The lawsuit filed on behalf of The Artist asserted that the fanzine produced by Uptown Productions was using The Artist's copyrighted materials without his consent and, additionally, using these materials solely for their own financial and marketing gains. The Settlement Agreement, dated July 28, 1999, requires that Uptown Productions immediately stop using The Artist, his likeness, and his copyrighted materials for any purposes other than those that are editorial. The lawsuit's conclusion marks the second favorable legal decision for The Artist in as many months. A lawsuit became the only viable option for The Artist early this year as Uptown Productions, and the fanzine they publish dedicated to The Artist, began exploiting The Artist in a variety of ways, including using his Symbol for commercial purposes and misrepresenting bootleg materials as official Artist products. At the initial request of the Artist to cease use of such materials, alleging that use of materials was unauthorized and unofficial, Uptown refused and instead enjoyed the benefits of increased publicity and exposure. A counter suit filed by Uptown accused The Artist of abusing the legal process and called for declaratory relief with respect to The Artist's claims. Both The Artist's claims and those of the Defendant, Uptown, were quelled in the Settlement Agreement. L.
