you can say "see judge we tried to work this out without litigation..."

I couldn't buy it at 2 Targets where I live. Said they were Pulled. Spencers had one with the wig for 49.99. I don't know why Checkout wouldn't let me purchase one. Well,

Actually the standard for proving trademark infringement is whether a reasonable consumer would be confused by the two logos. Also, a tradmark lasts for eternity and doesn't require registration.

For Copyright, the standard to prove infringment is (1) show you created the work and it is original, and (2) that they (a) copied the work (proven by showing access and substantial similarity), and (b) missapropriated it -- (proven by showing similarity that is non-trivial and of protectable portions of Prince's work) which basically means they copied parts of the work that were copyrighted. So they could put up a defense that prince's symbol isn't copyrightable since he took the bottom half of it, therefore they could use the bottom half as it is in the "public domain." - but since Prince had a circle and added something to the bottom, he in effect made something new and the work as a whole would by copyrighted. There's had a symbol too - so they are very very similar. Also, they've admitted access by saying they like prince and wanted to honor him - so they'd lose this case for copyright infringement.

also...They'd surely lose on the Trademark claim, as a non-prince fan may get the two symbols confused. (consumer confusion)

exactly. Anything that is manufactured and so-called pulled is still available. Just try to get the 'Gold Member', 'Saw 2' movie poster that was 'pulled'. I just bought the SAW poster last week.

C&D is such a scare tactic. BEWARE ALL YOU DOWNLOADERS! yeah right.

Alright dammit that's enough! How the hell can you copyright a symbol that has been in existence for centuries? That would be like E, W & F trying to copyright the Jupiter symbol that they've used on their album covers. It's just a damn symbol! Prince, you my boy and all but shit!!! Grow up! Thios is just stupid. They know what they are doing by using the symbol. Prince has it copyrighted. Aside from the legal issue, it is a matte rof integrity. You would think that any artist worth hearing would want to be identified by his or her work; not by the work of artist they like. If youre not Prince, why would you want to use the symbol? Prince should crush them in court.
